WHEREAS, the City of Saint Paul, through the Department of Public Works, Real Estate Division, has
secured agreements for the purchase of property rights, said property rights aze on the following
properties addressed as:

WHEREA5, these property rights on said properties aze necessary for the improvement as a part of the
White Bear and Burns Area Street Paving and Lighting Project., said propezty rights were Final Ordered
for acquisition on Mazch 7, 2007 with Council File Numbered 07-222. The total value at which said
property rights may be purchased as is in the amount of $8,250 (Eight Thousand Two Hundred Fiflv
Dollars, this being a fair and reasonable value for the property rights on said subject properties; and
WHEREAS, the Real Estate Division has recommended the purchase of said property rights at the
recommended value plus other considerarions as outlined 'an the terms and conditions agreed upon
between Property Owner and City of Saint Paul in the attached agreements;
NOW TIIEREFORE BE IT RESOLVED, that the proper City Officials are hereby authorized and
directed to pay the property owners of record, compensation for the property rights shown on the
attached agreements and all associated closing costs. Said sum to be charged to
Activity Code: C07-2T561-0788-29280

FOR RIGHT-OF-WAY AND UTILITY PURPOSES

Grantor(s), for good and valuable consideration, to them in hand paid and the
receipt of which is hereby acknowledged, does hereby grant, bazgain, sell and convey to
the City of Saint Paul, a municipal corporarion of the State of Minnesota, its successors
and assigns, as Gtantee, an 270 square foot permanent easement for public right-of-way
and ufility purposes over, under and across that part of Lot 5, Block 1, KOTKE
ADDITION; Ramsey County, Minnesota described as follows:
The east 15 feet of the most northerly 18 feet of Lot 5, Block 1,
KOTKE ADDITION, Ramsey County, Minnesota.
To have and to hold the same forever. Crrantor does covenant that it is well seized
in fee of the land and premises aforesaid, and has good right to sell and convey the same
free of a1t encumbrances.
That Grantor also covenants that the above granted easement is in the quiet and
peaceable possession of the Grantee. Grantor will warrant and defend against all persons
lawfully claiming the whole or any part thereof, subject to encutnbrances, if any,
hereinbefore mentioned. It is intended and agreed that this agreement shall be a covenant
nm»ing with the land and shall be binding to the fullest extent of the law and equity for
the benefit of the publia lt is ftu�ther intended and agreed that this agreement and
covenant shall remain in effect without limitation as to time.
Grantor shall assume all risk and liability for itself, its agents or employees for
any injury to persons or property resulting in any manner from the conduct of its own
operations and operations of its agents or employees within the easement area described
above, and far any loss, cost, damage, or expense resulting at any time from failure to
exercise proper precautions, of or by itself or its own agents or its own employees.
Grantor sha11 not be responsible for any injury to persons or property resulting in any
manner from the conduct of Grantee's operations and operations of its agents or
employees within the easement described above, or for any loss, cost, damage, or
expense resulting at any time from failure to exercise proper precautions, of or by
Crrantee or its own agents or its own employees. The liability of Grantee shall be
govemed by the provisions of the Minnesota Municipal Liability Tort Act, Minn. Stat.
§466.04, and other applicable law.
