In the matter of condemning and taking an easement in the land necessary for the slopes,
cuts and fills, including right of removal of lateral support from subject land or re-
mainder thereof, occasioned by excavations thereof or construction oC slopes in the'
grading and surfacing with bituminous material the alley in Nixon Addition and Scheffer
Place from Chatsworth to Milton St.
under Preliminary Order 208525 approved August 7, 1962
Intermediary Order 209148 approved September 18', 1962
A public hearing having been had upon the above improvement upon due notice, and the Council having
heard all persons, objections and recommendations relative thereto, and having fully considered the same;
therefore, be it
RESOLVED, By the Council of the City of Saint Paul that the precise nature, extent and kind of im-
provement to be made by the said City is
Condemning and taking an easement in the land necessary for the slopes, cuts and
fills, including right of removal of lateral support from subject land or remainder
thereof, occasioned by excavations thereof or construction of slopes in the grading
and surfacing with bituminous material the alley in Nixon Addition and Scheffer Place ~
from Chatsworth to Milton St.
and the Council hereby orders said improvements to be made.
RESOLVED FURTHER, that the following land, lands or easements therein be and the same are
hereby ordered to be taken, appropriated and condemned for the purpose of making said improvements, viz.:
For the slopes, cuts and fills, including night of removal of lateral support
x from subject land or remainder thereof, occasioned by excavations thereof or construction
of slopes in the grading and surfacing with bituminous material the alley in Nixon
Addition and Scheffer Place from Chatsworth to Milton St. to the extent shown on the
plan on file Tn -the office of the Commissioner of Public Works
RESOLVED °-FURTHER, That the Commissioner of Public Works be and is hereby instructed and
directed to prepare plans and specifications for said improvement, and the proper city officials are hereby
authorized and directed to proceed with the making of said improvement in accordance therewith.

liminary order of the Council, known as Council File No. 208525
approved_ August 7, 1962 relative to condemning and taking an ease-
ment in the land necessary for the slopes, cuts and fills, including right of removal
of lateral support from subject land or remainder thereof occasioned by excavations
thereof or construction of slopes in the grading and surfacing with bituminous material
the alley in Nixon Addition and Scheffer Place from Chatsworth St. to Milton St.
and having investigated the matters and things referred to therein, hereby reports:
