MINUTES OF THE LEGISLATIVE HEARING
LETTERS OF DEFICIENCY, CORRECTION NOTICES, AND CORRECTION ORDERS

The hearing was called to order at 3:05 p.m.
STAFF PRESENT: Mike Urmann and James Thomas, Division of Fire Prevention
Appeal of Lisa Hollingsworth, SMRLS, on behalf of Marlene Griffin, appellant, on a
Deficiency List to a Certificate of Occupancy for property at 866 Jessie Street.
The foliowing appeared: Lisa Hollingsworth, Southern Minnesota Regional Legal Services
(SMRLS), 166 Fourth Street East #200; Marlene Griffin, appellant, occupant of 866 Jessie
Street, Unit 1.
Ms. Hollingsworth stated that Ms. Griffin is the one that requested this hearing because some of
tbe items are specifically related to her unit.
Michael Urmann reported that the majority of the testimony will be from the field inspector
James Thomas. Mr. Thomas took photos that are provided to Ms. Moermond.
Mr. Thomas stated he was there at 1:30 today to get more photos, but the door that leads to the
porch was locked. The camera they have will not take pictures through the screen.
Ms. Moermond asked what kind of building. Mr. Thomas responded this is a three-unit building.
They received a complaint on August 24 about the stairwell being unsafe.
Mr. Urmann stated that they star[ed with the referral on the steps. Then, other issues were noted
at the building. Because of the condition of the rear exit stairs and the other parts of the building,
they will need a full Certificate of Occupancy on the building.
Ms. Moermond stated there is a lot of storage in the exterior and interior. She asked was there
sanitation issues on the interior. Mr. Thomas responded yes, although he has not made a
reinspection.
Ms. Hollingsworth stated that Ms. Griffin came to the office with Austin Goodwin, Social
Worker from Mental Heaith Resources. (Ms. Hollingsworth talked about Ms. Griffin's health
issues.) They have encouraged her to get the place to a passing condition, and she has made
good progress. Ms. Hollingsworth is asking for additional time for Ms. Griffin to work through
these issues. One of the things they are working on with Mr. Goodwin is getting a PCA
(Personal Caze Attendant) service into the home on a regular basis to provide ongoing
housekeeping services so that once the unit is in a good condition, it can stay in a good condition.
(Ms. Hollingsworth showed Ms. Moermond the photos taken today.)

Ms. Hollingsworth continued: the person in her office who went out to take pictures today ran
into a contractor who was hired by the landlord to make the repairs to the stairs. Ms.
Hollingsworth learned from Mr. Thomas today ttzat a pernut has been pulled.
Ms. Moermond asked about a notation on the Deficiency List about problems with the stairs.
Mr. Urmann stated this is specific to the occupant of Unit 1. They separate out orders that only
affect her occupancy so there is not confusion. These are only the orders for Unit 1.
Ms. Moermond stated the accumulation does not look that bad. She has seen worse. They were
doing some cleanup now. Usually when there is a situation where someone has things that are
getting to be too much, it can repeat itself in the future.
Ms. Griffin stated she has two daughters. One daughter she does not have contact with, and Ms.
Griffin has a hard time removing her items. (Ms. Griffin spoke about problems she has had with
her daughter and her own medicai problems.) Ms. Griffin also has some of her other daughter's
items until the daughter can afford a new place.
Ms. Moermond asked about the landlords. Ms. Griffin responded it is a man and a woman and
they have no problem with the storage.
Ms. Moermond stated she is willing to give her time to work on this. The accumulation can get
out of control and the place can get condemned. Ms. Griffin responded she is throwing things
away. She wants to unload it because it is tao much for her.
Her priorities aze to make sure Ms. Griffin can get out of tkie house in an emergency, said Ms.
Moermond. She asked can a firefighter navigate around her apartment safely. Ms. Griffin
responded they can.
Mr. Goodwin stated that Ms. Crriffin is in the process of downsizing. She lived with both
daughters in a three-bedroom aparhnent, and then she moved to a two-bedroom apartment, and
now a one-bedroom apartment. He has been helping Ms. Griffin. He has a little bit of additional
help, but those resources are limited. He would like an idea of how much storage space is
available. There is still quite a bit of material. He would ask for as much time as Ms.
Moermond is comfortable giving.
Ms. Griffin stated her doors and the walk through areas are accessible.
Mr. Urmann said that the pictures are a marked improvement from the original inspection. The
concern was the egress aisies and the porch. He has no issues with giving more time if they can
get Ttem 6 in compliance. Ms. Griffin responded it has been taken care of, to which Mr. Urmann
responded that there were three locks the last time it was checked. The fire code only accepts
one single motion plus the security lock chain or something to that effect. (Item 6— The
maximum number of locks on unit doors is two. Remove all locks in excess of two-Front door.)

Ms. Griffin stated that she has a pictute that shows there aze oniy two locks on the doors.
Ms. Moertnond stated another easy fix is the extension cord. Ms. Hollingsworth responded that
has been taken caze of.
Ms. Moermond asked do they haue a handout on safe storage in residential. Mr. Urmann
responded it is difficult. It is hazd to describe what combustible storage is when everything they
have is combustible.
Ms. Moermond stated that she is thinking of an extension to the end of November. In the
meantime, an inspector can come out and taik about what safe storage of these materials would
look like. Ms. Hollingsworth stated they will work on that. It would make sense that they can
arganize a time that Mr. Goodwin can be there. Mr. Urmann responded that they try to get with
the client and the worker. They want to get everyone together instead of coming out a couple of
times.
Ms. Moermond stated that the client has six weeks to bring the unit into compiiance. The goal is
to get this organized and get some of this stuff out of there, What she is hearing from them is
that they aze making progress so far. (Ms. Griffin spoke about her medical issues that are
delaying the progress.)
Ms. Moermond extended the compliance date to Thursday, November 30. An inspector could
come back on Friday, December 1. Between now and then, an inspector will come out to talk
about what safe storage looks like.
Mr. Urmann stated that the inspectar still has to deal with other things in the building. Ms.
Moermond added that the inspector will be there on the 23` but it has nothing to do with Ms.
Griffin's unit.
