O'Connell City Clerk Building Dear Madam: This is in the matter of the application of the A -1 Auto Parts Company to operate an automobile dismantling yard on property located on the east side of Arundel Street; the west side of Cumberland Street, and the southwest side of Como Avenue a Ct'be Great Northern Railway tracks and described as Lots 3, 18, 19, 20, Block 3, Neurer's Addition; Lots 2, 3, 4, Block 2, Neurer's Addi- tion. A map indicating the area is attached for your information. The zoning is Heavy Industry. The properties under consideration are now being used for automobile dismantling yard purposes, and the purpose of this application is to legalize the present use. The surrounding area uses to the west and north are industrial in char- acter; south of the subject properties are single- family residences which front on Arundel and Cumberland Streets; to the east and fronting on Como Avenue is a second -hand auto parts store which is part of the applicant's operation, farther east is a two - family residence fronting on Como Avenue, at the southwest intersection of Como and Western Avenues is a tavern. Field i'nvestigatio'n discloses no basic objection to the legalizing of the present operation as the proposed land use plan indicates the highest and best use of this land is for heavy industry purposes. For the most part, the property is enclosed by an eight -foot high tight board fence. However, the property which fronts on Como Avenue is being used in such a manner that material is project- ing above the fence, and this practice should be discontinued. The applicant has filed a letter of acquiescence from a number of property owners in the immediate area stating they have no objection to the granting of the permit. It - sbould be brought to the attention of the Council that on September 24, 1954, C. F. 170313, the City Council established a policy of not granting further approval of this type use within the city limits because it considered it a nuisance. In consideration of the above factors, the Board of Zoning recommends the grant- ing of the permit to operate an automobile dismantling yard on the above described property subject to the above recommendations. Gentlemen: When the Present A -1 Auto Parts Co.,388 W.,Como, bought the business in 1952 FRm4jthe previous owner„ we vwere of the opinion that the permits in connection with this operation were in order. ae now find that some of the areas being used do not have permits, r therefore, we are requesting an automobile dismantling permit for the area whose legal description is mentioned below. This area is zoned heavy industry. The legal description of the above property for which permits are requested is as follows: Lots 18,19,20, blk. 3, Newerer's Add. , lot 3, blk.3, Newerer's Add., lofs 9A4. blk.2, Newerer's Add. These C lots are bounded on the west by Arundel St. Directly across Arundel St. to the west lies a railroad storage yard and the Pennig Asphalt Co.'s gravel pile. On the north these,lots are bounded by the Great Northern Railroad. On the eaast they are bounded by 390 Como. The = afore mentioned property is owned by our company. If we are granted these permits we will plant trees around the property to make it ms inconspicuous as possible, and adhere to the provisi8ns provided. �Ie do not burn cars in• normal working proceedure, although, occassionaly one of them is burnt accidently. Also, there is water and hose in the main working area, which is used when the weather permits to prevent fire. A petition wens circulated among the few near —by neighbors indicates nearly all of themaare unopossed to the granting of these permits. This petition is attached to this-letter.
