WHEREAS, based upon the records in the Rasnsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before October 25, 2006,
the following are the now known interested or responsible parties for the Subject Property:

WHEREAS, Department of Safety and Inspections has served in accordance with tke
provisions of Chapter 45 of the Saint Paul Legislative Code an order idenfified as an"Order to
Abate Nuisance Building(s)" dated May 22, 2007; and
WHEREAS, this order infortned the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by June 21, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Councii and the 5aint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
ptupose of the public hearings; and

WE�REAS, a hearing was held before the Legislarive Hearing Officer of the Saint Paul
City Council on Tuesday, September 11, 2007 and on Tuesday, September 25, 2007 to heu
testimony and evidence, and after receiving testimony and evidence, made the recommendation
to approve the request to order the interested or responsible parties to make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its blighting
3nfluence on the community by demolishing and removing the shucture in accordance with ail
applicable codes and ordinances. The demolition of the shucture to be completed within f5fteen
(15) days after the date of the Council Hearing; and
WfIEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
October 3, 20Q7 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 992 JAMES AVENL7E.

That the Subject Property comprises a nuisance condition as defined 'an Saint Paul
Legislat3ve Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated ta exceed
five thousand dollazs ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsibie parties to correct the deficiencies or to demolish and remove the
building(s).

That Department of Safety and Inspections has posted a piacard on the Subject
Property which declares it to be a nuisance condition subject to demolirion.
That this building has been routanely monitored by Department of Safety and

That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:

The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
siructure must be completed within fifteen (15) days after the date of the Council
Hearing.
If the above corrective action is not completed within this period of tnne Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislarive
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this rime
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code

The building is a 1 �/z story, wood fram� single family dwelling with a one-stall detached
garage on a lot of 4,356 square feet.
According to our files, it has been a vacant building since August 31, 2004.
The current property owner is JeFfrey E. Christensen, per AMANDA and Ramsey county
property and taxation records.
There have been two (2) SUMMARY ABATEMENT NOTICES since 2004.
There have been zero (0) WORK ORDERS issued.
On May 10, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on May 22, 2007 with a compliance date of
June 21, 2007. As of this date this properry remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $625.Q0.

This is a one and one-half story wood frame, single family dwelling with a detached one-

As owner, agent or responsible pariy, you are hereby notified that if these defieiencies and
the resulting nuisance condition is not corrected by June 21, 2007 Nei�borhood Housing
and Property Improvement, Division of Code Enforcement, will begin a substantial
abatement process to demolish and remove the building(s). The costs of this action,
including administrative costs and demolition costs will be assessed against the property
t�es as a special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Secrion, 8 Fourth Street, Suite #200, Commerce
Building, (65I )266-9090. This inspection will idenfify specific defects, necessary repairs
and legal requirements to conect this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, al] present or subsequent
renters and any subsequent ocvners. If yau sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, natify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placazd on this property which
declares it to be a"nuisance condition", subject to demolition and removal by the City.
This placard shall not be removed without the written authority of the Department of
Neighborhood Housing and Property Tmprovement. The department is further required to
file a copy of this "Order to Abate" with the City Clerk's Office.
If conective action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. ARer this hearing the City Council will
adopt a resolurion stating what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accardance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law. If you have any

3. Ordering the owner to remove or repair the building(s) at 942 7ames Avenue within fifteen (15)
days from adoption of resolution.
Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling with
a detached one stall detached garage on a lot of 4,356 square feet and had been vacant since August 21,
2004. A code compliance inspection had been done on November 1, 2004. The vacant building
registration fees were delinquent in the amount of $625 and the $5,000 performance bond had not been
posted. On May 10, 2007, an inspecrion of the building was done and a list of deficiencies which
constitute a nuisance condifion was developed. An order to abate a nuisance building was posted on
May 22, 2007 with a compliance date of June 21, 2007. To date, the property remained in a condition
which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation estnnated
the mazket value of the land to be approximately $43,700 and the building to be $120,000. Real estate
tases for were current. Code Enforcement estimates the cost to repair the building to be approximately
$15,000. The cost for demolition was estimated to be approximately $l0,OQ0. There had also been
two summary abatements issued to this property since 2004; none of which went to work order. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented
photographs of the property.
The property owner of record, Jeffrey Christensen, appeared. Christina Weber, Wilford & Geske,
appeared on behalf of Litton Loan Servicing, the mortgage company.
Ms. Moermond inquired about the estimated cost of the repairs. Mr. Magner stated that the estimate
was what the owner believed he would need to bring the property into compliance. He stated that the
roof was deteriorated and believed that water had infiltrated the attic. The owner indicated to him that
he planned to bring the building into compliance. Mr. Magner stated that the owner would need to hire
licensed contractors to do any of the electrical and plumbing work in the house.
Mr. Christensen stated that he purchased the property on October 29, 2004 with the intention of living
there and he believed the property had been vacant far approximately a year before he purchased it.
He had obtained the code compliance inspection and at that time, was in no hurry to complete the
repairs. He did have plans to repair the roof; however, he did not have the money to pay the bond and
was behind on his mortgage payments. He was now warking three jobs to pay offhis debt and to
afford the cost of the repaizs. He believed the electrical work had been done and planned to have the
remainder of the repairs up to code within six months. He stated that he was also awaze that he needed
to pull permits to complete the work.
Ms. Weber stated that Mr. Cluistensen was behind on his mortgage payments; however, the properiy at
this time was not in danger of going into foreclosure. She was attending the hearing as she was unsure
whether the property owner would be present and she needed to protect the interests of her client.
Ms. Moermond asked Mr. Christensen whether he was living at the property. Mr. Christensen
responded that he was living elsewhere and said that his mailing address was PO Box 65244 in St. Paul
55165.
Ms. Moermond stated that she didn't believe a new code compliance inspection would be necessary;
however, she did believe Jim Seeger, Licensing, may need to visit the property to determine whether
conditions had deteriorated. She would require Mr. Christensen provide a work plan, that would be in
accordance with the code compliance inspection report, which she would need to approve. Mr.

Christensen stated that he had a list ofwork that he had completed which he showed to Ms. Moermond
for her review.
Ms. Moermond recommended laying this matter over to the September 25 Legislative Hearing. At that
tune, she would require the following: 1) the $5,000 performance bond must be posted; 2) the vacant
building registration form must be filled out; 3) the vacant building fees in the amount of $625 must
be paid; 4) a work plan must be completed wluch would include bids from contractors and rimelines
for completing the work; and 5) a financial plan demonstrating the ability to complete the repairs must
be provided. Ms. Moermond stated that the work plan would need to be approved by her and that Mr.
Christensen would need to demonstrate that he had the financial ability to complete the repairs to the
property. If Mr. Christensen provided everything, she would recommend that the City Council grant
him 180 days to complete the repairs.

the owner to provide the following: 1) the $5,000 performance bond must be posted; 2) the vacant
building registration form must be filled out; 3) the vacant building fees in the amount of $625 must
be paid; 4) a work plan must be completed which would include bids from contractors and timelines
for completing the work; and 5) a financial plan demonstrating the ability to complete the repairs must
be provided. Mr. Magner stated that to date, the owner had not compfied with any of the conditions.
Christina Weber, Wilford & Geske, appeared and stated that since the property was not in foreclosure,
there was nothing that her client could do to save the property.
Ms. Moermond stated that a letter was sent to Mr. Christensen outlimng the list of conditions that
needed to be met and that the hearing was continued to today. Since the properiy owner failed to
comply with the conditions set forth from the September 11 Legislative Hearing, she recommended the
building be removed within fifteen (15) days with no option for repair.
