WI�REAS, Depariment of Safety and Inspecfions has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecldng
and removal of a one and one-half story, wood framelmasonry, single family dwelling with a
detached, two-stall, masonry/wood frame garage located on property hereinafter referred to as
the "Subject Properry" and commonly lrnown as 970 CONCORDIA AVENUE. This property
is legally described as foilows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Tnspections on or before December 7, 20Q6,
the following are the now lrnown interested ar responsible parties for the Subject Property:

WHEREAS, Departxnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated May 22, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subj ect Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this arder informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by June 21, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHBREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WAEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, August 28, 2Q07 to hear testimony and evidence, and a8er receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighring influence on the community by demolishing
and removing the shucture in accordance with all applicable codes and ordinances. The

demolition of the structure to be completed within fifteen (l5) days after the date of the Council
Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
September 19, 2007 and the testimony and evidence including the acrion taken by the
Legislative Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 970 CONCORDIA AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condirion have not been corrected.

Property which declares it to be a nuisance condirion subject to demolirion.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant(Nuisance Buildings.
That the Irnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
L The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by demolishing and removing the structure in
accordance with all applicabie codes and ordinances. The demolition and removal of the
structure must be completed within fifteen (15) days after the date of the Councii
Hearing.

If the above corrective action is not completed within this period of time Deparnnent of
Safety and Inspections 9s hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and chazge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properiy or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the Caty of Saint Paul shali remove and dispose of such property as provided by law.
4. It is fiirtlier ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one half story, wood framelmasonry single family home with a two-stall
detached wood frame garage on a lot of 4792 square feet.
According to our files, it has been a vacant building since February 21, 2006.
The current property owners are Benjamin G. Tourville and Daniel J. Butler, per AMANDA and
Ramsey County property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been fourteen (14) SUMMARY ABATEMENT NOTICES since 2006.
There have been fourteen (14) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
On May 3, 2007, an inspection of the building was conducted, a list of deficiencies which constitute
a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A
NUISANCE BUILDING was posted on May 22, 2007 with a compliance date of June 21, 2007. As
of this date this property remains in a condition which comprises a nuisance as defined by the
legislative code.
The Vacank Building registration fees are delinquent in the amount of $375.00.
Ta�cation has placed an estimated market value of $50,000 on the land and $90,000 on the building.
As of March 15, 2007 a Code Compliance inspection has been completed.

Property Improvement, hereby declares the premises located at:

to comprise a nuisance eondition in violation of the Saint Paul Legislafive Code,
Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On May 03, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As
first remedial action, a Code Compliance Inspection must be obtained from the
Building Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce
Building (651)266-9090. That inspecflon will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condifion. You may also be
required to post a�ve thousand dallar ($5,0�0.�Q) performance bond with the
Suilding Inspecrion and Design Office before any permits are issued, except for a
demolition permit.
This building(s) is subject to tlie restrietions of Saint Paul Ordinance Chapter 33.03 and
sha11 not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued.

6. Insure basement celiar floor is even, is cleanable, and all holes are filled.
7. Install hand and guardrails on all stairways and steps as per attachment.

9. Install plinth blocks under posts in basement.

11. Install floor covering in the bathroom and kitchen that is impervious to

bolts.
15. Repair or replace any deteriorated window sash, broken glass, sash holders,
re-putty etc. as necessary.

17. Repair walls and ceilings throughout, as necessary.
18. Provide fire block construcfion as necessary.
20. Where wa11 and ceiling covering is removed, attic, replace doors and
windows, (insulafion, glass, weather stripping, etc.) shall meet new energy
code standards.

21. Prepaze and paint interior and exterior as necessary (take the necessary
precaurions if lead base paint is present).
22. Any framing members that do not meet code (where wall and ceiling
covering is removed, members that are over-spanned over-spaced, not
being carried properly, door and window openings that aze not headered,
etc.} aze to be reconstructed as per code.
23. Habitable rooms with new usage, replaced windows shall have glass azea
equal to 8% of floor azea, or a muumum of 8 sq. ft., one-half of wluch shall
operate and all bedroom windows shall meet emergency egress
requirements (20" wide min;mum, 24" high minimum but not less than 5.7
sq. ft. overall).
24. All chaned members will have to be scraped or sandblasted completely clean
and any water warped members replaced. A determination as to necessary
corrective measures will have to be made by this deparhnent as to
replacement, repairs, etc. All smoked or charred members are to be sealed
and deodorized.
25. Provide general clean-up o£premise. ,
26. Provide smoke detectors as per the Minnesota State Building Code.
27. Repair soffit, fascia trim, etc. as necessary.
28. Provide proper drainage azound house to direct water away from foundation.
29. Install downspouts and a complete gutter system as needed.
30. Replace house and garage roof covering and vent to Code.
ELECTRICAL
1. House gutted, must be wired to current code, with all appropriate
inspections.
2. All electrical work must be done by a license electrical contractor under an
electrical permit.
3. Any open walls or walls that are opened as part of this project must be
wired to the standards of the 2005 NEC.
PLUMBING
All plumbing work requires permit(s) and must be done by a plumbing
contractor licensed in Saint Paul.
1. Install waste & vent, water & gas piping per MN Pluxnbing Code.
2. Install water heater per Code.
3. Install all fixtures per Code.
HEATING
1. House totally gutted and could not get in.

As first remedial action, a Code Compliance Inspection Report must be obtained from the

Enforcement Officer with the names and addresses of any new owners or responsible

The Enforcement Officer is required by law to post a placard on this property which

This placard shall not be removed without the written authority of the Department of

4. Ordering the owner to remove or repair the building(s) at 970 Concordia Avenue within fifteen
(15) days from adoption of resolution.
Mr. Ma�er stated the building was a one-half story, wood frame/masonry, single-family dwelling
with a detached two-haif stall garage on a lot of 4,792 square feet and had been vacant since Februa.ry
21, 2006. A code compliance inspecrion had been done on March 15, 2007. The vacant building
registration fees were delinquent in the amount of $375 and the $5,000 performance bond had not been
posted. On May 3, 200�, an inspection of the building was done and a list of deficiencies which
constitute a nuisance condition was developed. An order to abate a nuisance building was posted on
May 22, 2007 with a compliance date of June 21, 2007. To date, the properiy remained in a condition
which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation estimated
the market value of the land to be approximately $50,000 and the building to be $90,000. Real estate
tases for were current. Code Enforcement estimates the cost to repair the building to be approximately
$80,000 to $40,000. The cost for demolition was estimated to be approximately $4,000 to $10,000.
There had also been 14 sLUninary abatements issued to this property all of which went to work order:
to secure the building and the City had to board the building to secure it from trespass, remove
improperly stored refuse and remove tall grass and weeds. Code Enforcement recommends the
building be repaired or removed within 15 days. Mr. Magner stated that approximately two months
ago, he had a conversation with one of the property owners who expressed surprise by the action that
was being taken. The property owner indicated that they were going to pull permits and rehabilitate
the structure. To date, they had done nothing. Mr. Magner presented photographs of the property.
Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that
there was a fire in the garage and at that time, they found the property to be vacant, boarded, secured,
there was extensive rot to the exterior northwest corner wall and the gazage was open at that time. At
that time, Daniel Butler was at the property and indicated that he was going secure the building and
take care of the issues.
Ms. Moermond asked whether the vacant building registration form and fees had ever been received.
Mr. Magner stated that the building was registered and the fees were paid on July 12, 2006, however to
date, they had not updated their information or paid the fees.
Ms. Moermond asked whether there had been any further damage done to the property since the Code
Compliance inspection was done in March, 2007. Mr. Magner stated that he was not aware of any
fiuther damage, however in December, 2006, the water had been running in the basement and they had
to call the Water Department to have the water shut off.
The property owners of record, Benjamin Tourville and Daniel Butler, did not appear. One neighbor
appeazed who was affiliated with the Jeremiah Program which was two properties away from their new
development. She expressed concern about the property as it attracted vagrants and she was aware that
people were sleeping in the building.
Ms. Moermond stated that based on the record and the fact that the owners did not appear at the
hearing, she recommended the building be removed within 15 days with no option for repair.
