The property is zoned "A" residence. The site is presently developed with a single - family residence which was constructed in 1957, and it is proposed to construct a two -car garage on the site at a setback of 35 feet from Upper Afton Road. The property has a frontage of approximately 97 feet on Upper Afton Road and extends to a depth of 250 feet, resulting in an area of approximately 21,250 square feet. The existing residence is set back 50 feet, which is the normal set- back for this property. Because of the topography of the site, the appli- cant is requesting a setback of 35 feet for the proposed garage, Therefore, it-is necessary to secure Council authorization for the relaxation of the required setback. Field investigation discloses that the area uses are single - family resi- dences and that the lots vary considerably in depth. It does not appear that the relaxation as requested would have a detrimental effect on any other property. The applicant has secured a letter of acquiescence from his neighbor to the east who would be affected by the setback. In consideration of the above factors, the Board of Zoning recommends the granting of the appeal to construct a two -car garage at a setback of 35 feet fxoil Upper Afton Road on the above described property. I am contemplating building a double garage on my property at 1594 Upper Afton Road. When our home was built there in 1957 it was set back 50 feet from the street line-and faces sideways on a 97 X•250 foot lot. There is a private driveway bordering our lot on the west klong side) which goes back to a house on the cliff behind our property which over- looks Mississippi river and Highway 61. Between that driveway and East Dora Court to the west are two houses which are only set back 35 feet from Upper Afton Road. To the east of our property is a house set back somewhat farther than ours on -a much larger lot. There is no alley at the rear of any of these lots nor arq between the whole stretch of Upper Afton Road from E. Dora Court to White Bear Avenue about half a mile or more to the east. I would appreciate the council's permission to construct a garage set in a line with the houses to the west of ours, such a line now having been established by all the houses between ours and Highway 61, a distance of about three blocks, and all being the required 35 feet from Upper Afton Road. I would not be establishing a precedent because several doors to the east of us is a much newer home, set at the rear of a deeper lot than ours, and for which the garage was built about 100 feet in front of the house towards Upper Afton Road. _I will_very.much appreciate your attention and an early reply, to this matter.
