SAINT PAUL, LEGISLATIVE CODE, -PERTAINING
TO USE DISTRICTS, HEIGHT DISTRICTS AND
REZONING OF CERTAIN PROPERTIES IN THE
CITY OF SAINT PAUL, AS AMENDED. THIS
IS AN EMERGENCY ORDINANCE RENDERED NECES-
SARY FOR THE PRESERVATION OF THE PUBLIC
PEACE, HEALTH, AND SAFETY.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to
64, inclusive, of the Saint Paul Legislative Code, pertain-
ing to Use Districts, Height Districts, and Rezoning of
certain properties in the City of Saint Paul, as amended,
be and the same is hereby further amended so as to rezone
the following described property from "A" Residence District,
to Commercial Distric -, to -wits
All of Lots 8 through 14, Joy's East End;
All of Lots 1 through 4 and all of Lots 23
through 28, Block 2, Lindley Heights; All
of Lots 2 through 7, Block 1, Lindley Heights;
That part of Lots 5, 69 7, 21 and 22, Bloc 2,
Lindley Heights which lie E'ly of a line I
described as follows: commencing at a point

The City Council requested that you prepare an ordinance granting the
attached petition to rezone certain property in the vicinity of English
St., Wakefield and Wilson Aves., as more fully described in the attached
petition, from "A" Residence to Commercial District, subject to compliance
with the recommendations of the Zoning Board for a 200 -foot screen planted
buffer beyond the west property line of the subject site and that a 5- oot
basket weave fence be provided along the west property line.

Dear Madam:
This is in the matter of the petition of Tobin -Smith Inc. to rezone from "A"
residence to commercial district property located in the vicinity of English
Street, Wakefield and Wilson Avenues. A copy of the legal description is
attached.
On August 10, 1962, the Commissioner of Finance reported the petition suffi-
cient with the owners of 18 of a possible 20 (907.) tracts within the prescribed
100 foot radius having signed the petition. On February 2, 1962, the City
Council denied a petition to rezone a larger tract which included thersubject
property. On.March 20, 1962, the City Council approved a request to withdraw
a petition to rezone the subject property. The site is presently vacant and
it is proposed to develop it with a luxury motel with restaurant facilities.
The property under consideration consists of 5 separate tracts of land separ-
ated by platted streets and alleys, none of which are improved. The property
has frontage along the south side of Wilson Avenue; the east and west 'sides of
unimproved English Street between Wilson and Wakefield Avenues and the north
and south sides of Wakefield Avenue west of unimproved English Street. The
5 tracts combined result in an area of approximately 156,253 square feet.'
Directly west and adjoining is vacant land which fronts on/Wakefield a!nd Wilson
Avenues, farther to the west are very substantial single - family residences'which
front on Johnson Parkway; north and across Wilson Avenue are a number of vacant
lots fronting on said street, also an apartment building now under construction
at the northeast corner of English Street and Wilson Avenue; east and Iadjoining
is vacant land which fronts on Wilson Avenue and Highway #12 right -of •,way;
south and adjoi'ni'ng is Highway # 12 right -of -way. '
The staff made no recommendation to the Board of Zoning because the petition
was not received in time to permit the necessary investigation and field check
usually made in rezoning matters.
The Board of Zoning considered this petition at its regular meeting on August 16,
'1962 and recommends the rezoning of the above described property subject to the
following conditions: (1) that A 200 foot screen planted buffer be provided be-
yond the west property line of the subject site, and (2) that a 5 footibasket-
weave fence be provided along the west property line of the subject property. '
The applicant agreed to both of these stipulations.
