A public hearing having been had upon the above improvement upon due notice, and the Council having
heard all persona, objections and recommendations relative thereto, and having fully considered the same;
therefore, be it
RESOLVED, By the Council of the City of Saint Paul that the precise nature, extent and kind of im-
provement to be made by the said City is
Condemning and taking an easement in the land necessary for the slopes, cuts
and fills, including right of removal of "lateral support from subject land or re-
mainder thereof, occasioned by excavations thereof or construction of slopes in
the grading and surfacing with bituminous material°
- the North and
South alley from Jenks Ave. to Lawson Ave. to the proposed change of grade
and the Council hereby orders said improvements tobe
RESOLVED FURTHER, that the following land, lands or easements therein be and the same are
hereby ordered to be taken, appropriated and condemned for the purpose of making said improvements, viz.:
For the slopes, cuts and fills, including right of removal of lateral support
from subject land or remainder thereof, occasioned by excavations thereof or con-
struction of slopes in the grading andA urfaeing with bituminous material -Q a -a;4ey

of grade to.the extent shown on the plan on file in the office of the Commissioner of
Pub1Z� FURTHER, That the Commissioner of Public Works be and is hereby instructed and
directed to prepare plans and specifications for said improvement, and the proper city officials are hereby
authorized and directed to proceed with the making of said improvement in accordance therewith.

RESOLVED, upon the recommendation of the
Commissioner of Public Works that Council File No. 208135,
approved July 17, 1962, and relating to the condemnations
of easements in certain lands necessary for slopes, cuts and
fills necessary in the construction, grading and surfacing
of a certain alley in Block 3, Governor Johnson's Addition
from Frank Street to the North and South alley and. the North
and South alley from Jenks Avenue to Lawson Avenue# be and
the same hereby is amended in the following particulars; that
the lands and easements ordered to be takeny appropriated and
condemned for the purpose of making the improvements called
for under the resolution, be amended so that the same are
described as follows
"For the slopes, cuts and fills, including the
right of removal of lateral support from sub-
ject ]sand or remainder thereof, occasioned by
excavations thereof or construction of slopes in
the grading and surfacing with bituminous material
the alley in Block 3, Governor Johnson's Addition
from Frank Street to the North and South alley
and the North and South alley from Jenks Avenue
to Lawson Avenue to the proposed change of grade
to the extent shown on the plan on file in the
office of the Commissioner of Public Works;"
and be it
FURTHER RESOLVED, that the City Clerk is directed
to attach a copy of this resolution to Council File No. 208135,•
and to insert in lieu of the description contained in the
second to last paragraph of the aforementioned resolution the
description contained in the body of this resolution, it being
the true intent and purpose of the prior resolution to describe
the lands as the same are herein described.
