WHEREAS, pursuant to Minnesota Session Laws 1959,,
Chapter 500 - H.F. 38, Article II, Section 38, the City and
the State may enter into agreements concerning the maintenance
of trunk highways within the corporate limits of the City upon
such terms as may be agreed upon; and
WHEREAS, the City and the State did enter into an agreement
dated January 4,.1962, designated as Maintenance Agreement No. 938
whereby the City, in consideration of an annual payment of $1,500.00
per mile per year, undertook to maintain and keep in good repair
portions of certain trunk highways within the corporate City limits
including a portion of Trunk Highway No. 10; and
WHEREAS, the aforesaid Agreement No. 938 excluded
extraordinary maintenance, betterments, construction or reconstruction;
and
WHEREAS, it is considered desirable that the City under-
take the performance of certain extraordinary maintenance, betterments,
construction and reconstruction concerning Como Avenue Bridge No. 3
located on Trunk Highway No. 10, at the cost and expense of the
State; be it
RESOLVED, That the proper City officers are hereby
authorized and directed to execute Maintenance Agreement No. 963
to accomplish the aforesaid purposes.
