NO i I An ordinance amending the Zoning Code, - Chapters 60 to 61,, inclusive, of the Saint Paul Legislative Code, as amended, pertaining to Use Districts, Height Vistnicts and Rezoning of certain properties in the City of Saint Paul. This is an, emergency ordinance rendered- necessary for the - preservation of the public peace, health, and safety. THE COUNCIL OF THE CITY OF SAINT PAUL HOES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to 6/, inclusive, of the Saint Paul Legislative Code, ,as amended, pertaining to,Use Districts, Height.Districts. and Rezoning of certain-properties in the City of Saint Paul, be and the-same hereby is further amended so as to- rezone the following described property from "A" Residence District to Commercial District:- subject to 7 d Yeas Attest: 1. 2. The legal description is Lot 6 and-the northerly 10 feet of Loth, Block 2., Beaver Lake Heights Addition. 11 I .On August 9, 1962, the Commissioner of Finance reported the petition sufficient with the owners of 12 of a possible 15 (80 %) tracts of land within the prescribed 100 foot radius having signed the petition. The site is occupied by a single - family residence and garage, and the petitioner proposes to install a beauty parlor in the basement of the residence. This is an irregularly shaped tract of land with a front- age of approximately 50 feet on Nokomis Avenue and an average depth of 108 feet, resulting in an area of approximately 7,020 square feet. The surrounding area uses are all single - family residences constructed after World War No. 2. I Field investigation discloses that the entire surrounding area 'is developed-with single - family residences and the proposed rezoning would constitute a "spot zone" and would be detrimental to the existing area uses. The Board of Zoning considered this petition at its regular meeting on August 16, 1962, and recommends the denial of the petition to rezone the above described property to a commercial district. Hosking, 2267 Commonwealth Avenue, St. Paul 8, Minnesota, paid la fee of $10.00 to the office of the Building Inspector wit a request to inspect a double bungalow which was locate at 6201 -03 Lyndale Avenue, South in Minneapolis, as well�as a piece of property on Commonwealth Avenue - the legal des�ri- ption is Lot 3 Block 42 North St. Anthony Park - tolsee if the City would permit the relocation of the double bu galow to that particular piece of property. Uponp' completion of the inspection, I was informed the relocation would be all right. On the strength of this information I purchased the d uble bungalow and the lot on Commonwealth and contracted to have it moved and set up immediately. The building was movedland the excavation started when a City Inspector arrived and ordered all work at the site stopped. Shortly afterwards we were told that the work was stopped because the lot did not have the square feet necessary for a double bungalow and that there was a mistake in issuing the permit. After checking the building code it became evident that the lot was 590 square feet too small. I Since that time, we, with the help of the people in the Building Inspection Department, have tried to find a way out of this quandary and we were told that you were the proper body to apply to for help. Because of the length of time involved to make this appeal and have it answered, and because of the necessity of getting this building off of the street, we decided there is no alternative but to resubmit plans and a request to move the building in as a single unit. This has been done and XXX$ the building will be on the lot in a short time: i The lot requirements for a two family residence is (1) 50 feet of lot frontage - which this lot has. (2) a lot area of not less than 7"0 `square feet. This lot has approximately 6900 Sq . Ft. I The purpose of this appeal is a request to waive the isquare footage requirement on this lot. F. Koeper, for professional services to the Historic Sites Comm of the City Planning Board is hereby acknowledged. I have noted the changes as follows: 1. Paragraph 1 thereof, wherein it reads "twelve months from September 15, 1961," shall be changed to read "thirteen months from September 15,- 1961." 2. Paragraph 2 thereof, wherein appears the amount $750.00 shall be changed to read $850.00 3. Paragraph 3 (c) thereof, wherein it reads "not to exceed $500.00" shall be changed so as to read "not to exceed $400.00." 4. All other terms and provisions of the contract to remain the same as in the original document.
