In. the Matter of changing the grade of PAYNE AVENUE from a point 88 feet south of
the center line of Bush Avenue to a point 389 feet north of the center line of Bush
Avenue to conform to the proposed grade as shown on the Profiles hereto attached and
made a part thereof; and also changing the grade of BUSH AVENUE from East Line of Payne
Avenue to 100 feet east and also condemning and taking an easement in the land neces-
sary for slopes, cuts and fills, including right of removal of lateral support from
subject land or remainder thereof, occasioned by excavations thereof or construction
of slopes in the regrading and repaving of Payne Avenue within the limits -as mentioned
above
under Preliminary Order 206386 approved March 15, 1962
The Council of the City of St. Paul having received the report of the Commissioner of Finance
upon the above improvement, and having considered said report, hereby resolves:
1. That the said report and the same is hereby approved and adopted, and the said improvement
is hereby ordered to be proceeded with.

2. That the nature of the improvement which the Council recommends is to change the grade of
PAYNE AVENUE from a point 88 feet south of the center line of Bush Avenue to a point 389
feet north of the center line of Bush Avenue to conform to the proposed grade as shown on
the Profiles hereto attached and made a part thereof; and also change the grade of BUSH
AVENUE; from East Line of Payne Avenue to'100 feet east and'also condemn and take an ease- `-
ment in the land necessary for slopes, cuts and fills, including right of removal of
lateral support from subject land or remainder thereof, ;.. occasioned by excavations
thereof or constructiontf slopes in the regrading and repaving of Payne Avenue within,
the limits as mentioned above, in accordance with the blueprint hereto attached and
made a part hereof, the hatched portions showing -Le cuts and the shaded portions
showing the fills
with no alternatives, and that the estimated cost thereof is $3; 000.00
Resolved Further, That a public hearing be had on said improvement on the 17th day of
April. 1962 , at the hour of 10 o'clock A. M., in the Council Chamber of the Court
House and City Hall Building in the City of St. Paul. That the Commissioner of Finance give notice of
said meeting to the persons and in the manner provided by the Charter, stating the time and place of
hearing, the nature of the improvement and the total cost thereof as estimated.
