THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters
60 to 64, inclusive, of the Saint Paul Legislative
Code, pertaining to Use Districts, Height Districts,
and Rezoning of certain properties in the City of
Saint Paul, as amended, be and the same is hereby
further amended so as to rezone the following describ-
ed property from "A" Residence District to Commercial
District, to-wit:. .
Blocks B, D, and except Elly 94.31 ft. of
S'ly 100 ft. Block C, Beaver Lake Heights,
located on the East side of Hazel Street
between Bush and Stillwater Avenues.
Section 2. This ordinance is hereby declared
to be an emergency ordinance rendered necessary for

The Board of Zoning at its regular meeting of Septetnber 21 considered
the petition of Jennings D. McLellan etal, to on Blocks B, C & D,
Beaver Lake He..ghts Add., except the easterly 94.3 of Beaver Lake
Heights Add 0 the southerly 100 ft. of Block C, eaver Lake Heights
Add., from its present "A" residence classification to a "commercial"
classification.
On August 27, the Commissioner of Finance reported the petition suffici-
ent in that 33 of the 49 property owners (67%) within the prescribed 100
ft. radius had signed the petition.
This property is presently undeveloped and was, at one time, used as
a city dump site. It is approximately 12 ft. below the adjacent street
grades at its lowest point. The site is irregular in shape having a
frontage along unimproved Hazel Avenue of approximately 890 ft. and
approximately 540 ft. along Nokomis Avenue resulting in a total site
area of approximately 487,755 sq. ft. or 11.2 acres.
Field investigation discloses that the subject property abuts the rear
yards of several single - family residences which front on Algonquin and
Iroquois Avenues and is also directly across the street from several
single - family residences fronting on Nokomis Avenue. To the west across
unimproved Hazel Street are several vacant lots fronting on Ross Avenue;
E. Seventh Street and Bush Avenue. There are also 6 11 -unit apartment build-
ings fronting on East Seventh Street and single - family residence fronting
on Bush Avenue. North and adjoining is a tavern, auto repair garage and
vacant land classified "A" residence fronting on Stillwater Avenue.
Poor soilu conditions and other physical characteristics of this property
indicate it is unlikely that it would ever be developed for single - family
use. However, there was some concern as to the need for additional com-
mercial uses for this area and it was suggested by one of the Board members
that it might be advisable to ask for evidence of lea es, etc.

After considerable discussion among the Board members and hearing the
Planning Board staff and petitioner, the Board recommended the granting
of the applicant's petition to reclassify the above- described property
to a commercial district. The proposal is for a neighborhood shopping
center.
