PAUL WaXo entatives of varUNCIL ils of overnrrlent of Mi'E NO. — ,� OFFICE OF THE CITY ( }TerL>Jentaltirnmunny 50 COUNCIL RESOLUTION— GENE. said s subdivisions found it advr r themselves as a comb PEEfrENTED BY r whether modiflcatl- CC,t�MISSIONEa 1 action of the Sta'; .t7 be advisabl- • • *3 WHEREAS, representatives of various subdivisions of government of Minnesota have recently met concerning the rule of governmental immunity as it applies to said subdivisions of government,.and as a result found it advisable to comprise themselves -as a committee to consider whether ,codification of said rule by, action of the State legislature would be advisable; and WHEREAS, the formation of said committee to consider the present ,status of the rule of governmental immunity as aforesaid was motivated by pending court.appeals involving the rule, by recent court decisions in other states which have abrogated the rule, :and by the growing concern that application of the rule results in undue hardship to certain individuals who have suffered a loss; rand WHEREAS, the City Council of Saint Paul recognizes that unqualified abrogation of the rule would seriously impair the finances of many governmental subdivisions, including the City of Saint Paul and its school district, a.nd as a consequence such abrogation without +qualification might force a curtailment of governmental services to the citizens of this City and of other localities in the State; and WHEREAS 2 it appears prudent that if any encroachment be made, on the rule of governmental immunity, it be carefully considered and that legislative safeguards be enacted to protect the finances of all subdivisions of government in Minnesota so that all necessary services rendered to all citizens be .always available; now, therefore, be it R1;SOLVED, by the Council of the City of Saint Paul that the Corporation Counsel or a designated representative from his office be authorized and directed to serve as a member of the aforesaid committee and to report "back to the Council from time to time concerning the conclusions and recommendations reached by the committee.
