WHEREAS, in the matter of Comptroller's Contract L -6338 for
the Widening and Resurfacing White Bear Avenue from Arling-
ton to Larpenteur Avenue , Armor -Coat Finishing Company,
Contractor, the specified date of completion is August 1,
1961, and ;•
WHEREAS, the Contractor has prosecuted the work diligently,
but due to delay in placing asphalt surfacing in;order to
coordinate that work with the County paving project on
White Bear Avenue north from Larpenteur Avenue, it was
not possible to complete the seal coating until the
summer of 1962, therefore be it, I ; Y
RESOLVED, that the proper City Officials be and they are
hereby authorized and directed to execute an amendment
to said contract extend:ing•the time of completion to
September 20, 1962 provided, however, that this resolu-
tion shall have no force or effect unless the sureties_
on the contractor's bond consent thereto and file such
consent in writing,with the City Comptroller, and be it
FURTHER RESOLVED, that the City of St. Paul hereby7,waives
all claim for- liquidated damages and that no engineering
and inspection. costs on this project will be charged to
the Contractor for such extended period. l+
