08-1014 � CouncilFile# c���l/ �_ ____— - - - � eenS�ee�OS8296 RESOLUTION Presented by 1 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of 2 noise in the City of Sa3nt Paui; and 3 4 WHEREAS, §293.11 provides for the �anting of variances from the sound level limitations 5 contained in §293.09, upon a fmding by the City Council that full compliance with Chapter 293 would 6 consritute an unreasonable hardship on the applicant, other persons or on the community; and 7 WHEREAS, The University of St. Thomas / STAR, represented by Jese Ledbetter and Matt Gustafson, Assistant Directors of Campus Life who have been designated as the responsible persons on the application, has applied for a variance to present live music at Foley Plaza, on the University campus at 2ll5 Sumuiit Avenue; and WHEREAS, applicant is seeking a variance for the hours of 7:00 p.m. unti19:00 p.m. on September 19 and 20, 2008; and WFIEREAS, if applicant is not granted a variance it will not be able to present live music at 2ll 5 Suminit Avenue; and WHEREAS, the Department of Safety and Inspections has reviewed the application and has made recommendations regarding conditions for the variance; now, therefore, be it 22 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to The University 23 of St. Thomas !
