AN ORDINANCE AUTHORIZING THE ISSUANCE OF
A PERMIT TO WILDER FOUNDATION, A MINNESOTA
CORPORATION, TO CONSTRUCT AND MAINTAIN A
BUILDING OVER AND ACROSS CERTAIN EXISTING
SEWER EASEMENTS OF THE-CITY OF SAINT PAUL LOCATED
IN BLOCK 76 OF WEST ST. PAUL, PROPER, AND MORE
PARTICULARLY DESCRIBED IN COUNCIL FILE 100313,
APPROVED APRIL 9, 1935, AND COUNCIL FILE 19+262,
APPROVED OCTOBER 22, 1959. THIS IS AN EMERGENCY
ORDINANCE RENDERED NECESSARY FOR THE PRESERVATION
OF THE PUBLIC PEACE, HEALTH, AND SAFETY.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Commissioner of Public Works is
hereby authorized to issue a permit to Wilder Foundation, a
Minnesota Corporation, to construct and maintain a building
over and across certain existing sewer easements located in
Block 76 of West St. Paul Proper and more particularly described
in Council File 100313, approved April 9, 1935, and Council File
19+262, approved October 22, 1959, subject to the following terms
and conditions:

1) That said permittee shall forthwith furnish
and deliver to the City of Saint Paul a surety
bond in the penal sum of $10,000, made and executed
by said permittee, as principal, and a corporate
surety company duly authorized to transact business
in the State of Minnesota, as surety, to and in favor,
of the City of Saint Paul, as obligee, conditioned
that said permittee shall indemnify and hold harmless
said City of Saint Paul against all expense and -
liability on account of all claims, suits and judgments
arising out of or connected with the construction,
erection, maintenance and /or operation by said permittee
and /or its successor in interest of the aforementioned/
building, which surety bond shall be in such form as
shall be approved by the Corporation Counsel and shall
have such surety as shall be approved by the Commissioner
of Finance. The aforementioned bond shall remain in
force until such time as said building is completed and
thereafter until the Council of the City of Saint Paul
shall authorize the substitution of an undertaking by
permittee,or its successors or assigns, of the same
import.

2) That said permittee shall, prior to the commencement
of the construction and erection of said building, at said
permittee's own cost and expense, aad by a competent registered
architect or engineer, cause to be prepared and submitted to
the Commissioner of Public Works a set of proper detailed plans
#nd specifications for said structure, which shall be subject tc
approval by the Commissioner of Public Works.

3) Thatsaid permittee, and its successors and assigns,

abd liability on account of all damages, injuries,
claims, causes of action, suits and judgments on account
of injury to person and /or property arising from or
connected with the construction, erection, maintenance,
operation and /or removal of said building hereunder;
and that supplemental to all other obligations on their
part, jointly or severally, hereunder, said permittee and
its successors and assigns shall furnish and maintain,
and pay all premiums and other expenses for casualty
insurance coverage by a duly licensed casualty insurance
company in the amount of $300,000 against liability for
injury to any person and /or persons in any single accident,
and in the amount of $25,000 against liability for injury
to property in any single accident, and in said amounts and
for said purposes, respectively, indemnifying said permittee,
its successors and assigns and the City of Saint Paul against
liability on account of all claims of third persons-for-
injury to person and /or property arising from or connected
with the construction, erection, maintenance, operation and /or
removal of said building, hereunder, and shall furnish competent
evidence of said coverage, from time to time, to the Comptroller
of the City of Saint Paul.
Sec. 2. That said permittee shall within the period
of ten days next after the effective date of this ordinance,
file with the City Clerk, its written acceptance of this ordinance
and agreement to be bound by the provisions, terms and conditions
thereof, without limitation, which written instrument of acceptance
and agreement shall be in a form approved by the Corporation Counsel.,
Sec..3. This ordinance is hereby declared to be an .
emergency ordinance rendered necessary for the preservation of ',the
public peace, health, and safety.
Sec. 4. This ordinance shall take effect and be in
force from and after its passage, approval and publication.'

This will acknowledge and thank you for your letter of April 9 as well as
its enclosed copy of Ordinance No. 12175, granting Amherst H. Wilder
Foundation permission to construct and maintain a building over and
across certain existing sewer easements.
It is our interpretation of your letter and the provisions of the Ordinance
that to comply with both the Wilder Foundation must:
1. Pay the cost of publishing the ordinance, which was the amount of !
$21.12. r

2. File a bond in the amount of $10, 000. 00.
3. Provide acceptable evidence of public liability insurance which shall
indemnify the City of St. Paul against all loss and liability as set forth
in Paragraph 3 of Section 1 of said ordinance.
4. File an acceptance of the ordinance.
To satisfy the above requirements we are transmitting herewith:

1. The check of the Wilder Foundation in the amount of $21.12 in payment
of the cost of publication.
2. A $10, 000, 00 bond executed by the Wilder Foundation and the St. Paul
Fire and Marine Insurance Company.

3. A Certificate of Insurance to the City of St. Paul with maximum liability
limits equal to or in excess of the amount set forth in Paragraph 3 of
Section 1 of said ordinance.

Foundation has conformed to the terms of the ordinance. Your letter of
April 9, together with a copy of the ordinance should be ample proof that
permission has been granted, but I would appreciate your acknowledgment
of this letter stating that we have complied in all respects to the terms of
the ordinance and the requirements of your letter of April 9.
