WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a front two story, wood frame dwelling and rear, two story, wood frame, single
family dwelling located on property hereinafter referred to as the "Subject Property" and
commonly lrnown as 606 & 606'/: THOMAS AVEPiLJE. This property is legally described as
follows, to wit:
SMITHS SUBDIVISION OF BLOCK 12, STINSONS DIVISION OF ST. PAUL, MINN. LOT
12 BLK 12
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or befare March 13, 2008, the
following are the now Irnown interested or responsible parties for the Subject Property: IndyMac
Bank FSB, 460 Sierra Madre Villa, Suite #101, Mailstop HS O1-04, Pasadena, CA 91107;
Shapiro, Nordmeyer & Zielke, 12550 West Frontage Road, suite 200, Burnsville, MN 55337;
Joseph Lazson, 1240 Selby Ave, St. Paul, MN 55104; Thomas-Dale District 7 Planning Council.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an arder identified as an"Order to
Abate Nuisance Building(s)" dated May 14, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this arder informed the interested or responsible parties that they must repair
or demolish the structure located on the Subj ect Property by June 13, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constihxte a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and ,
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul I,egislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, August 12 and August 26, 2008 to hear testimony and evidence, and

after receiving testimony and evidence, made the recommendation to approve the request to
order the interested ar responsible parties to make the Subject Property safe and not deh
to the public peace, health, safety and welfare and remove its blighting influence on the
community by rehabilitating this structure in accordance with all applicable codes and
ordinances, or in the alternative by demolishing and removing the structure in accordance with
all applicable codes and ordinances. The rehabilitation or demolition of the structure to be
completed within fifteen (15) days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
September 10, 2008 and the testimony and evidence including the acrion taken by the
Legislarive Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 606 & 606 %2 THOMAS AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolitiou and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Deparhnent of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 haue been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the altemative by demolishing
and removing the structure in accordance with all applicable codes and ardinances. The
rehabilitarion or demolition and removal of the structure must be completed within

If the above corrective action is not completed within this period of rime Depariment of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shail be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is fixrther ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislarive Code.

The building is a one and one-half-story, wood frame, duplex with another detached one-story,
wood frame, single-family dwelling, both on a lot of 4,792 square feet,
According to our files, they have been vacant buildings since May 3, 2007.
The current property owner is IndyMac Bank, FSB, per AMANDA and Ramsey county property
records.
The City of St. Paul has boarded these buildings to secure from trespass.
There have been twelve (12) SUMMARY ABATEMENT NOTICES since 2007.
There have been eleven (11) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Boarding
- Removal of snow and ice
- Removal of tall grass and weeds
On Apri129, 2008, an inspection of the buildings was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on May 14, 2008 with a compliance date of
June 13, 2008. As of this date this property remains in a condition which comprises a nuisance as
defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $35,700 on the land and $103,500 on the
buildings.
As of August 13, 2004, a Code Compliance inspection has been completed.
As of August 5, 2008, the $5,000.00 performance bond has been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $50,000-$60,000. The
estimated cost to Demolish is $11,600 to $15,600.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

of Code Enforcement, hereby declares the premises located at:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter 45.02, and
subject to demolition under authority of Chapter 45.11.
On Apri129, 2008, a Building Deficiency Inspection Report was compiled and the following conditions were
observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As first
remedial action, a Code Compliance Inspection must be obtained from the Building Inspection
and Design Secrion, 8 Fourth Street East, Suite 200, Commerce Building (651)266-9090. That
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition. You may also be required to post a five thousand dollar ($5,000.00)
performance bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall not
again be used for occupancy until such time as a Certificate of Compliance or a Certificate of
Occupancy has been issued.

dwelling.
606 Thomas: Exterior
1. The foundation is deteriorated, defective or in a state of disrepair. Repair all foundation
defects in a professional manner to a weather-tight, water-tight and rodent-proof condition.
Permit may be required.
2. The eaves and soffits are in a state of disrepair or deteriaration. Repair all defects, holes,
breaks, loose or rotting boards, to a professional state of maintenance. Permit may be
required.
The window and/or door screens are missing, defective or in a state of disrepair. Provide
proper window and door screens for all openable windows and doors. Screens must be
tight-fitting and securely fastened to the frames.
4. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken
window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a
professional manner. Permit may be required.
5. The exterior walls of the house and/or garage are defective. Repair all holes, breaks, loose or
rotting siding, to a professional state of maintenance.
6. The exterior walls and/or trim of the house and/or garage has defective, peeled, flaked, scaled
or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound
condition in a professional manner.

7. There is evidence of improper wiring. Have a licensed electrical contractor certify system and
make necessary repairs.
8. There is a lack of Water Service.
9. The bathroom floor covering is deteriorated or inadequate. Provide floor covering which is
impervious to water and easily cleanable throughout the bathroom and seal around the edges
and fixtures.
10. The interior walls are defective. Repair all wall defects and finish in a professional manner.
11. The interior ceilings are defective. Repair all ceiling defects and finish in a professional
manner.
12. The carpet is in disrepair. Repair/replace or remove.

13. There is improper venting of the water heater. Repair.
14. The stairs are in disrepair. Repair.
15. FURNACE: Have a licensed heating contractor servzce and clean the fiunace or boiler and
make any necessary repairs. Perform a C/O test on the heating plant. Then, send the attached
form back to the Inspector. Repair of gas fired appliances requires a permit.
16. The stairs have missing or defective handrails. Provide all interior and exterior stairways and
steps of more that three (3) risers with handrails which are gippable and installed 34" to 38"
above the nose of the stair treads.

As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by June 13, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substanrial abatement process to

demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property tases as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enfarcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If co�ective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will thea
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if correcfive action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

Pursuant to your request the above-referenced properiy was inspected and the following report is

BUILDING
1. Install tempered glass window at top of stairs.
2. Remove drywall and insulation from basement bedroom and install vapor barrier at
fonndarion well before framing.

Habitable rooms with new usage, replaced windows shall have glass area equal to 8% of
floor area, or a minimum of 8 sq. ft., one-half of which shall operate and a11 bedroom
windows shall meet emergency egres requirements (20" wide minimum, 24" high
minnnum but noY less than 5.7 sq. ft. overall).
Provide general clean-up of premise.
Provide smoke detectors as per the Minnesota State Building Code.

4. Soil and waste piping has no front sewer clean-out.
5. Vent basement water closet and correct waste to Code.
6. Vent laundry tub and correct waste and water piping to Code.
7. Correct waste and vent at kitchen sink.
8. Correct waste and vent at first floor bathtub.
9. Install faucet on bathtub to Code.
10. Repair ar replace lawn hydrant(s).
11. Provide backflow assembly or device for lawn hydrant(s).
HEATING
L Clean and Orsat furnace burner. Check all controls for proper operation. Submit report.
2. Check furnace heat exchanger for leaks, provide documentation.
3. Replace furnace flue venting with three (3) screws per joint equally spaced.
4. Recommend adequate combustion air piped to floor and properly supported.
5. Provide support for gas lines to Code.
6. Plug, cap and/or remove all disconnected gas lines.
7. Install approved lever handle manual building shutoff gas va�ve in an accessible location
ahead of the fust branch tee. Provide access for 100 percent closure of valve. (Water line
in the way).

3. There was considerable storage/clutter within property at the time of the inspection. All to
meet appropriate Codes when complete.
4. All items noted as recommended do not have to be completed for code compliance but
should be completed at a later date. Possible purchasers of properiy shall be made aware of
these items.

11. Ordering the owner to remove or repair the building{s) at 606-606 1/2 Thomas Avenue
within fi$een (IS) days from adoption of resolution.
The property owner of record, IndyMac Bank, FSB, did not appear. No other parties of interest
appeared.
Mr. Ma�er stated the building was a one and one-half story, wood frame, duplex with another
detached one-story wood frame, single-family dwelling at the rear of the properiy on a lot of 4,792
square feet and had been vacant since May 3, 2007. A code compliance inspection had been done
on August 13, 2004, the vacant buiiding registrarion fees were current, and the $5,000 performance
bond had been posted on August 5, 2008. On April 29, 2008, an inspection of the building was
done and a list of deficiencies which constitute a nuisance condition was developed. An order to
abate a nuisance building was posted on May 14, 2008 with a compliance date of June 13, 2008. Tc
date, the property remained in a condition which comprised a nuisance as defined by the Legislafive
Code. Ramsey County Taxation estimafed the market value of the land to be approximately
$35,700 and the building to be $103,500. Real estate taxes were current. Code Enforcement
estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for
demolition was estimated to be approximately $11,600 to $15,600. There had also been 12
summary abatements issued to this property since 2007, ll of which went to work order: to secure
the building and fhe City had to board the building to secure it from trespass, remove improperiy
stored refuse, boarding, cut tall grass and weeds, and remove snow and ice. Code Enforcement
recommends the building be repaired or removed within 15 days. Mr. Magner presented
photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that the front building was an
1884 workers cottage-style building. These properties were located in the potential historic
Frogtown district; however, it had not been surveyed. The siding was covered and there had been
some alterations. The rear house was built in the 1880s as well. In cases such as this, it was
common for a property owner to build a smaller house on a part of the lot and live Yhere while
building the larger house. She sh encouraged rehab of the buildings.
Mr. Magner stated that there was a long history of issues with this property and it was not the first
time iY had been through the legislative hearing process. Priar to Joseph Larson's ownership, the
property was owned by Julian 7ayasuriya and was then sold to Joseph Larson in 2006. The vacant
building file was opened on the front house on Apri130, 2007 and the file was opened on the rear
house on Apri128, 2004.
Ms. Moermond recommended continuing the hearing to August 26.

appeared.
Mr. Magner stated that tlus was a laid over from August I2. No one appeared and a letter was sent.

Ms. Moermond stated that she will bring this to the attention of Councilmember Carter.
Ms. Barr stated that from the last hearing, the HPC prepared a Historical review on the property and
she read it into the record. She also stated that she did a site visit on Sunday and took current
photos of the buiiding.
Ms. Moermond questioned how much it would cost to hire a qualified historian for this building.
Ms. Barr stated that this was more of a large context they are looking at it as a whole part of the
Frogtown Historic District. She suggested that the HPC discuss it. She was not sure of the cost as
an individual property. Ms. Moermond asked if the HPC could find someone to manage the
contract for the review. Ms. Barr responded that Ms. Spong would be the better person to ask.
Ms. Moermond recommended continuing the public hearing to October 14 for HPC or Historic St.
Paul to review.

Mr. Magner stated tkat legislative hearings were held on August 12 and August 26 in which the
owner did not appear.
Ms. Spong stated that the Historic Preservarion Commission had an interest in this property. She
said that she was awaze that Historic St. Paui was interested in this property as well and there was a
loan committee meeting that evening to discuss this property which she planned to attend Ms.
Moermond stated that she planned to attend that meeting as well.
