44" WHEREAS, in connection with the construction of
the ATWATER -KENT Relief Sewer System, it has become necessary
to construct and maintain certain sewer facilities, specifically
-two 15 -1nch sewers, one 24 -inch sewer, and two 60 -inch sewers
under the tracks and property owned by the Great Northern
Railway Company, in the City of Saint Paul, County of Ramsey;
and
WHEREAS, the exact location of said sewers underneath
said railroad tracks is shown on a certain drawing designated
as "Exhibit A" and made a part of the agreement hereto attached
and herein authorized between the Great Northern Railway Company,
lessor, and City of Saint Paul, lessee;and
-WHEREAS, the Great Northern Railway Company, lessor,
in consideration of the payment`of One Dollar, has agreed to
grant to the City of Saint Paul license and permission to
construct and maintain said sewer facilities underneath said
railroad tracks, said grant to be in the form of agreement hereto
attached and made a part hereof by reference; and
` WHEREAS, -it is in the interests of the City of''Saint Pahl
that said City accept such license and permission from the {Great
Northern Railway Company and pay to the Great No Ahern Railway
Company the sum of One Dollar; now, therefore, be it
RESOLVED, That the proper City officers are hereby
authorized and directed to execute on behalf of the City of
Saint Paula license agreement in the form hereto attached and
made a part hereof by reference; and be it
FURTHER RESOLVED, That the proper City officers are
hereby authorized and directed to remit to the Great Northern
Railway Company, as and for consideration for said license, the
sum of One Dollar.
