WHEREAS, the Office of the Corporation Counsel has
examined the abstract of title to that particular real estate
hereinafter described, which said abstract shows that on August 5,
1960, a mechanic's lien for labor and materials was filed on behalf
of Magne Vinnes, in the amount of $1,061.8+, and that on the 25th
day of July, 1961, said Magne Vinnes did cause to be recorded
against said property a notice of lis pendens,•indicating that
the aforesaid lien is being perfected by an action at law in the
District Court of Ramsey County; and
WHEREAS, the Office of the Corporation Counsel has conferred
with both litigants in relation to said matter and is unable to
determine to which party the sum of $1,o61.84 should be paid; and
WHEREAS, the following described real estate is being taken
by the City of Saint Paul in connection with the new Johnson High
School, and said City will pay the sum of $20,000.00 for the
acquisition of said real estate described as:
The east four (E 4) filet of Lot twenty -seven
(
and all of Lot twenty -eight (28). Block three (3),
King's Arcade Park, according to the plat thereof
on file and of record in the office of the Register
of Deeds in and for Ramsey'County, Minnesota;
said sale and conveyance to include the right of the owners,'
Lowell H. Roberts and Marian A. Roberts, to remove from said
premises, at their own cost and expense, that particular building
known as 801 Clear Avenue, together with all equipment and fixtures
therein contained, provided that they remove the foundations walls
to 3 feet below lot grade and remove all debris, on or before
November 15, 1962, so that the Department of Education may fill
the excavation with sand or other material as they see fit to use;
now, therefore, be it-

to the Clerk of District Court, Ramsey County, Minnesota,
to be held by said Clerk abiding the outcome and termination
of the aforesaid lawsuit, and the City Comptroller hereby is
authorized to prepare the appropriate warrant to deposit said
funds with said Clerk, as aforesaid;
RESOLVED FURTHER, that the City Comptroller is authorized
to pay the balance of said sum of $20,000.00 to the parties
entitled thereto; upon receipt of a title opinion from the Corporation
Counsel;
