CHAPTERS 60 TO 649 INCLUSIVE, OF THE
SAINT PAUL LEGISLATIVE CODE, PERTAINING
TO USE DISTRICTS, HEIGHT DISTRICTS AND
REZONING OF CERTAIN PROPERTIES IN THE
CITY OF SAINT PAUL, AS AMENDED. THIS
IS AN EMERGENCY ORDINANCE RENDERED NECES-
SARY FOR THE PRESERVATION OF THE PUBLIC
PEACE, HEALTH, AND SAFETY.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to
64, inclusive, of the Saint Paul Legislative Code, pertain-
ing to Use Districts, Height Districts, and Rezoning of
certain properties in the City of Saint Paul, as amended,
be and the same is hereby further amended so as to rezone
the following describes, property from "A1l Residence District
to "C" Residence District, to -wits
North 75 feet of the north one -half of
the east one -half of Lot 19 and the
north 75 feet of the west 60 feet of
Lot 20, J. W. Bass Garden Lots, .,_accord-
ing to the plat thereof on file and of
record in the office of the Register of
Deeds in and for Ramsey County, Minnesota,
being located on the southeast corner of
Mississippi Street and--Clear Avenue.
Section 2. This ordinance is hereby declared to
be an emergency ordinance rendered necessary for the preserva-
tion'of the public peace, health and safety.
Section 3. This ordinance shall take effect, and
be in force upon its passage, approval and publications.

This is in the matter of the petition to rezone from "A" to "C" residence
property located at the southeast corner of Mississippi Street and Clear
Avenue and described as the north 75 feet of the north one -half of the
east one -half of Lot 19 and the north 75 feet of the west 60 ,feet of Lot 20,
J.W.Bass Garden Lots. i
On. August 6, 1962, the Commissioner of Finance reported the petition
sufficient with the owners of 6 of a possible 8 (75%.) tracts of land
within the prescribed 100 foot radius having signed the petition. The
land is vacant and it-is proposed to consolidate this parcel with the
,property adjoining on the south and east which was recently reclassified
by the Council to "C" residence. The entire tract will be developed for
apartment use. The site has a frontage of 75 feet on the service road of
Highway 35E and 185 feet on unimproved Clear Avenue resulting in an area
of 13,875 square feet. The surrounding area land uses are entirely single -
family residences and vacant land classified in an "A" residence dIistrict.
Inasmuch as the property adjoining to the south and east has been :re-
classified to "C" residence, it seems reasonable to include this parcel
so that the major portion of this block can be developed with the same
land use.

Dear Madam:
This is in the matter of the petition of Hugh A. McMenemy to
rezone from "B" to "C" residence district property located at
the northwest corner of Bay Street and Butternut Avenue and
described as Lots 33 and 34, Block 2, Riverside Addition.'
On July 17, 1962, the Commissioner of Finance reported the
petition sufficient with the owners of 9 of a possible 10
(900) tracts of land within the prescribed 100 foot radius hav-
ing signed the petition. The site is vacant and it is proposed
to develop it with an 11 unit apartment building as indicated
on the petition. The property has a frontage of 80 feet on
Butternut Avenue and 125 feet on Bay Street resulting in a tota'
area of 10,000 square feet. This is an older neighborhood and
is developed predominantly with single - family residences which
are surrounded by industrial type uses and vacant land classi-
fied in an industrial district.
The Board of Zoning considered this petition at its regular
meeting on August 2, 1962, and it was the opinion of the Board
that the highest and best use of the land at this time was for
apartment development. Therefore, the Board of Zoning recomme
the granting of the petition to rezone the above described pro
perty to "C" residence.
