RESOLVED FURTHER, That such settlement and
compromise and the adjustments of said Assessment Roll
and application for judgment, aforesaid, are directed
by this Council's reconsideration of the involved matter
and in the interests of equity and justice and have been
recommended by the Valuation Engineer;'and that the same
shall be contingent upon a Stipulation, in said District
Court proceeding, withdrawing the Answer and Objections
therein filed against said application for judgment, in
respect of said Assessments of Benefits, by George Frasl
and Vera F. Frasl, owners of the hereinabove described
assessed land approved by the Corporation Counsel and
finally dispositive of all controversies concerning the
same; that the foregoing adjustments necessitate the
increase in the appropriation of City funds to defray the
cost of said improvement by the amount of $235.23, and
that such increase therefor hereby is provided to be made
by an appropriation of the'same amount from the Permanent
Improvement Revolving Fund, subject to reimbursement to
said Fund to be made from City Budget Fund 31 -E -1.

RESOLVED, "In the Matter of the Opening, Widening
and Extending of Winchell Street•to a width of 60 feet from
the north line of Lot 3, Block 6, Rogers and Hendricks Acre,
Lots Number 2, to the south lines of Lots 9 and 12, Block
6, Rogers and Hendricks Acre Lots Number 2," wherein this
Council'Is- 'Resolution C. F. No. 206742, ratified and con-
firmed the involved condemnations and awards of damages
and assessments of benefits and the application of the
City of Saint Paul for judgment of the District Court
confirming said assessments of benefits is pending, that_
in final settlement and compromise of.all controversies
concerning the assessment of•benefits against except the
West 30 feet,'Lot 8, Block 6, Ro ers and Hendricks Acre
Lots Number 2, in the amount of 4.3.63, and against except
the West 30 feet, Lot 9, Block 6 Roggers and Hendricks Acre
Lots Number 2, in.the amount of 64.1.60, be stricken and in
lieu thereof, in each instance, a net award of damages, in
the amount of $75.00,be substituted in place and stead of
the stricken Assessment of Benefits; and that, for the
t. purpose of such settlement and compromise, the pertinent
portion of the applicable Assessment Roll No. 15303 incor-
porated in said Application for Judgment shall be amended
to read as- follows:
