O'Connell City Clerk Building Dear Madam: OF SAINT PAUL SAINT PAUL 2, MINNESOTA August 22, 1962' 1 This is in the matter of the appeal of Joseph and Bernard Kessel to establish a building line of zero (0) feet for a canopy and five (5) feet for the building on property located on the east side of Snelling Avenue between St. Clair and Berkeley' Avenues and described as Lots 4 and 5, Block 4, Sylvan Park Addition. The property is zoned com- mercial. , On March 18, 1950, a permit was granted for a root -beer stand on the premises with the stipulation that the stand be set back at least six feet from Snelling Avenue. The site is developed with a small diner and the root -beer stand which is not in operation; the remainder of the site is used for off - street parking purposes. The applicant proposes to remove the existing facilities and develop the property with a one -story commercial building in which he intends to operate a bakery business which is now located on the lower West Side. The applicant will provide approximately nine off - street parking spaces.- The property has a frontage of 100 feet on Snelling Avenue and a depth of 122.46 feet resulting in an area of 12,246 square feet. Because of the split zoning in this block, the established building line is 24 feet, and in order to construct the proposed building as indicated on the applicant's plan, it is necessary to secure Council approval for the proposed building lines. Adjoining to the north and south are commercial uses which front on Snelling Avenue and are located from two to four feet from Snelling Avenue; east across a platted alley, and west across Snelling Avenue are single - family residences. Field investigation discloses no basic objection to the proposal as it will not have a detrimental effect on the adjoining commercial uses. The applicant's plan indicates that the off - street parking facility will be established in accordance with the standards for this type of facility and will also provide loading and unloading facili- ties at the rear of the building. In consideration of the above factors, the Board of Zoning recommends the granting of the appeal to establish a building line of zero (0) feet for the canopy and five (5 ) feet for the building on the above described property in accordance with plans approved August 2, 1962. 1 I— ZONING APPEAL Sincerely, rl H. Chair tl ,d-1. Gentlemen:' In conformance with the setback provision of Saint Paul for this particular property, we are required to set back 20% of the depth of the lot. In order to utilize the land most effectively for our purposes, we would need use of the entire property. Lund and Lange Flowers to the south of our property and a dry cleaning establishment to the north have been allowed to build to the sidewalk line. Therefore, we feel that precedents on this block have been set. We are, therefore, asking you to establish a building line on this property which will be the front property line._ i The advantages of building to the sidewalk line if the Council be willing to issue a variance in this matter would be considera- ble.
