Presented by
1 WHEREAS, Deparnnent of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two-story, wood frame, single family with two metal sheds located on property
4 hereinafter referred to as the "Subject Property" and commonly laiown as 1457 MECHANIC
5 AVENUE.

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before December 7, 2006,
the following are the now known interested or responsible parties for the Subject Property:
LTRW Land Development LLC, 971 Sibley Memorial Highway, Lilydale, MN 55118;
Professional Finance Incorporated, 2165 Woodlane Drive, Suite 100, Woodbury, MN 55125;

WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated May 21, 2007; and
WHEREAS, this arder informed the then laiown interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WFIEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by June 20, 2007; and
WHEREAS, the enfarcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condirion has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties haue been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, September 11, 2007 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the
interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The demolition of the structure to be completed within fifteen (15) days after the date of the
Council Hearing; and

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
October 3, 2007 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testunony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 1457 MECHANIC AVEN UE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been conected.

That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Deparhnent of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 haue been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within fifteen (15) days after the date of the Council
Hearing.
If the above conective action is not completed within this period of time Department of
Safety and Tnspections is hereby authorized to take whatever steps are necessary to

demolish and remove this structure, fill the site and charge the costs incuzred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislarive
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code

Order to Abate Nuisance Building(s)
Dear : Sir or Madam
The Vacant/Nuisance Buildings Unit, Department of Neighborhood Housing and
Property Improvement, hereby declares the premises located at:
1457 MECHANIC AVE
and legally described as follows, to wit:
AMES OUT LOTS LOT 3 BLK 2
to comprise a nuisance condition in violation of the Saint Paul Legislarive Code,
Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On April 17, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As
first remedial action, a Code Compliance Inspection must be obtained from the
Building Inspection and Design Sectian, 8 Fourth Street East, Suite 20�, Commerce
Building (651)266-9090. That inspection will idenrify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a five thousand dollar ($5,000.00) performance bond with the
Building Inspection and Design Office before any permits are issued, except for a
demolition permit.
This building(s) is subject to the restricrions of Saint Paul Ordinance Chapter 33.03 and
shall not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a two-story, wood frame, single family dwelling with two-metal sheds.

Interior
i. The bathroom floor covering is deteriorated or inadequate. Provide
floor covering which is impervious to water and easily cieanable
throughout the bathroom and seal around the edges and fixtures.
2. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for
all entry doors to dwelling unit(s).
3. Lack of Electricity. Immediately restore electrical service. Failure to
provide proper electrical service will result in these premises being
declared Unfit for Human Habitation and ordered vacated for lack of
this basic facility. Use of candles, fuel operated lighting or extension
cord wiring is not permitted while the power is off:
4. Lack of Natural Gas Service. Immediately restore natural gas service.
Failure to provide natural gas service will result in these premises being
declared Unfit for Human Habitation and ordered vacated for lack of
this basic facility.
There are missing or defective guardrails. Provide al] stairv✓ays,
porches, decks or steps which are more than 30" high with guardrails
and intermediate rails with openings in the guardrail no more than four
(4) inches apart and in accordance with the State Building Code.
6. The stairs have missing or defective handrails. Provide all interior and
exterior stairways and steps of more that three (3) risers with handrails
which are grippable and installed 34" to 38" above the nose of the stair
treads.
7. The interior ceilings are defective. Repair all ceiling defects and finish
in a professional manner.
8. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
9. There is evidence of a rodent infestation. Tmmediately exterminate and
elixninate all rodents from the entire building. Remove rodent
harborages in the yard areas. Tuckpoint the foundation if necessary to
rodent-proof the building to prevent re-infestation. Immediately remove
any dead rodents from the premises.
10. SANITATION: Immediately remove improperly stored or accumulated
refuse including; garbage, rubbish, junk, vehicle parts, wood, metal,
recycling materials, household items, building materials, rubble, tires,
etc., from yard. The Saint Paul L,egislative Code requires all exterior

property azeas to be maintained in a clean and sanitary condition.
Usable matezials must be stored in an approved manner, so as not to
constitute a nuisance.

11. Smoke Detector: Lack of properly installed and operable smoke
detector. Provide functioning smoke detectors in accordance with the
attached requirement, within 24 hours.
12. DEFECTIVE STAIRS. Stairs are broken, defective, or in disrepair.
Repair in a professional manner.
13. Lack of Water Service. Immediately restore water service. Failure to
provide water service will result in these premises being declared Unfit
for Human Habitarion and ordered vacated for lack of this basic facility.
14. The chimney is defecrive, deteriorated or in a state of disrepair. Replace
all missing or defective bricks, tuckpoint as needed to restore the
chimney to a professional state of maintenance and repair. Perxnit may
be required.
15. T'he eaves and soffits are in a state of disrepair or deterioration. Repair
all defects, holes, breaks, loose or rotting boards, to a professional state
of maintenance. Permit may be required.
16. The exterior walls and/or trim of the house and/ar garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
17. The exterior walls and/or trim of the garage has defective, peeled,
flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape
and repaint to effect a sound condition in a professional manner.
18. The foundation is deteriorated, defective or in a state of disrepair.
Repair all foundation defects in a professional manner to a
weather-tight, water-tight and rodent-proof condition. Permit may be
required.
19. The roof is deteriorated, defective, or in a state of disrepair. Repair or
replace the roof covering to a sound, tight and water impeivious
condition. Permit may be required.
20. The exterior walls of the house and/or gazage are defective. Repair all
holes, breaks, loose or rotting siding, to a professional state of
maintenance.

22. The window and/or door screens ue missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable
windows and doors. Screens must be tight-fitting and securely fastened
to the frames.
23. The windows and/or storm windows are in a state of disrepair. Replace
all missing or broken window glass. Make all necessary repairs to
frames, sashes, hazdwaze and associated trim in a professional manner.
Permit may be required.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by June 20, 2007 Neighborhood Housing
and Property Improvement, Division of Code Enforcement, will begin a substantial
abatement process to demolish and remove the building(s). The costs of this action,
including administrative costs and demolition costs will be assessed against the property
taxes as a special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce
Building, (651)266-9090. This inspection will identify specific defects, necessary repairs
and legal requirements to coirect this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsibie
parties.
The Enforcement Officer is required by law to post a placard on this properiy which
declares it to be a"nuisance condirion", subject to demolition and removal by the City.
This placard shall not be removed without the written authority of the Department of
Neighborhood Housing and Property Improvement. The department is further required to
file a copy of this "Order to Abate" with the City Clerk's Office.
If conective action is not taken within the fime specified in this order, the Enforcement
Officer will norify the City Council that abatement action is necessazy. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.

If the resolution calls for abatement acrion the Council may either order the City to talce
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if conective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including admuustrative costs will be assessed
against the property as a special assessment in accordance with law.

4. Ordering the owner to remove or repair the building(s) at 1457 Mechanic Avenue within fifteen
(15) days from adoption of resolution.
Mr. Magner stated the building was a two-story, wood frame, single-family dwelling on a lot of 35,719
square feet and had been vacant since October 27, 2006. A code compliance inspecrion had not been
done, the vacant building registration fees were delinquent in the amount of $250 and the $5,000
performance bond had not been posted. On April 17, 2007, an inspection of the building was done and
a list of deficiencies which constitute a nuisance condition was developed. An order to abate a
nuisance building was posted on May 21, 2007 with a compliance date of June 20, 2007. To date, the
property remained in a condirion which comprised a nuisance as defined by the Legislative Code.
Ramsey County Taxation estimated the mazket value of the land to be approximately $126,500 and the
building to be $24,100. Real estate taaces for 2006 were delinquent in the amount of $1,455.80. Code
Enforcement estimates the cost to repair the building to be approximately $50,000. The cost for
demolition was estimated to be approximately $12,000 to $I5,000. There had also been seven
suuunary abatements issued since 2006 to this property ten of which went to work order: to secure the
building and the City had to board the building to secure it from trespass, remove improperly stored
refizse, and remove tall grass and weeds. Code Enforcement recommends the building be repaired or
removed within 15 days. Mr. Magner presented photographs of the property.
Greg Kuntz appeared on behalf of LTRW Land Development LLC, the property owner of record. Mr.
Kuntz stated that he was one of the partners of LTRW and the property at 1457 and 1471 Mechanic, as
well as other parcels on Mechanic and Ames, were purchased at the suggestion of Sheri Pemberton to
be a part of the future development of Phalen Crossings. The City at the time, apparently, did not have
the funds to purchase the properties for the development so they did so at her suggestion. This part of
the development was proposed to be Phase 5; however, since the real estate market became flat, there
presently were no future plans to develop the site. LTRW had no fmancial interest in improving the
properties and he was merely at the hearing to obtain information. At this time, he was not sure
whether LTRW would have the desire to demolish the properties or if they would let the City do the
demolition. He questioned the proposed demolition cost.
Mr. Magner stated that the cost did not factor in whether the contractor would have to remove any
hazardous waste or contaminants which would be added as an addendum to the contract cost for the
demolition. He offered to faac a list of contractors that the City placed bids with for the demolition of
properties to Mr. Kuntz to review with his partners. He added that if the City were to bid out the
demolition of the buildings, there was an addition $500 administration fee and it would take
approximately six months for the assessment to be assessed onto the real estate taaces.
Ms. Moerxnond recommended the building be removed within 15 days with no option for repair.
