WHEREAS, based upon the recards in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before March 13, 2008, the
following are the now known interested or responsible parties for the Subject Property: Vcare
Properties LLC, Kou Vang, 22079 Ethan Ave, Forest Lake, MN 55025; Shapiro, Nordmeyer &
Zielke, 12550 West Frontage Rd, Suite 200, Burnsville, MN 55337; Argent Mortgage Company,
1 City Blvd West, Orange, CA 92868; MERS, PO Box 2026, Flint, MI 48501; Thomas-Dale
Aistrict 7 Planning Council.
WHEREAS, Depaxtment of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated May 14, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by June 13, 2008; and
WHEREAS, the enforcement officer has posted a placazd on the Subject Property
declaring this building(s} to constitute a nuisance condition; sub}ect to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, piace and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, August 12 and August 26, 20�8 to hear testimony and evidence, and
after receiving testimony and evidence, made the recommendation to approve the request to

43 to the public peace, health, safety and welfaze and remove its biighting influence on the
44 community by rehabilitating this structure in accordance with all applicable codes and
45 ordinances, or in the altemative by demolishing and removing the structure in accordance with
46 all applicable codes and ordinances. The rehabilitation or demolition of the shucture to be
47 completed within �fteen (15) days after the date of the Council Hearing; and

49 WFIEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
50 September 10, 2008 and the testimony and evidence including the action taken by the
51 Legislative Hearing Officer was considered by the Council; now therefore

53 BE IT RESOLVEA, that based upon the testimony and evidence presented at the above
54 referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
55 Order concerning the Subject Property at 290 CHARLES AVENUE.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollazs ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

1. The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and weifare and remove its

accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
fifteen (1S� days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of tune Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property ar fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.

The building is a two and one-half-story, wood frame, duplex with a detached two-stall gazage,
on a lot of 3,920 squaze feet.
According to our files, it has been a vacant building since 3uly 5, 2007.
The current property owner is Vcare Properties, LLC c/o Kou Vang, per AMANDA and Ramsey
county property records.
The City of St. Paul has boazded this building to secure it from trespass.
There have been two (2) StJMMARY ABATEMENT NOTICES since 2007.
There have been five (5) WORK ORDERS issued for:
- Removal of snow and ice
- Boarding
On May 5, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on May 14, 2008 with a compliance date of
June 13, 2008. As of this date this property remains in a condition which comprises a nuisance as
defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $29,900 on the land and $153,800 on the

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enfarcement Officer is required by law to post a placard on this properiy which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed wlthout the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The depariment is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If conective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abate�nent action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City sha11 abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

Ryan Krumrie, attorney with Shapiro, Nordmeyer & Zielke, appeared on behalf of the property
owner MERSC/Wells Fargo.
Mr. Magner stated the building was a two-story, wood frame, duplex with a detached two-stall
garage on a lot of 3,920 square feet and had been vacant since July 5, 2007. A code compliance
inspection had been done on July 24, 2007, the vacant building registration fees were current, and
the $5,000 performance bond had not been posted. On May 5, 2008, an inspection of the building
was done and a list of deficiencies which constitute a nuisance condition was developed. An order
to abate a nuisance building was posted on May 14, 2008 with a compliance date of June 13, 2008.
To date, the property remained in a condition which comprised a nuisance as defined by the
Legislative Code. Ramsey County Tasation estimated the market value of the land to be
approximately $29,900 and the building to be $153,800. Real estate taYes were current. Code
Enforcement estimates the cost to repair the building to be approximately $100,000 to $110,000.
The cost for demolition was estimated to be approximately $12,230 to $16,230. There had also
been two summary abatements issued to this property since 2007, five of which went to work order:
to secure the building and the City had to board the building to secure it from trespass, boarding,
and remove snow and ice. Code Enforcement recommends the building be repaired or removed
within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was an
1889 Queen Anne-style building. It was surveyed and was located in the potential Frogtown
Historic District. The house was substantial in size, had good integrity, and had a polygonal corner
tower with a witch's hat. She noted that the original owner was Gilbert Holden who was also the
first owner of the property. She encouraged rehab of the building.
Mr. Krumrie stated that the redemption period expired in June, 2008 and MERSC purchased the
certificate at the sherifPs sale. Ae said that he had the unrecorded mortgage which he needed to file
with the County.
Ms. Moermond asked Mr. Magner about the summary abatement history. Mr. Manger stated that
they had issued orders in April, 2008, June, 2008 and July, 2008.
Mr. Kiuuirie stated that he had been informed the previous evening by the realtor, Mark Weibusch,
that he had a signed purchase agreement with Bye Properties LLC, the president of the company
being Mark Pasvogel. It was his information that Mr. Pasvogel would post the bond and intended to
rehab the property. According to the purchase agreement, the closing date was to be no later than
August 20. He was unsure why Mr. Pasvogel was present for the hearing.
Ms. Moermond asked whether the copper had been stolen from the building. Mr. Magner
responded that he was unsure; however, the building had been boarded four times since becoming
vacant. Ae said that since the code compliance inspection report was over a year old, it would be at
the discretion of Jim Seeger whether another inspection would need to be done. Mr. Magner stated
that the 2008 vacant building fee had not yet been paid. If MERSC did not pay the vacant buiiding
registration fee, the new owner would be required to pay the $1,000 fee.

Mr. Magner stated that this was a laid over from August 12. At that time, Ryan Knunrie, Attorney
for Shapiro, Nordmeyer and Zielke, representing the property owner appeared and Mai Vang sent a
letter indicating that all conditions must be met. Mr. Krunuie stated at the last hearing that he had
been informed the previous evening by the realtor, Mark Weibusch, that he had a signed purchase
agreement with Bye Properties LLC, the president of the company being Mazk Pasvogel. It was hi;
information that Mr. Pasvogei would post the bond and intended to rehab the property. According
to the purchase agreement, the closing date was to be no later than August 20.
Mr. Pasvogel stated that he his construction company was doing the work on the project and was
also the property management company that was maintaining the property. Ms. Moermond asked
how many properties he owned in the City. Mr. Pasvogel responded that they owned 12 which
were located all in Saint Paul. He said that he would have attended the first hearing if he had
lmown about it.
Ms. Moermond asked what his plans were for the property. Ms. Pasvogel responded that there was
major construction on the property. He estimated the total cost for the rehab is $83,805, including
all new windows, two new boilers (furnaces), electrical, plumbing throughout, upstairs and
downstairs venting, new carpet throughout, new cabinets, new kitchen and bathroom flooring,
toilets and landscaping on the outside. As of now, he had not done the siding because he had not
gotten a bid for it.
Ms. Moermond asked whether the copper had been stolen from the building. Mr. Pasvogel
responded it had. He also noted that the pipes were never winterized so the pipes froze and when
they thawed, the pipes expanded and cracked.
Ms. Moermond stated that the City's estimate cost for the rehabilitation was $100,000. Mr. Magner
stated that Mr. Pasvogel indicated that with him doing the majority of the work and if he decided to
do siding on the building, it would be close to the City's estimate. Mr. Pasvogel stated that if he
were to do the siding, it would be an additional $11,000.
Ms. Moermond questioned whether this was a duplex. Mr. Pasvogel responded that to his
lrnowledge it is a duplex. Ms. Barr stated that as for historical, it was inventoried in the 1983
survey and is located in the potenrial Frogtown Historic District however, it has not been
designated yet. This was a very substantial house with a vacant lot next door, the three-story bay
tower seemed to be in great condition but the original siding had been covered.
Ms. Moermond recommended Mr. Pasvogel provide the following by the close ofbusiness on
September 3: 1) provide a work plan; 2) provide fmancial documentation; 3) the vacant building
registration form must be completed (one was provided to them at hearing); 4) the vacant build'mg
fees must be paid for 2008. Ms. Voss-Weber stated that they are waiting to close on the house to
pay the fees.
