THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That subject to the provisions, terms, .and conditions
hereinafter set forth, the Commissioner of Public Works is authorized
to issue 'a permit to Remington Rand Univac,.Division of Sperry Rand
Corporation, to construct, at its own cost and expense, a public motor
vehicle parkingarea within the following described sections of
public street and public alley, within the corporate limits of the
City of Saint Paul, to -irtt: .,.
Northerly 9 feet of Reserve Boulevard, also known as
"Shepard Road, from approximately 36 feet east of the
east line of Fairview Avenue as vacated, to approxi-
mately 93 feet west of the west line of Wheeler Avenue
as vacated, and alley in Block 6, Whitneylj; re- arrange-
ment of Bellevue Addition, within the aforesaid limits;'
That said permit shall be issued subject to the following provisions,
terms, and conditions:
1.Said permittee shall file a bond running to the City of Saint
Paul, in the sum of $10,000, conditioner) to comply with all the terms
of this ordinance and to indemnify and save harmless said City from
an liability, charges, loss, judgments, suits, costs, damage or
expense accruing to person or property, arising out of the construction
of said public motor vehicle parking area.
2. Said permittee shall provide proper plans and specifications
for the construction of such public motor vehicle parking area, which
plans and specifications shall be subject thereto and shall require the
approval of the Commissioner of Public Works and, among other things,
shall make provisions -for -the establishment, construction,'and surfacing
with durable paving materials of requisite -roadways and motor vehicle
parking spaces as shall be practicable. Said permittee shall file such
plans and specifications, bearing the endorsed approval of said Commissioner

permittee shall prosecute such construction work from the
inception until the completion of the same uninterruptedly, and
perform the same in strict accordance with such approved
plans and specifications under the supervision and subject to
the direction of said Commissioner. Said permittee shall be
obligated to pay, from its own funds, the entire cost of said
plans -and specifications therefor and of the subject construction
work, without recourse on any such account against said City or
any third party. Said permittee shall be further liable to pay `
to said City an amount which shall represent the cost of such
supervision of such construction work by said Commissioner, and
a further amount which shall represent the City's cost of the
publication of -this ordinance.
5. Said permittee, neither by virtue of such construction
of said public motor vehicle parking area at its own cost and
expense under any such permit, nor otherwisq, hereunder, shall
acquire any right, title, estate or interest in-or to any part
of said area, and the same, said area, shall forever remain
public street and public alley areas, owned, controlled, and
used by said City, as trustee of the public, for public street
or public alley uses and purposes.
6. Said permittee shall be obligated at all times to
fully indemnify and hold harmless the -City of Saint Paul against
liability on account of any and all claims for damages for injury
to person or property resultant therefrom or connected with said
permittee's construction, maintenance, or operation of said public
motor vehicle parking area and the hereinafter mentioned special
purpose off- street parking facility, and to procure and maintain,
at all times, and at said permittee's own cost and expense, public
liability casualty insurance coverage indemnifying said permittee
and said City against liability on account of all such claims for
personal injuries to the extent of $250,000 for injury to one person
and $5002000 for personal injuries caused by any one accident, and
for property injuries to the extent of $100,000 on account of any
single claim and $150,000 on account of any single accident, and
to file evidence of said coverage with the Comptroller of said
City, in form approved by the Corporation Counsel.
7. That said public motor vehicle parking area hereby
authorized for construction and maintenance within said sections
of public street and public alley hereunder, without loss of the
public character of the same, hereby shall be deemed to be authorized
to be maintained and operated in conjunction with contiguous land

Your letter of December 17, 1962 relative to Ordinance #12345 was mis-
directed to the Remington Rand Sales Office in Minneapolis. Hence, there
has been some delay in complying with the terms of the ordinance.
In compliance with various paragraphs of the ordinance, I am enclosing
a Certificate of Insurance including the required coverages and a Surety Bond
covering the construction, maintenance, operation, and use of the parking
area described in the ordinance. Plans and specifications for the work have
been filed with the Commissioner of Public Works, and have been approved by
his office. It is understood from conversations between our offices that
it will be unnecessary to file such plans and specifications in your office,
in view of their availability in the office of the Commissioner.
The invoice for $28.81 for publication of the ordinance has been sent
to our Accounts Payable Department, and a check will be forwarded to the City
Commissioner within the next day or so to defray this expense.
I also enclose a signed copy of the written acceptance of the ordinance,
signifying our agreement to abide by all terms and conditions of Council File
#210065.
