O'Connell City Clerk Building Dear Madam: This is in the matter of the appeal of Mr. and Mrs. William Casper to es- tablish a 15 foot set back from Pleasant Avenue and a six -foot set back from Monroe Court on property described as Lot 17, Block 11, Ridgewood Park and located at the easterly corner of Monroe Court and Pleasant,Avenue. The property is zoned "B" residence. The property is vacant and at approximately the street grade of both Pleasant Avenue and Monroe Court. The Highway Department is taking the applicant's property at 1673 W. Seventh Street and 'If the appeal is granted, the applicant proposes to move his residence from the Seventh Street location to the property under consideration. This is a triangularly shaped tract of land having a .frontage of 129 feet on Monroe Court and 155.65 feet on Pleasant Avenue, result- ing in an area of approximately 5,653 square feet. Because of the double street frontage, the City Architect has ruled that a building line set back equal to 20% of the depth of the lot must be maintained from both streets. The lot is of sufficient size to accomodate the residence, but it is not possible to main- tain the required set back from both streets. Therefore, it is necessary for the applicant to appeal to the Council for a relaxation of said set backs. Field investigation discloses that a recently constructed single - family residence adjoining on the east which also has frontage on both streets, maintains a set back of 15 feet from Pleasant Avenue. Because this lot is of greater depth, it maintains a set back of 32 feet from Monroe Court. The second lot to the east is vacant and also has double frontage; farther to the east at the northwest corner of Victoria and Monroe Court is a single - family residence which takes its frontage on Victoria Street. The area uses are single and two - family resi- dences. A study of this appeal by the staff indicates that the building proposed to be moved onto this lot may be situated in one of two ways, and in each case could maintain a 15 foot set back from Pleasant Avenue, but the set back from Monroe Court would have to be reduced to six feet. The Board of Zoning considered this matter at their regular meeting on February 1, 1962, and it is its opinion that the relaxation as requested would not have a detrimental effect on the adjoining property. A hardship does exist because of the peculiar shape of this lot. It appears that the relaxation would be in keeping with the purpose and intent of the Ordinance. Therefore, the Board of Zoning recommends the granting of the appeal to establish a 15 foot building line set back from Pleasant Avenue and a six -foot building set back from monr b;t Court on theabove described property be granted.
