O'Connell City Clerk Building Dear Madam: This is in the matter of the appeal of Margaret C. Hansen to establish a ten - foot building line set back from,Ross Avenue on ' properrty located at the northeast corner of Ross and White Bear Avenues. The property is described as the south one -half of Lots 16 and 17, Block 2, Aurora Addition. The zoning is commercial.,._ The site is now vacant except for a billboard. The applicant proposes to develop the property with a one -story building to be occupied by a furniture store. The site has a frontage of 61.3 feet on White Bear Avenue and 75.8 feet on Ross Ave- nue resulting in an area of approximately 7,155 square feet. The property was originally platted with its frontage on Ross Avenue as are the remaining lots in the block to the east. The zoning classification of the lots in the block farther to the east is "A" residence, therefore a building line set back of 24 feet (20% of the average depth of these lots) is required for the entire frontage. In order to have a building of sufficient size, the applicant is requesting permission to construct it to within ten feet of Ross Avenue which requires Council authorization. Directly east and adjoining are two vacant lots which were recently classified to commercial district so that they could be utilized for off- street parking in connection with commercial activities now along White Bear Avenue. South and Y across Ross Avenue is a supermarket and parking lot which front on both White Bear and Ross Avenues; west and across White Bear Avenue is a single - family resi- dence fronting on said street; north are various commercial activities fronting on White Bear Avenue. Field investigation discloses no basic objection to this requested relaxation as the proposed building would not be closer than 80 feet to the nearest residence fronting on Ross Avenue, and the proposed off- street parking lot which would be directly adjoining the property under consideration can be installed to within 12 feet of Ross Avenue. The Board of Zoning considered this matter at their regular meeting of February 1, 1962, and it is the Board's opinion that a denial of this request would.serve a hardship on the applicant, and the granting of same would be in accordance with the purpose and intent of the Ordinance. This property is classified. in the Commercial District and has been since 1922. It is our intent to dvelop this property with a.one -story commercial store building which would front on White Bear Avenue. Under chapter 62 of the Legislature Zoning Code (see attached sheet) it is.necessary to maintain a building line setback from Roas Avenue of approximately 20 to 22 feet in that the block is partially in the "A" residence district. We, therfor request that this setback be relaxed to 10 feet as the property does not lend itself to a proper- use under these'conditions. - ''This appeal is permitted under chapter 64.03 par- , agraph of the,Legislative Zoning Code.
