2. That the owner of said real estate, within
the period of 60 days next succeeding the publica-
tion of this ordinance, shall file with the City
Clerk, in two (2) fully executed counterparts, said
owner's written acceptance of this ordinance, in-
corporating, among other things, said owner's grant
unto said City of Saint Paul of a negative easement
affecting said real estate for the imposition, main-
tenance and enforcement of the aforesaid restrictions
and limitations upon the employment and use of the
hereinabove described real estate, approved as to
form and execution by the Corporation Counsel and
recordable in the office of the Register of Deeds.
That said owner's written acceptance and grant of
negative easement shall contain additional effective
provisions for the restriction of said real estate
to, ses permitted in one or more of said Residence
Districts from and after any future sale, transfer
or alienation of the present ownership of,the same,
or use or occupancy of the same.
3. That, in addition to otherrequirements
therefor, said written instrument of acceptance and
grant shall incorporate a certified copy of this
ordinance, and immediately upon the aforesaid filing
of the same the City Clerk shall cause one of such`
counterparts thereof to be filed of record in the
office of-the Regis_ ter_ - of .Deeds in and for Ramsey '
County, - Minnesota.
Section 2. This ordinance is hereby declared ;to
be an emergency ordinance rendered necessary for the preserva-
tion of the public peace, health and safety.
Section 3. This ordinance shall take effect and
be in force upon its passage, approval and pxblication. i

Dear Madam:
This is in the matter of the•petition of John M. Thera to rezone from
IICI' residence to commercial district property located on the north side
of Sherburne Avenue between Snelling Avenue and Fry Street and described
as Lot 4, BLock 1, Brigbtwood Park and Lot 9, Block 4, Stierle, McConville
and Seeger's Midway Addition.
On June 21, 1962, the Commissioner of Finance reported the petition suffi-
cient with the owners of 19 of a possible 19 (79 %) tracts of land within
.the prescribed 100 foot radius having signed the petition. Tble site is
developed with a two -story single- family residence which the petitioner
proposes to remove and develop the lot with off - street parking to be used
in conjunction with the commercial activities fronting on Snelling Avenue.
The property under consideration has a frontage of 40 feet on�Sherburne
Avenue and a width of 31.1 feet at the rear of the lot and a depth of 112.65
feet, resulting in an area of approximately 3,786 square feet; To the west
are three single - family residences and the rest of the block is developed
with apartment buildings; north and across a platted alley is,an apartment
building which fronts on Charles Avenue; east and across a public alley are
various commercial uses which front on Snelling Avenue; south and across
Sherburne Avenue is a parking lot which serves the commercial uses fronting
on Snelling Avenue. I
The Board of Zoning considered the matter at their regular meeting on
August 2, 1962. It is the Board's opinion that the additional off- street
parking space is needed in the area and that this is an extension of the
commercial zoning on Snelling Avenue although it is separated by an alley.
Therefore, the Board of Zoning recommends the granting of the petition to
rezone the above described property subject to a negative easement limit-
ing the commercial use to that of a parking lot.

Attached hereto is a petition to rezone the property located
at 1597 Sherburne Ave., St. Paul, Minn, which property is
legally described as:
Lot 4, Block 1, Brightwood Park, and Lot 9,
Block 4, S.tierle, McConville & Seegers
Midway Addition, {
from its present zoning of Class "C" Residential to "Commercial '.

The purpose of rezoning the property is so that the property may
be used as an automobile parking lot. The house itself was
damaged to the extent of approximately $3, 000 on March 3, 1962,
by fire. This damage has not yet been repaired. Since', the house
is extremely old and of sub - standard construction, it 'appears to
me the site can better be used for auto parking than for minimum
living quarters. Attached also is a drawing indicating! the propose_ d
parking arrangement. I believe such an arrangement is both
feasible and practical, however if the Planning Board of the City
of Saint Paul has other suggestions, I would be most happy to
abide by such suggestions. - -.
+-I' believe the petition, contains 100% of the required signatures of
the property owners within the required 100 ft. radius of the
property, however, a Word or two to clarify .several signatures
might be in order:
1. Signatures in spaces #1, 4, 5, 9, and 11, contain
only 1 signature for the reason that in each case
these ladies are widows and are the sole owners
of the various properties.

2. Signatures in spaces 7 & 8 contain the signatures
..of Lois Diane Edlung and James E. Edlund (her
.husband).. Title to these parcels are in the names
of Frank E. Jensen and Lilly A. Jensen, both of
whom are now deceased. Lois Diane Edlund has
been named executric of both these estated and -
also is the sole heir of these estates, therefore
both she and her husband have consented i,to the
rezoning...
3. Signature in, space 411 contains the signature of
Amre Sudheimer, while the records in the Finance
Department indicate the name of Amre N.t Joachim.
Mrs., Sudheinier was formerly' Mrs. Joachim and
through a divorce decree her former name was
restored by the, Court, therefore -this is one and,
' the same person although the names differ.; {
4. In space #6, Adam Vierling, Jr,,. is one of the
> record owners, however, Mr. Vierling says he
no longer is Junior and prefers to siga his name = with the "Jr. " omitted. {

The Council of the City of Saint Paul

SECTION 1
That the Zoning Code Chapters 60 to
64 inclusive, of the Saint Paul Legis-
r-4 lative Code, as amended, pertaining to
Use Districts, Height Districts and Re-
zoning of certain properties in'the City
of Saint Paul, be and the same hereby
Y is further amended so as to rezone the
O following described property from "C"
o Residence District to Commercial Dis-
m tract: -
Lot 4, Blork 1, Brightwood Park to
St. Paul, Minnesota and Lot 9,
Block 4, Stierle, McConville &
Seeger's Midway Addition, accord-
ing to the plat thereof on file and
of record in the office of the Reg-
ister of Deeds in and for Ramsey
County, Minnesota, located on the-
north side of Sherburne Avenue
between Snelling Avenue and Fry
Street,
subject to the following express ex-
ceptions and conditions:
1. That subject to any further re-
classification of the hereinabove de-
scribed real estate by virtue of pro-
ceedings therefor hereafter instituted,
conducted anal completed according to
applicable ,provisions of said Zoning
Code, as, amended, and 'applicable pro-
visions of the statutes of the State of
Minnesota', hereby, the employment of
mid'real estate henceforth is restricted
and limited to -the .following specified
uses, to -wit: (a) Residential District
uses permitted by-the regulatory pro-
visions of the said Zoning Code, as
amended, in "A'+ • Residence District,
"B" Residence District and "C" Resi-
dence District, thereby established; and,
(b) Commercial Uses which shall in-
clude no more than the establishment,
maintenance and conduct of a parking
lot, subject to all applicable statutes,
ordinances, rules and regulations pre-
scribed and promulgated by govern-
mental agencies having cognizance.
2. That the owner of said real es-
tate, within the period of 60 days next
succeeding the publication of this or-
dinance, Fhall file with the City Clerk,
in two (2) fully executed counterparts,
said owner's written acceptance of this
6rdinance, incorporating, among other
things, said owner's grant unto said
City of Saint Paul of a negative ease-
ment affecting said real estate for the
imposition, maintenance and enforce-
ment of the aforesaid restrictions and
limitations upon the employment and
use of the hereinabove described real
estate, a proved as to form and ex=
ecution by the Corporation Counsel
and recordable in tKe office of the
Register of Deeds. That said owner's
written acceptance and grant of neg,•
ative easement shall contain additional
effective provisions for the restriction
of said real estate to uses permitted in
one or more of said Residence Districts
from and after an future sale, transfer
or alienation of the present ownership
of the,same, or use or occupancy of the
same._
3. That, in addition,to other izequire-
ments'therefor, said written instrument
of acceptance and grant shall incorpo-
rate a certified copy of this ordinance,
and immediately upon the aforesaid
filing of the same the City Clerk shall
cause one of such counterparts thereof
to be filed of record in the office of the
Register of Deeds in and for Ramsey
County, Minnesota.
SECTION 2
This ordinance is hereby declared to
be an emergency ordinance rendered
necessary for the preservation of the
,public peace, health and safety.
SECTION 3 i
This ordinance shall take effect and
be in force upon its passage, approval
and publication.
