1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two-story, wood frame duplex with a detached, two and a half car garage
4 located on property hereinafter referred to as the "Subject Property" and commonly known as 11
5 JESSAMINE AVE E. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before October 25, 2006,
the following are the now known interested or responsible parties for the Subject Property:
Karen Thao, 1276 Etna Street, St. Paul, MN 55106; Robert Thao, 513 Trilliuxn Lane, Hudson,
WI 54016; GreenPoint Mortgage Funding, 100 Wood Hollow Drive, Novato, CA 94945;

WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul L,egislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated June 1, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by July 2, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
deciaring this building(s) to constitute a nuisance condition; subject to demolirion; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, September 25, 2007 to heaz testimony and evidence, and after
receiving tesfimony and evidence, made the recommendafion to approve the request to order the
interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
rehabilitaring this structure in accordance with ali applicable codes and ordinances, or in the

and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen
(15) days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
October 17, 200'1 and the testimony and evidence including the action taken by the Legislarive
Hearing Officer was considered by the Council; now therefore
BE TT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 11 JESSAMINE AVENUE EAST.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to conect the deficiencies ar to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition haue not been conected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, VacantJNuisance Buildings.
That the laiown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

1. The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ardered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code

The Deparhnent of Safety and Inspections has declared this building(s) to constitute a
"nuisance" as defined by Legislative Code, Chapter 45. The Department of Safety and
Inspections has issued an order to the then known responsible parties to eliminate this
nuisance condition by correcting the deficiencies or by razing and removing this
building{s).
The property was re-inspected on July 9, 2007. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting
influence of this property. It is the recommendation of the Department of Safety and
Inspections that the City Council pass a resolution ordering the responsible parties to
either repair, or demolish and remove this building in a timely manner and failing that,
authorize the Department of Safety and Inspections to proceed to demolition and removal,
and to assess the costs incurred against the real estate as a special assessment to be
collected in the same manner as tases.

The building is a 2 story wood-frame duplex on a lot of 4,792 squaze feet.
According to our files, it has been a vacant building since October 26, 2004.
The current property owners are Robert and Karen Thao, per AMANDA and Ramsey county property
records.
The city has had to board this building to secure it from trespass.
There have been seventeen (17) SiJMMARY ABATEMENT NOTICES since 2004.
There have been eight (8) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
- Removal of snow and ice
On May 26, 2007, an inspection of the building was conducted, a list of deficiencies which constitute a
nuisance condirion was developed and photographs were taken. An ORDER TO ABATE A
NUISANCE BITILDING was posted on June 1, 2007 with a compliance date of July 2, 2007. As of
this date this property remains in a condition wluch comprises a nuisance as defined by the legislative
code.

Inspections, Division of Code Enforcement, hereby declares the premises located at:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On May 26, 2007, a Buiiding Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of de�iciencies is not necessarily all the de�iciencies present at this time. As first
remedial action, a Code Compliance Inspection must be obtained from the Buiiding
Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce Building
(651)266-9090. That inspection wiII identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition. You may aiso be required to post a five
thousand dollar ($5,000.00) performance bond with the Building Inspection and Design
Of�ce before any permits are issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.0� and shall not
again be used for occupancy until such time as a Certificate of Compliance or a Certificate of
Occupancy has been issued.
This is a two-story, wood frame duplex with a detached, two and half car garage.
Note: The owner did not show for the inspection. The inspection is based on the Code
Compliance Report dated October 2005.
Pursuant to your request the above-referenced property was inspected and the following report is
submitted:
BUILDING
1. Install drip over all doors and windows as per Code.
2. Install new gutters and down spouts on whole house and provide drainage to bring water
away from house.
3. Replace all damaged siding, paint and flash where needed.
4. Repair ar replace siding, trim and shingles as needed on garage.
5. Install new door at east side enhy of first floor unit.
6. Replace, sister or double all over-spanned floor joist and add joist hangers as per Code.
7. Repair foundation to keep silt and water from coming in.
8. Install a compiete handrail on basement stairs as per Code.
9. Repair walls and ceilings to provide a one-hour fire separation between units.
10. Replace bottom of vanity cabinet in second floor bathroom.
1l. Install tempered glass in second floor stairway window.
12. Provide electxical panel for second floor unit or a one-hour fire separation between ,
cammon areas and electrical panel for second floor unit with fire-rated doors.
13. Provide separate heating system for second floor unit.
14. Install windows in openings in garage.
15. Repair walls and ceilings throughout, as necessary.
16. Tuck Point interior/exterior foundation.
17. Repair soffit, fascia trim, etc. as necessary.
18. Provide hand and guardrails on all stairways and steps as per attachment.
19. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
20. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc. as
necessary.
21. Provide storms and screens complete and in good repair for ali door and window openings.
22. Fire block construction as necessary.
23 Where wall and ceiling covering is removed, attic, replace doors and windows, (insulation,
glass, weather stripping, etc.) shall meet new energy code standasds.

24. Re-level structure as much as is practical.
25. Prepaze and paint interior and exterior as necessary (take the necessary precautions if lead
base paint is present).
26. Any framing members that do not meet code (where wall and ceiling covering is removed,
members that aze over-spanned, over-spaced, not being carried properly, door and window
openings that are not headered, etc.) are to be reconstructed as per code.
27. Habitable rooms with new usage, replaced windows shali have glass area equal to 8% of
floor area, or a minimum of 8 sq, ft., one-half of which shall operate and all bedroom
windows shall meet emergency egress requirements (20" wide minimum, 24" high
minimum but not less than 5.7 sq. ft. overall).
28. Provide genera] clean-up of premise.
29. Provide smoke detectors as per the Minnesota State Building Code.
30. Provide general rehabilitation of garage.
ELECTRICAL
1, Remove unused wiring in basement.
2. Install GFCI receptacle adjacent to bathroom sink and replace other receptacle with a GFCI
protect type in first floor bathroom.
3. Rewire first floor stove and hood.
4. Install an additional receptacle in second floor kitchen.
5. Install GFCI receptacle adjacent to bathroom sink in second floor bathroom.
6. Insure proper fuses or breakers for all conductors.
7. Repair or replace all broken, missing or loose fixtures, devices, covers and plates.
8. Check all 3-wire outlets for proper polarity and ground.
9. Throughout building, install outlets and fixtures as per Bulletin 80-1.
10. Install smoke detectors as per Bulletin 80-1 and UBC.
11. Electrical work requires a Permit and inspections.
PLUMBING
1. Correct temperature and pressure relief valve discharge piping at water heater.
2. Correct gas venting at water heater.
3. The water heater has gas contzol valve parts missing.
4. The water heater was not fired or in service at the time of the inspection.
5. The water meter was removed; not in service at the time of the inspection.
6. Repair or replace all corroded, broken or leaking water piping.
7. Water system has improper piping or usage.
8. Dryer gas shutoff, connector and piping are inconect.
9. Provide proper pipe supports for soil and waste piping.
10. Correct waste at floor drain.
11. Correct waste at first floor lavatory to Code.

ZONING
1. This property was inspected as being a Iegal duplex with a non-conforming lot size.

NEIGHBORHOOA HOUSING AND PROPERTY IMPROVEMENT (NHPI) FOR
PERMITS TO BE ISSUED ON THIS PROPERTY,

3. This property is desio ated by the Vacant Buildings Department as a Category #3 which
requires a$2,000 Performance Bond or Deposit at the rime the permit is issued.
4. Provide plans and specifications for any portion of the building that is to be rebuilt.
5. Most of the roof covering could not be properly inspected from grade. Recommend this be
done before rehabilitation is attempted.
6. All items noted as recommended do not have to be completed for code compliance but
shouid be completed at a later date. Possible purchasers of property shall be made aware of
these items.

As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by July 2, 2007 the Department of Safety
and Inspctions, Division of Code Enforcement, will begin a substantial abatement process
to demolish and remove the building(s). The costs of this action, inciuding administrative
costs and demolition costs will be assessed against the property taxes as a special
assessment in accordance with 1aw.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Buiiding Inspection and Design Section, 8 Fourth Street, Suite i#200, Commerce
Suilding, (651}266-9090. This inspection wili identify specific defects, necessary repairs
and legal requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subject to demolition and removal by the City.
This placard shall not be removed without the written authority of the Depariment of
Safety and Inspections, Division of Code Enforcement. The department is further
required to file a copy of this "Order to Abate" with the City Clexk's Office.
If corrective action is not taken within the time specified in this order, the Enfarcement
Officer wi11 notify the City Council that abatement action is necessary. The City Clerk
will then schedule daCes for Public Hearings before the City Council at which time

As residents of.Jessamine Ave., we wish to convey our concerns regarding 11 East
Jessamine Avenue and express our support for its demolition. During the years that
this had been a rental property, we had to endure significant and ongoing problems
associated with this property and its tenants.
Examples are:
• Drug dealing and use
• Prostitution
• An illegal auto repair business in the garage with vehicles par•Ized in the alley
blocking access for other residents
• Noise, litter, gaNbage/furnitureitires/junkpiled behind the property, often
overflowing into the alley
• Lack of required trash collection service — Tenants often put theiY garbage in
neighbors'bins
• Unsupervised children
• Urzresponsive landlords
• Tall grass & weeds
• Lack of any maintenance to the dwelling and garage
This property has been vacant for 2 years now and continues to deteriorate. It has
had a negative impact on our property values and y�eality of life. Please remcave this

The Tri Area Block Ciub supports the demolition of i 1 East Jessamine Avenue. This property
lies within the boundaries of ow block club area and has long been considered a setback in our
efforts to improve the quality of life in our neighborhood.
This property became a probiem during tfie years it has been a rental. The Iandiords and tenants
changed over those years but ffie problems always remained—Issues stemming from the behavior
af tenams and a lack of maintenance/oversight on the pazt of property owners.
One of the owners, who at ttre time also owned 14 East Jessamine tocated across the street
(another problem property), stated at a public hearing regarding the demolition of 14 East that
the foundation at 11 East "was even worse." Since one af the reasons 14 East was torn down
was its poor foundation, then based on Yhe owner's statement, it is not unreasonable to assume 11
EasY should also be demolished
Block Club members have been trying for years to reverse the downward trend in our
neighborhood Unforiunately, the decline is outpacing our efforts. This is in part due to the
lengthy process involved in addressing these properties and also to the "snowball" effect they
have on surrounding properties. Residents move away in ftustration, their homes devalued by the
bIight are bought by absentee landlords, and the problems expand like tentacles throughout the
neighborhood. We urgently need to end this cycle or risk losing our livable neighborhoods.
Demolishing 11 East Jessamine would be one small step toward that goa1.

To Whom it may concern,
I am writing in regards to the properry 11 East Jessamine Avenue. This duplex has been
a constant source of drug and drug related acrivifies. A bfight on the neighborhood in
terms of the criminal element that continually lived in both rental areas, it beina a duplex.
I have lived in the neighborhood since 1982 I cannot remember the last tune that place
looked decent, or had decent law abiding citizens living in it.
11 East Jessauiine and its negligent owners and criminal occupants aze a perfect example
of just what has brought the Rice Street area to a place where we aze teetering on the edge
of becoming a realiy bad part of town to live in.
We cannot afford to live in a Woodbury, Eagan or Edina. Just because we haven't the
resources finazicially, does that mean we shouldn't have a ciean, safe neighborhood in
which to live? Does that mean we just have to put up with drugs and alcohol and the
deviant behavior that accompanies the type of people who rent these dumps, year after
year? Nicer neighborhoods would never put up with this they wouid never have allowed
it in the first place. So why do we????
You have an opportunity to make my neighborhood a better, safer place. VJe pray that
you will take action on this properiy and continue to help by ridding our neighborhood of
these unsafe, unfit houses that aze the biight of the Rice Street azea.

5. Ordering the owner to remove or repair the building(s) at 11 Jessainine Avenue East within
fifteen (15) days from adoption of resolution.
Mr. Magner stated the building was a two-story, wood frame, duplex on a lot of 1,742 square feet and
had been vacant since October 26, 2004. A code compliance inspecrion had been done on October 10,
2005. The vacant building registration fees were current and the $5,000 performance bond had not
been posted. On May 26, 2007, an inspection of the building was done and a list of deficiencies which
constitute a nuisance condifion was developed. An order to abate a nuisance building was posted on
June 1, 2007 with a compliance date of 7uly 2, 2007. To date, the property remained in a condition
which comprised a nuisance as defined by the Legislative Code. Ramsey County TaYation estimated
the mazket value of the land to be approxunately $55,600 and the building to be $119,900. Real estate
taxes for were current. Code Enforcement estimates the cost to repair the building to be approxunately
$60,000 to $70,000. The cost for demolition was estimated to be approximately $8,000 to $10,000.
There had also been 17 sununary abatements issued to this property since 2004 eight of which went to
work order: to secure the building and the City had to board the building to secure it from trespass,
remove improperly stored refuse, remove tall grass and weeds, and remove snow and ice. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner read into
the record the following letters requesting that this building be demolished: from Jeff Martens, Chair
of the Land Use Task Force for District 6 Planning Council; signatures of 18 neighbors to this
property; the Tri Area Block Club; and from Brian and Jean Lynch . Said letters aze attached and
made a part of these minutes. Mr. Magner stated that at the time the property was originally
condemned, Julian Jayasuriya owned the property and subsequently sold it to Robert and Karen Thao.
The property was currently in foreclosure. Mr. Magner presented photographs of the property.
The property owners of record, Robert and Karen Thao, did not appear.
Cl�ristina Weber, Wilford & Geske, appeared on behalf of the mortgage company, GreenPoint
Mortgage Funding. Ms. Weber stated that the foreclosure would occur on October 25. She asked how
long the property had been vacant. Mr. Magner responded that the property became a registered
vacant building on October 26, 2004.
Ms. Moermond asked Mr. Magner whether he or staff were aware of any changes to the condition of
the building since the code compliance inspection had been done in March, 2006. Mr. Magner
responded that he believed the owners had attempted to begin work without permits and was not aware
how much of the repairs they were able to accomplish. At some point, the owner's waiked away from
the property. He didn't believe the code compliance would be relevant as he did not believe the house
had been winterized during their ownership and prior to the mortgage company starting the foreclosure
process.
Ms. Weber stated that she had talked to Jim Seeger in Licensing and he indicated that a new code
compliance inspection was not necessary. She stated that the mortgage company had the code
compliance inspecrion report and a contractor had been into the properly. They were now waiting to
get a report back from the contractor based on the old inspection report. The mortgage company at this
tune was not willing to make a decision on whether to repair the building and was awaiting the report
from the contractor. Ms. Weber stated that she instructed her client on what would be expected as far
as posting the bond, a work plan, and financial plan, so that they were aware what was required if they
chose to repair the building.

Ms. Moermond stated that she would need this information, work plan, financial plan, and bond
posted, to her by the end of the business day on Friday, October 12, 2007. If there were any issues
with the information that was submitted, they would have time to work on it prior to the Public
Hearing on October 17.
Mr. Magner stated that for clarification, the Legislative Hearing Officer would grant addirional time to
repair if the registration form is submitted, the performance bond was posted, the work plan, and
financial plan were submitted, and the property must be maintained. Ms. Moermond stated this was
correct and all must be submitted by the end of business on Friday, October 12, 2007.
