RESOLVED, that, for good cause shown, pursuant to the
request of the ,appellant, Clarence Lowe, 601 Fourth Street S. E.,
Minneapolis, said appellant is granted leave to withdraw his appeal
for relaxation of side yard zoning requirement pertaining to Lot 21.,
Block 6, Hazel Park Fourth Addition, and that said appeal shall be
deemed to have been withdrawn and discontinued, and the proper City
officers hereby are authorized to refund to said-appellant the
filing fee in the amount of $20 deposited with the City Clerk for
the filing ofi the same, upon said appellant's return of Receipt No.

I am returning herewith request to the Council of Clarence
Lowe, 601 Fourth Street S. E., Minneapolis for refund of
a $20.00 filing fee paid by him on a zoning appeal.
We have checked into this matter and find that no work
has been done to process this appeal and therefore our
recommendation is that this refund be made.

Gentlemen:
I, Clarence Lowe, co -owner of Lots 20, 21, 22, 23, and 24 -
Block 6 of Haplpark Division 4 located on the north side of
Stillwater Avenue between White Bear Avenue and Pan Dyke
Street; am applying for a permit to construct a driveway
along the easterly 20 feet of the above description.
At the present time, this property is vacant but I am planning
to construct two apartment houses on this property. The
purpose of this appeal is to relax the regular eight foot side
yard buffer area, as stated in Chapter 60 -23, Section 5 -
Paragraph "d ". The need for this appeal is to permit a drive-
way along the property line which is contiguous to Adrian
Livington's property.
The right to appeal is found under Legislative Code Chapter
64 -03.

I, Adrian Livington of 1815 Stillwater Avenue, St. Paul,
Minnesota,,owner of Lot 25 - Block 6 of Hazelpark Division 4; ;
have an easement from Harold Hubert and Clarence Lowe, owners
of Lots 20, 21, 22, 23, and 24 - Block 6 of Hazelpark Division
4, to use the east 10 feet of LOt 24 - Block 6 of Hazelpark
Division 4 for a driveway so that entrance can be gained to !
the rear of my lot from Stillwater Avenue. I, therefore,
request that a permit be granted them to construct a driveway
along their easterly property line, which is contiguous to
my property.
