WHEREAS, on the 24th day of April,1962, a letter was
received by the City Council from R. H. Berry, 1796 West
Minnehaha Avenue, informing the Council that on April 14
at approximately 9:20 PI.M. a bullet struck a window over a
doorway of the porch at 1796 West Minnehaha Avenue damaging
the same and necessitating repairs in the amount of $15.00;
and
WHEREAS, said bullet was discharged by police officers
of the City of Saint Paul while in performance of their offi +cial
duties on said date and near said address, and it is in the
interests of the citizens of the City, of Saint Paul that said
officers perform their duties and that the property of no
citizen be thereby unnecessarily damaged,
Now, Therefore, be it
RESOLVED, that pursuant to Section 418.11, Minnesota
Statutes 1941, the proper City officers are hereby authorized
and directed to pay to said R. H. Berry the sum of $15.00 upon
said claimant's execution of a release in full of the City
and its police officers, said release to be in a form approved
by the Corporation Counsel, and said payment to be made out of
Judgment and Compromise Fund.
