RESOLVED, upon :and pursuant to the Appeal of Garley Construction
Company therefor, under the Zoning Code, that the provisions of the Zoning
Code hereby are determined and varied as and-to the extent necessary for
the granting of a permit for the construction and maintenance of two 11 -unit
apaxtment buildings on Lots 10 through 16, Block 8, Rice Street Villas,
abutting the west side of Rice Street between Hoyt Avenue and 1,1heelogk
Parkway, in the Cityof Saint Paul, :and that<a permit therefor is granted'
unto said ,appellant.
RESOLVED FURTHER, that pursuant to the pertinent application of
said Company, a permit hereby is granted to said Company for the installation

The City Council requested that you prepare a resolution granting the
attached appeal of Garley Construction Co. for permit to relax the_density
standards of the Zoning Code . Chap. 60.24, for multi- residences on Lots 10
through 16, Block 8, Rice Street Villas, on the west side of Rice St. between
Hoyt and Wheelock Pkwy. AND the attached application of Garley Construction
Co. for permit to install and operate a 22-car .private off-street parking lot
in conjunction with two 11 unit apartment buildings on the welt side of Rice
St. between Hoyt Ave. and Wheelock Pkwy. described'as Lots -10 through 16,
Block 8, Rice Street Villas, in,accordance with plans approved April 5, 1962.

Dear Madam:
This is in the matter of Garley Construction Company's 1) appeal to relax
the density standards of Chapter 60.24 of the Legislative Zoning Code, and
2) application for a permit to install and operate a 22 car private off-
street parking lot in conjunction with two 11 -unit apartment buildings on
property located on the west side of Rice Street between Hoyt Avenue and
Wheelock Parkway and described as Lots 10 thru 16, Block 8, Rice Street
Villas. The property is zoned commercial.
The site has a frontage of 175 feet on Rice Street and extends to a depth
of 124.6 feet, resulting in an area of 21,805 square febt. To the south
-and adjoining are three vacant lots, farther south is a single - family
residence; north and adjoining is land which is vacant except for a bill-
board; east across Rice Street are commercial uses and a single - family
residence; west across an alley is a single - family residence fronting on
Albermarle Street.
The purpose of the appeal" is to relax the density requirements of 1,000
square feet per unit in order to permit the erection of two 11 -unit apart-
ment buildings on the site. Inasmuch as the deficiency amounts to only
195 square feet, this appears to be a reasonable request. The Traffic
Engineer has approved the plans which meet the standards for this type of
facility. The proposed development meets the standards for building ground
coverage.
In consideration of the above factors, the Board of Zoning recommends the
1) granting of the appeal to relax the required density standards and 2)
the granting of the permit for a 22 car private off- street parking lot on
the above described property in accordance with plans approved April 5, 1962.
