Butler to construct a. public sewer from the terminus of the existing public sewer in Walsh Park to a point in the public .alley south of Walsh Park that is approximately 15G-feet west of the east line of Lot 15, Block 14, in West Edd, St. Paul, Minnesota, as measured along the south line of said public alley. This is an emergency ordinance rendered necessary for the preservation of the public peace, health, and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: 206449 Section 1. That permission .and authority are hereby granted to Hilda V. Butler to construct a public sewer in Walsh Park to a point in the public -alley south of Valsh Park that is approximately 150 feet west of the east line of Lot 15, Block 1/,., in West End, St. Paul, Minnesota,- as measured along the south line of said publ-1-c alley; the following described property to be served by such sewer, may be connected ,therewith, for.said purpose, tirithout any requirement for any payment to said City therefor either an advance sewer assessment..deposit, or of otfaer nature: That part of Lots 15, 16, 17, 18, 19 and 20 in Block 1/+ in West End, St. Paul, Minnesota, described as follows: Beginning-at a stone monument at the northeast corner of Lot 15 in said Block 14, thence westerly ,along the northerly line of said Lots 15 through 19.,;a distance of 210 feet to a. point; thence southwesterly at an included angle with said northerly line of said Lots 15 through 19 of 1350 401a distance of 106.0 feet to a point in said Lot 20; thence south- easterly in a, straight line 175 feet more or less to a point in the northerly line of Ridge Street (now vacated) a distance of 235.0 feet westerly from the southeasterly corner of said Lot 15; thence southerly and parallel with the easterly line of said Lot 15 extended, a distance of 30 feet to a point in the center line of vacated Ridge Street, thence easterly along the said center line of vacated Ridge Street a distance of 235.0 feet to the intersection with the -said easterly line of said Lot 15 • r.aYir. extended; thence.northerly along said easterly line of said Lot 15 extended a, distance of 230 feet to place of beginning. '' Section 2. Thy.. Commissioner of Public IiOrks is hereby :authorized to issue a permit to Hilda V. Said permittee shall construct said sewer efntii4ely at her own expense, under the supervision and to the satisfaction of the Commissioner of Public Works, and in- accordance with the plans and specifications prepared by him. 2. Said permittee shall pay the cost of engineering and inspection of said work, and for the publication of this ordinance. 3. Said permittee shall properly protect all excavations made in phb3A-&3and both day and night so as to avoid all damage -or injury to persons or property; shall properly fill {and- tamp said pi bld-b' land to avoid settling and shall resurface, in accordance with the plans and specifications of the Department of Public Works, any portions of sai L:YhIsh Park Dr or the public alley south of same that are disturbed during the construction of the sewer. 4.. Said permittee,. after the inception of said work, shall prosecute same continuously.iAth diligence, and fully complete said work to the satisfaction and approval of said Commissioner on or before October 1, 1962. 5. Said permittee expressly agrees and undertakes to fully - indemnify and-hold harmless the City of Saint Paul, its agents, officers, and employees from any and all damages, claims, losses, judgments, suits or expenses arising out of or occasioned by the performance of the work contemplated by this permission and authority. 6. Said permittee shall furnish a bond to the City of Saint Paul in the sum of $10,000 conditioned to comply with all the terms of this ordinance and to sage harmless said City from all liability, loss, judgments, suits, costs, cha.rges,:and expense that may accrue to persons or property occasioned by the making of the improvement or arising out of same. 7: -Said permittee shall not proceed to- construct said sewer unless and until said permittee shall have fully complied with the provisions regarding insurance and indemnification contained in the City of Saint Paul Department of Public Works Specifications for Street and Sewer Construction dated April 1, 1959, Section r numbered 1.44., :as amended, and found on pages 1 -13 through 1 -17 of said 'Specifications applicable to contractors. For the purposes of this ordinance, the aforesaid section of said Specifications numbered 1.41+ shall be read as though the word " permittee" were substituted for the word "contractor" wherever the same appears in the aforesaid Section 1.44. Said Section 1.44 of the Specifications for Street and Sewer Construction in the City of Saint Paul is hereby incorporated herein by reference as fully and as completely as if set forth herein verbatim. Proof of compliance with the provisions of the aforesaid Section numbered 1.44 shall be in such form as the Corporation Counsel of the City of Saint Paul may direct, and the documents required by the Orloinel to'City Clerk PRESENTED BY T ORDINANCE 206449 COUNCIL FILE NO. ORDINANCE NO. -3- ,aforesaid Section 1.41. shall, after submission to the Corporation Counsel, be filed in the office of the Comptroller of the City of Saint Paul. Section 3. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health,,and safety.
