CoSt/Revenue Budgeted: September 10, 2007 9:32 AM Page 1 ,� ; MINUTES OF THE LEGISLATIVE HEARING ���g Z��� ORDERS TO REMOVE/REPAIIZ, CONDEMNATIONS, ABATEMENT ASSESSMENTS AND ABATEMENT ORDERS Tuesday, September 11, 2007 Room 330 City Hall, 15 Kellogg Blvd. West Marcia Moetmond, Leb slative Hearing Officer The hearin� was called to order at 10:05 a.m. STAFF PRESENT: Steve Magner, Deparhnent of Safety and Inspection (DSn - Code Enforcement Laid over Suuunary Abatement Assessment J0710A1 Property clean-up at ll 32 Central Avenue West on June 13, 2007: 1132 Central Avenue West (J0710A1) The owner did not retum the gold card far the August 21 Legislative Hearing; laid over September 4. The owner called on September 4 indicating he could not attend the hearing; laid over to September 11. Mr. Magner stated orders were issued on June 1, 2007 to cut tall grass and weeds and to remove wood, junk and debris with a compliance date of June 5. The property was re-inspected on June 11 and the wark had not been done. A work order was sent to the Parks Deparhnent who mowed the lawn and removed the items on June 13, 2007 for a total assessment of $518. The orders were mailed to Mohainmed Shahidullah at PO Box 907 in Winsted and no mail was returned. Mr. Magner stated tliat the property had been vacant twice now; most recently on July 21, 2006. There had been seven sununary abatement orders issued since that time and it was his opinion that by now, the owner underst�od the drill concerning complying with abatement orders. Ms. Moermond asked Mr. Magner how many of the summary abatements had gone to work order. Mr. Magnez responded that three had gone to work order where the City had to do the work. Ms. Moermond asked to see the video of the clean up which showed tall grass and weeds with a growth of eight to ten inches that was cut; brush, concrete, bricks, windows, fencing against the house, himber, and wood by a shed that was removed. Mohatmned Shahidullah, property owner, stated that he had mowed the lawn and this was obviously new growth since the last time he had mowed. He had obtained permits to build a deck and to put an additional room on the house. All of the items that were taken were for wark that he was doing on the house. He compiained that he now had to buy more lumber to build the deck and that when the City mowed the lawn, they cut down his flowers as well as his tomato plants. He contended that he had called the inspector and told hnn when he would be mowing the lawn. Ms. Moermond asked Mr. Magner if there was any indication in the file of the property owner calling the inspector. Mr. Magner stated that there was no documentation in the file. Ms. Moermond stated that the video clearly indicated there was tall grass and weeds that was cut and there was lumber and other materials strewn about the yard which the City removed.
