In the matter of......�nging_thegrade of PAYNE AVENUE from a point 88 feet south -of the

center`line of Bush Avenue to a point 389 feet north of the center line of Bush Avenue,
and also changing -the grade of BUSH AVENUE'from East line of Payne Avenue toilOO feet
east to conform to the,proposed grade as shown on the profile on file in the Department
of Public Works, and also condemning and taking an easement in the land necessary for
slopes, cuts and fills, including right of,removal of lateral support from subject land
or remainder thereof, occasioned by excavations thereof or construction of slopes in
the regrading and repaving of Payne Avenue within the limits mentioned'abovet

The Commissioner of Finance having submitted his report in the above matter as to the amount of
damages awarded for the taking of the land or' easements therein appropriated for the above improvement
and to whom payable; and also having submitted his assessment of benefits to property from the making
of said improvement, therefore be it -
Resolved, That the said assessment of benefits be and the same is hereby ;approved.

Resolved further, That a public hearing be had before the Council upon said report and for a confirma-
tion of the awards of damages made by the Commissioner of Finance, and also upon the said assessment of
benefits; at the Council Chamber, in the Court House in the City of St. Paul on the ........... #
