of the subject premises, pursuant to the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, fora permit to relax
the 8 -foot parking lot set back requirement of Section 60.23, subsection
5, paragraph d of said Zoning Code., in respect of the premises situate
on the east side of English Street between Conway Street and Wilson
.Avenue, described:as Lot 6 except the North 10.67 feet thereof, all.of
Lots 7, 81 9 sand the North 21.34 feet of Lot 10, Block 8; "2,a.stview
Addition No. 4, and that part of the vacated•alley adjoining same,
that said provisions of said Zoning Code be determined and varied
hereunder to the extent necessary for the gr.nting of said permit and
that said permit accordingly hereby is granted; be it
RESOLVED FURTHER, upon consideration of the pertinent
application of Wallace M. Mailand, owner of the subject premises,
that permit hereby is granted unto said applicant for the installation,
maintenance, and operation of ,an off - street parking facility, in con-
junction with two 17 -unit apartment buildings to be erected on the
above described premises, such off- street parking facility to provide
34 separate motor vehicle parking spaces and be constructed and main-
tained in accordance with the approved plans therefor, a copy whereof
is filed herewith, dated March 1, 1962, and subject to compliance
with the provisions of all ordinances governing the operation of
parking lots, aild to the condition that the sidewalk abutting said
premises be kept clean and free of ice and snow at all times.

Dear Madam:
This is in the matter of Wallace Mailand's 1) appeal to relax the
parking lot set back requirement of chapter 60.23, Section 5, Para-
graph "d" of t.be Legislative Code, and 2) application for a permit
for a 34 car private off - street parking lot on property located
on the east, side of English Street between Conway Street and Wilson
Avenue and described as Lot 6 except the north 10.67 feet thereof,
all of Lots 7, 8, 9, and the north 21.34 feet of Lot 10, Block 8,
Eastview Addition No. 4, and all that part of the vacated alley ad-
joining the above described lots. This is part of a larger tract
which was rezoned to 11C" residence on January 20, 1962.
The property is vacant and at the street grade of English Street.
The applicant proposes to develop it with two 17 -unit apartment
buildings with off-street parking accessory thereto. The site has
a frontage of 226.67 feet on English Street and a depth of 150 feet
resulting in an area of approximately 34,000 square feet. The appli-
cant's proposal meets the required standards for density and building
ground coverage. North and adjoining is vacant land proposed for
apartment development; to the south and adjoining is vacant land pro-
posed as a site for an apartment building; to the west and across
English Street is vacant land; to the east and at a lower grade is
the Eastview Shopping Center.
In-order to provide the necessary parking spaces and have as much
lawn area as possible, the applicant is requesting a relaxation of
the required 8 foot side yard,buffer, so the parking may extend across
the entire width of the property at the rear. Inasmuch as the entire
frontage in this block will be developed with apartment uses all of
which will have their parking at the rear, it does not seem reason-
able to maintain the 8 foot buffer between each parking lot. Field
investigation discloses no objection to the proposal as all of the park-
ing lots will be contigeous to each other. The Traffic Engineer has
approved the plan which meets the standards for this type of facility.
In consideration of the above factors, the Board of Zoning recommends
1) the granting of the appeal as above outlined, and 2) the granting
of the permit for a 34 car private off - street parking lot on the above
described property in accordance with plans approved March 1, 1962.

I, Wallace M. Mailand, hereby appeal your Honorable Body to waive the
eight. foot. side yard set -back ,requirements for parking lots having the
capacity of ten or more "spaces which adjoins property _classified in the
residence_ district.
This property is located on the East side of English Street between Conway
and Wilson'Streets and is described as follows:
Lot 6 except the North 10. 67 feet thereof, all of. Lots 7, 8
and 9, and the North 21. 34 feet of Lot 10, Block 8, East -
View Addition No. 4, and all of, that part of the vacated
alley in said Block 8 lying South 'of an Easterly extension
of the South line of said North 10. 67 feet of Lot 6 and lying
North of an Easterly extension of the South line of said.
.North 21. 34 feet of Lot 10.
We are proposing to develop this_ property with two, seventeen "unit apart-
ment buildings with offstreet parking for thirty -four (34) cars. The
property adjoining on the South sides and the ,North sides of the. subject
property will also be developed for multi- residence purposes and the
proposed off street parking for .these- two developments will immediately
adjoin my proposed parking facility. It appears no purpose or benefit
would be achieved by maintaining this set -back requirement. The re-
laxation of this required- eight -foot set -back would provide more adequate
yard area directly adjacent to these buildings. This appeal is being
made under Chapter 64. 03 paragraph I of the Legislative Building Code.
