'# NiRW 131_151 -133 1 ZONING, • CITY 113 CITY HALL AND COURT HOUSE Mrs. Agnes O'Connell City Clerk Building Dear Madam: OF SAINT PAUL SAINT PAUL 1, MINNESOTA May 7, 1962 This is in the matter of the appeal of Walter and Agnes Scboewe to relax the off - street parking requirements for residence development on property located at the northwest corner of Arcade Street and Maryland Avenue and described as Lot 18, Block 12, Oakville Park. The property is zoned commercial. The property under consideration was originally developed in 1922 with a two -story brick veneer store and apartment building ( two apartments). Tbd size of the building was 39 feet x 68 feet. In 1926, an addition was added which increased the number of apartments to four, and increased the size of the building to 39 feet x 120 feet. The Assessor's records indicate that in 1945 this building was occupied by commercial uses on the first_ floor, with four apartments and two doctor's offices on the second floor.- In 1955 their records indicate commercial uses on the first floor, four apartments and three doctor's offices on the second floor. At the present time there are commercial uses on the first floor- four apartments and two doctor's of Toes, wbi� ch are vacan , on the second floor. The applicant proposes to alter the second floor so that the vacant doctor's- offices can be converted to apart- 0 ment use, making a total of six apartments. CbapteF- BV.-0 7 die Zoning Code requires ° pp scant to provide one off- street parking space for each apart- ment unit at the time any alterations are made which would result in an increase in the number of apartment units. The building department cannot issue-the necessary permits to make this' proposed alteration until such time as the applicant provides the necessary off- street parking, or the Council grants a relaxation of said requirements. Inasmuch as the building now occupies almost the entire site, it is not possible to provide parking on the subject property and the applicant has indicated they are unable to secure any parking in the surrounding area. 1 The Traffic Engineer recommends that the mandatory off- street parking be pro- vided because of the rush -hour parking bans on both Arcade Street and Maryland Avenue and because of the parking demand generated by the•commercial character of the immediate area. The Board of Zoning considered this matter at its regular meeting on April 19, 1962. Attorney for the applicant questioned whether or not this section of / the Zoning Code applies to residential uses in a commercial building. The Board of Zoning felt that requiring the applicant to provide the prescribed off-street parking would work an unnecessary hardship in this case, and re- commends the granting of the appeal to relax the off- street parking requirements on the above described property. It is residential and commercial property. Twelve years ago, we converted two apartments into doctors' offices. Since then, the doctors have 'built clinics of their own leaving us with offices which we are unable to rent because the trend is all for street level clinics. When we applied for a permit to convert said offices back into apartments, we were informed that we would have to provide off - street parking facilities not only for the two new apartments, which weTwere contemplating, 'but also for the four which have always 'been there. Consequently, we are appealing for relaxation of off - street parking regulations of Chapter 23, Section 3, Paragraph A of Legislative Zoning Code, Chapter 6402— Paragraph i . We respectfully petition that the parking requirement 'be waived for the following reasons: 1. It is impossiirle to acquire land to comply with zoning code. There is none availa'ble in this area. 2. Real estate taxes have tone up, and less revenue from the unoccupied rental units has created a critical financial load. 3. It is apparent there mould le mach less parking requirement on the street with apartments, particularly during the rush hours when each doctor would have two or three patients waiting.
