WHEREAS, In the matter of Comptroller's Contract L 6406
for the installation of traffic signals at Johnson Parkway
and Maryland Avenue, Pelham Boulevard and Franklin Avenue,
Lexington Parkway and Van Slyke Avenue, Randolph Avenue and
Edgcumbe Road, Randolph Avenue and Lexington Parkway, and re-
vising traffic signals at Lexington Parkway and Como Avenue,
and interconnection of traffic signals on Lexington Parkway
from Randolph Avenue to St. Clair Avenue, and between Como
Avenue and Van Slyke Avenue, Commonwealth Electric Company,
Contractor, the specified date of completion was January 1,
1962 and
WHEREAS, The Contractor has prosecuted the work diligent-
ly, but due to delay in the delivery of materials caused by
conditions beyond the control of the Contractor, it was not
possible to complete the Contract by said date of completion,
therefore, .be- -i t
- RESOLVED, That the proper City Officials be and they are"
hereby authorized and directed to execute an amendment to said
Contract extending,the time of completion to March 1, 1962,
provided, however, that this resolution shall have no force
or effect unless the sureties on the Contractor's bond consent
thereto and file such consent in writing with the City Comp-
troller, and be it
FURTHER RESOLVED, That the City of St. Paul hereby waives
all claim for liquidated damages and that no engineering and y
inspection costs on this project will be charged by the City
on account of such extended period.
