07-830Council File # � �g�(� Green Sheet # 3043652 CITY Presented By RESOLUTION SAINT PAUL, NIINNESOTA � 2 WHEREAS, In 2005 the City Council requested the Planing Commission to undertake a study 3 of so-called "sober houses" because the City's zoning code lacked a sober house definition and 4 lacked regulations that might be applicable to sober houses; and 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 WHEREAS, Although City staff is now nearing completion of a sober house shxdy, the staff report and the Planning Commission's process for recommending amendments to the City's official controls that could result in specific sober house regulations may not be completed for several months and, further, the City Council's legislative process to consider recommendations from the Planning Commission's report that would lead to the adoption of official City controls regulating sober houses could take several additional months; and WHEREAS, Recent amendments to the state of Minnesota's building and fire codes have also prompted the City's building and fire code inspectors to reconsider the way the City classifies and inspects sober houses for life and building safety code compliance; and WHEREAS, The establishment of new or additions to current sober houses, pending the completion of the zoning study and a reconsideration of the City's life and building code compliance standazds, could result in land uses which would not be consistent with the goals and requirements of the City's land use plan, zoning code and other official controls including building and fire code compliance; and WHEREAS, the potential for incompatible or inconsistent development within the area raises substantial questions relating to the ability of the City's present official controls to provide compliance with the comprehensive plan, zoning code and other official controls intended to regulate land uses as well as protect the health, welfare and safety of those persons who may reside in a sober house; and WHEREAS, in light of the City's nearly completed zoning study of sober house uses, as well as the need to determine how to apply the new building and fire codes to sober houses, there is an immediate need to preserve the status quo with respect to sober house land uses and to protect the general health, welfare and safety of the public pending the conclusion of the said sober house study, the Council of the City of Saint Paul desires to immediately prohibit development on any pazcel of land ar part thereof within the City, until such time as the aforementioned zoning study has been completed and the Council has taken action on the recommendations contained therein and that the City's building and fire safety inspectars have determined how to inspect sober houses for building and fire safety code compliance; NOW, THEREFORE, 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 0�-g3b BE IT RESOLVED, pending the adoplion of a sepazate interim ordinance in compliance with the City's Charter, the Council of the City of Saint Paul will hereby immediately prohibit for any pazcel of land or part thereof within the City, the approval or issuance of any zoning approvals, building permits, building or fire safety code compliance or certificate of occupancy approvals, until the �piration of twelve months as provided in Minn. Stat. § 462355, Subd.(4), or until such earlier time as the Council of the City of Saint Paul has taken action on the recommendations contained in the study; AND, BE IT FLJRTHER RESOLVED, that until such time as the sepazate interim ordinance has been adopted and approved pursuant to the Saint Paul City Charter, and unless otherwise provided for by the City Council, any city deparhnent receiving a written application regazding the official controls noted above for a"sober house," shall immediately process the application in accardance with the provisions of Minn.
