WHEREAS, based upon the records in the Ramsey County Recorder's Office and
informafion obtained by Department of Safety and Inspections on or before October 25, 2006,
the following are the now known interested or responsible parties for the Subject Property: JT

WHEREAS, Department of Safety and Inspecfions has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated May 14, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demollsh the structure located on the Subject Property by June 12, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condirion; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislarive
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislatave Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer o£ the Saint Paul
City Council on Tuesday, August 14, 2007 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition of the sriucture to be completed within five (5) days after the date of
the Council Hearing; and

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
September 5, 2007 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 388 GOODIiLCH AVENUE.
That the Subject Property comprises a nuisance condition as defined in 5aint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That Department of Safety and Inspections has posted a placatd on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been xoatinely monitored by Department of Safety and

That the Irnown interested parties and owners are as previously stated in this
resolution and that the norification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties sha11 make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by demolishing and removing the shucture in
accordance with all applicable codes and ordinances. The �ela�kex-e� demolition
and removal of the shucture must be compieted within five (5) days after the date of the
Council Hearing.
2. If the above conective action is not completed within this period of time Department of
Safety and Inspecrions is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the

Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul I,egislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolirion and removal
shali be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Sa3nt Paul shail remove and dispose of such property as provided by law.

The building is a two-story, wood frame, duplex on a lot of 4792 square feet.
According to our files, it has been a vacant building since February 9, 2007.
The current properiy owners are JT Horizon LLC, per AMANDA and Ramsey county property
records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been two (2) SLIMMARY ABATEMENT NOTICES since 2007.
There have been zero (0) WORK ORDERS issued.
On Apri124, 2007, an inspection of the building was conducted, a list of deficiencies which constitute
a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A
NLJISANCE BL7ILDING was posted on May 14, 2007 with a compliance date of June 12, 2007. As of
this date this property remains in a condition which comprises a nuisance as defined by the legislative
code.
The Vacant Building registration fees are delinquent in the amount of $250.00.
Taxation has placed an esrimated market value of $44,500 on the 1and and $212,700 on the building.
As of July 17, 2007, a Code Compliance inspection has been compieted.
As of August 9, 2007, the $5,000.00 performance bond has not been posted.

Improvement, hereby declares the premises located at:
388 GOODRICH AVE
and legally described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On Apri124, 2007, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As �rst
remedial action, a Code Compliance Inspection must be obtained from the Building
Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce Building
(651)266-9090. That inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition. You may also be required to post a five
thousand dollar ($5,000.00) performance bond with the Building Inspection and Design
Office before any permits are issued, except for a demolition permit.
This building(s) is subject to the restricrions of Saint Pau1 Ordinance Chapter 33.03 and shall not
again be used for occupancy until such time as a Certificate of Compliance ar a Certificate of
Occupancy has been issued.
This is a two-story, wood frame, duplex.

Condemned pxoperty (see attached). Both condemnation and vacant building status
require a code compliance inspection be completed and all listed deficiencies be
corrected before dwelling may be occupied.
Condemnation dated January 24, 2007
The Department of Neighborhood Housing and Property Improvement, Division of Code
Enforcement has determined that the dwelling and premises at 388 GOODI2ICH AVE is "Unfit
for Human Habitation". In accordance with Saint Paul Legaslative Code, Chapter 34, Section 23,
the premises will be placarded on January 23, 2007 and ardered vacated no later than
February Ol, 2007.
Your attention is called to the following provisions of Section 34.23, Subsection 6 entitled,
"Vacation of Structure or UniY':
"Any residential structure or residential unit which has been condemned or
placarded as un�t for human habitation shall be vacated within the time set forth in
the placard and/or order. It shall be unlawful for any person to let to any person for
huznan habitation any structure or unit so condemned or placarded, and no person
shali occnpy the structure or unit after the date set forth in the piacard andlor
notice."

1. Material Endangerment — 34.23(7a&7b) Lacking maintenance dilapidated and fire
hazard electrical deficiencies.
Other Violations: These deficiencies must be corrected in order to bring this property into
compliance with the Saint Paul Legislatice Code.
2. The exterior walls andlor trim of the house ancUar garage has defective, peeled,
flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and
repaint to effect a sound condition in a professional manner.
3. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames, sashes,
hardware and associated trim in a professional manner. Permit may be
required.
4. The window andlar door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all operable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
5. Floor in kitchen is buckling.
6. Stove not functioning.
7. The interior ceilings are defective. Repair aA ceiling defects and finish in a
professional manner.
8. Due to the number of deficiencies, a Code Compliance Inspection will be
required before a Placard Lift will be issued.
Authorization to reoccupy thislthese dwelling unit(s) will not be given until it is
demonstrated that all principal violations have been corrected and that no new conditions
exist which could constitute material endangerment or which threaten the peace, health,
safety or welfaze of the occupants of this building.
All repairs and new installations must be made in accordance with the appropriate codes.
Permit information may be obtained from the Building Tnspection and Design Section, 8
Fourth Street, #200, Commerce Building, (651) 266-9090.
You may file an appeal to this notice by contacting the City Clerk's Office at (651) 266-
8688. Any appeal must be made in writing within 10 days of the date of this notice.
It is the responsi6ility of the property owner to keep a11 buiidings secured and to properly
maintain the prexnises at all times.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not conected by June 12, 2007 Neighborhood Housing
and Property Improvement, Division of Code Enforcement, wili be�in a substantial
abatement process to demolish and remove the building(s). The costs of this action,
including adrninistrarive costs and demolition costs wili be assessed against the property

As fust remedial acrion, a Code Compliance Inspection Report must be obtained from the

As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, ar convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declazes it to be a"nuisance condition", subject to demolition and removal by the City.
This placard shall not be removed without the written authority of the Department of
Neighbarhood Housing and Property Improvement. The department is further required to
file a copy of this "Order to Abate" with the City C1erk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings befare the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council wi11
adopt a resolution stating what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law. If you have any

HEATING

a$5,000 Performance Bond or Deposit at the tune the pernut is issued.

I am writing on behalf of my family, multi-generational family residents of 387 Goodrich
Avenue, directly opposite the vacant buiiding at 388 Goodrich Avenue. We have owned
our properiy since November of 2004. Ever since we moved to the neighhorhood, 388
Goodrich has been a problem with muitiple tenants, sudden tenant changes and ongoing
disturbances that always take place in the street at all hours of day and night.
Foz the past rivo years, the owners of this property have never appeared to meet with
neighbors to help deal with the crisis's occurring due to the transient people that they
rented the pmperty to. The property has NEVER been maintained decenfly. It has been
faliing apart since we arrived. We have been calling the owners and the police weekly
for two years because af incidents such as these:
� Men on bicycles and on foot were coming in and out of f�e apartments all hours
of day and night — vagrants, often arriving eazly in the morning, hauling in found
objects or otherwise from the streets to stockpile in the huilding.
• The woman/tenant of the second floor apaztment was abusive and volatfle —
almost daily - raging in the sireets at a11 hours of day and night — screaming filthy
and racist language at her husband, son and other men coming and going in the
night.
•'Their dog — a pit bull — was chained to a doghouse in the back yard - it broke
loose on many occasions, twice charging our nine and ten yeaz old daughters. It
dragged its doghouse down the driveway and out into the street one aft.ernoon.
• The last tenants were evicted and spent six months fighting the eviction in court,
delaying their eviction and then retumed illegally, squatking in the property for
weeks of more all night screaming, violence, questionable behavior with youth
and again, shreams of homeless men and many, many calls to the Si. Paul Police.
This property cannot be brought up W code — it is unsafe for habitation, a filthy
condemned building thai our neighborhood does not welcome and cannot sustain. The

condition is beyond renovation - it will never amaet anything but sium standard
investment
RecenUy we were informed that the properry would be demolished and then some men
showed up saying they were the new owners and they rudely began work on the pmperty
illegally. They left garbage overIlowing in a dumpster in the driveway which instigated
another health hazard — mice and rats and stench. With anti-neighborhood atatudes such
as this, we do not want the city to allow them access to the building for any renovation
because we know it will only lead to more disturbances, violence and degradation of the
area - a serious affmnt to our quaIiTy of life, safety of our children and to our community.
Many in our neighborhood have invested in 'vnp2oving our properties and #388 Goodrich
diminishes that retiun on a daily basis. We already have to deal with two other properties
in the immediate vicinity that aze vacant and boarded up. The St. Paul Police have
enough condemned, abandoned and boarded up properkies to deal with. T'his one sucked
up our energy and goodwill for too long, as well as taxpayer dollars and police officers
valuable time on too many occasions to count. The City of St Paul will suffer urban
flight if low rent renovation of properties like ttris is allowed to continue Uecause it does
not support healthy and safe family neighborhoods.
My family and I ask that you approve the demolition of the building, clearing the site and
supporting the West 7`� Street Federation or the Neighborhood Community Housing
Services to urvest in turning this destniction into opporhuYity for a family that really
wants to settle in tkus neighborhood and contribute to the weltbeing of our community.

I just got back from a legislative hearing on the property at 386-388
Goodrich Avenue. From a tenant and behavior standpoint, it has been a
nuisance properiy for over 20 years. At last, it appears we are making
strides toward having the building demolished. In the history read by
Marcia Moermond, the Legislative Hearing O�cer, the safe price o4 this
filthy, dilapidated, vermin-infested building appears to have doubled
over the last few years, to a price in the $300,000 bracket. As I
indicated in an earlier communication, a similar property two blocks
over, on Harrison, was reportedly sold recently for nearly $500,000.
Even the nicest, largest, completely renovated house on Goodrich would
not bring that price from a legitimate buyer. It is apparent that
something is going on with these and other properties.
The owner of the building that was the subject of today's hearing is
listed as JT Horizon, LLC. All I can fiind on the Internet is the
information below, and I don't know what all the numbers mean. Betty
Moran of the District 9 Council/West 7th Federation can supply a list of
other properties under this ownership that have similar histories and
are in similar condition.

John (and by copy to Dave Thune), could the Saint Paul Police Department
and/or the City Council initiate an investigation into the practices and
persons involved in these sales? It appears to us as neighbors that
there must be some kind of "money laundering" or other illegal scheme
involved with these properties. If catching the owners at the top will
start a rockslide at the bottom, we're all for it. We have 6een calling
on many properties for many years, and your officers have been doing
their best for us, but they're not being supported at the governing
level. If this is not your jurisdiction, could you pass it along to the
County or State Attorney (or FBI?), along with the Force Unifs

7. Ordering the owner to remove ar repair the building(s) at 388 Goodrich Avenue within fifteen
(15) days from adoption of resolution.
Mr. Magner stated the building was a two-story, wood frame, duplex on a lot of 4,792 square feet and
had been vacant since February 9, 2007. A code compliance inspection had been done on July 17,
2007. The vacant building registration fees were delinquent in the amount of $250 and the $5,000
performance bond had not been posted. On Apri124, 2007, an inspecrion of the building was done and
a list of deficiencies which constitute a nuisance condition was developed. An order to abate a
nuisance building was posted on May 14, 2007 with a compliance date of June 12, 2007. To date, the
property remained in a condition which comprised a nuisance as defined by the Legislative Code.
Ramsey County TaYation esrimated the market value of the land to be approximately $44,500 and the
building to be $212,700. Reai estate taYes for were current. Code Enforcement estimates the cost to
repair the building to be approxnnately $50,000 to $90,000. The cost for demolition was estimated to
be approxunately $1Q,000 to $11,000. There had also been two sulmnary abatements issued to this
property in 2007, one of which went to wark order. to secure the building and the City had to board
the building to secure it from trespass. Mr. Magner stated that people had illegally entered the building
in an attempt to make some repairs and they were told they were not allowed to do any wark on the
building until a performance bond was posted and permits were issued which had not happened to
date. Code Enforcement recommends the building be repaired or removed within 15 days. Mr.
Magner presented photographs of the property.
The property owner of record, JT Horizon LLC, did not appear.
Ms. Moermond asked Mr. Magner whether he had any contact with JT Horizon. Mr. Magner stated
that he had no recent conversations with anyone as far as a plan. He had previously talked to someone
and told them the building was a category III vacant building and they would need to post a bond.
Ms. Moermond said that obviously since there had only been two suminary abatements at the property,
someone must be maintaining it. Mr. Magner responded that he was aware that someone was doing
some work at the property, however, this had not been a vacant building for very long. Prior to this
property being transferred to vacant buildings, it was a case managed property as there were numerous
complaints and concems from the neighborhood against the property. Majority of the complaints were
legitnnate based on the activities of the occupants. Subsequently, the building was condemned and the
building had to be boarded to keep the tenants out of the building. The building was condemned on
January 23, 2007 with a vacate date of February 1, 2007.
Ms. Moermond asked what the conditions were at the property that lead to the condemnation. Mr.
Magner stated that the properiy was condemned due to material endangerment, lacking maintenance,
fire and electrical deficiencies; other violations included exterior wails and trims, windows, doors,
screens, floors, defective ceilings, non-functioning stove and numerous other deficiencies which
constituted a code compliance inspection. In looking at the code compliance inspecfion, there were 33
items listed which required extensive repairs.
Ms. Moermond stated that the code compliance report listed the property as a duplex, however, it also
listed an illegal third unit in the basement. She asked whether this was a legal duplex or a non-
conforming duplex. Mr. Magner stated that the report under zoning indicated that it was inspected as
dupiex, however, it was a legal non-conforming duplex due to the lot size. If they were to re-build the
property as a duplex, they would be required to have a 7,500 square foot lot.

Someone in the audience stated that there were two property addresses for the house that being 388
and 386 Goodrich.
Burke Murphy, 387 Goodrich, appeazed and read a letter into the record from her neighbor, Edward
Jirak, 390 Goodrich, as he was unable to attend the hearing. Ms. Murphy then read a letter into the
record on behalf of her family. Said letters are attached and made a part of these minutes.
Robert and Susan Brown, 121 Western Avenue, appeared. Ms. Brown stated that their home was
located adjacent to 388 and they experienced problems with trash and garbage overflowing from the
dumpster, which had been placed there in June and which spilled over into their yard. As a result,
there was an ovenvhelming infestarion of mice which had made their way into their home as well. Mr.
Brown stated that he had purchased the property approxunately 10 years ago. The beha�ior of the kids
at 388 was atrocious and he felt he was acting as a parent to them as no other responsible adult was
taking charge of these kids. He had two teenage sons and the kids from the upstairs unit would throw
light bulbs into their yazd which prevented them from enjoying their backyard with all the broken
glass. There was also a lot of garbage Chat was being thrown into their yard as well and the smell was
horrific. He explained that he warked at the Walker Art Center and part of his responsibility was to
entertain artists and curators when they would come into town for an opening. He had planned an
event at his home the first weekend the dumpster had arrived and he felt there was no way he could
entertain at his home with the smell and the filth. He wanted to see the building demolished, however,
he was concemed about fumigating the building when it was demolished because of the rodent
infestation.
Lonaine Hosley, 391 Goodrich, appeazed and stated she had lived at this address for 45 years. For at
least the past 20 years, the property had been rented to low-income tenants and no inveshnent was ever
put back into the property. She believed no one screened the tenants that they rented to as there were
behavioral problems including drugs, sex, shouting at all hours of the day and night. The police had
been called numerous times to this property and could attest to the behavior of the tenants. Within the
past couple of months, she had witnessed a man working on the house and she confronted him and told
him he was not supposed to be on the property doing anything as the building was condemned. The
man did eventually leave and had not returned. She decided to check out the house and found that it
was not locked so she and another neighbor decided to go in to look at the interior condition. She
could not believe that anyone could have possibly lived there as there was fecal matter and urine in
almost every room. The floors in the kitchen were heaved. She just could not believe the dilapidated
condition of the house.
Ms. Moermond stated that in looking at the color pictures, the fecal matter shows up quiet clearly in
the pictures. She stated that there had been comments about tenant behavior and she believed property
management was important to discuss. 5he explained that she really needed to focus on the physicai
condirion of the building.
Ms. Hosley continued that the house was boarded up, however, someone started taking the boazds off
the windows. The windows were open and she was sure the elements probably did additional damage.
Ms. Moermond asked about the eviction of the tenants. Ms. Hosley responded that the Police had to
teil a woman that she had to leave as there was a court arder for her eviction. The dumpster was full of
everything that the tenants had thrown out. She was concemed that h were living in the house
since it was open to access. She wished to see the building demolished.

Kristi Iverson, 345 Goodrich, appeued and presented photos that she took of the property. She
pointed out the window that had been broken into when people had entered the house. She stated that
she had lived in her home for the past 15 years which was approximately one block from 388. She
often walked around the neighborhood and on one occasion over a year ago, there were people sitting
on the porch at 388 with the windows and doors wide open and the stench from the house was so
overwhelxning that she almost fell over.
Audrey Halbert, 401 Goodrich, appeared and stated that she was 81 years old and had lived in the
neighborhood her entire life. It was her opinion that the property had significantly deteriorated over
the past 20 years and she would like to see the building demolished.
Betty Moran, West Seventh/Fort Road Federarion, appeazed and stated that she had some history of the
property she wished to shaze. She stated that JT Horizon was listed as the owner, however, she was
aware that the actual naznes of the owners were Jeffrey Lamphrey and Tony Green. It was her
information that Tony Green worked for a finance company. They also owned several properties in
West Seventh Street all of which seemed to be in this condition or were on there way to this condition.
They were all also managed in this same manner. In May, 2000, this properiy sold for $130,000; in
December, 2005, the property sold for $388,000. In her research, she found that most of the properties
that JT Horizon owned had the same financials with some as high as $500,000 and she believed these
properties were on Farbes and on Harrison. JT Horizon currently owned a property at 263 Duke
Street, which was a duplex with only the lower unit being occupied. Ms. Mcermond asked whether
Ms. Moxan was indicating that these properties appeared to have been appraised and refinanced in
approximately 2004. Ms. Moran stated that this was conect. She went on to say that 263 Duke Street
was currently in the same condition as 388 Goodrich where the City is managing the property. She
stated that the Federation wished to see this property demolished.
Pah Hosley, 391 Goodrich, appeared and stated that 388 Goodrich had been a drug house for a
minimum of 20 yeazs. During the suimner time, he could not open the windows due to the noise and
activity going on at this property all night long. He could not recall the owner ever even visiting the
property and when a construction person showed up at the building, he gaue the neighbors an"I don't
care" attitude. The property continues to deteriorate and he wished to see the building demolished.
Ms. Brown stated that she had a concern with the windows being open and she could see a ceiling fan
going which she believed was a fire hazard. Ms. Brown continued that she had concern with teens
scoping out the property. There had been two shooting on the corner within the past two weeks which
she was very concerned about. Mr. Hosley stated that he was aware that the meter had been jurrtped.
Ms. Murphy expressed concern about the vermin and air quality when the huilding was demolished.
Roger Egge, 320 Goodrich, appeazed in support of the neighbors but did not speak.
Mary Jean Cutting, 413 Goodrich, appeared in support of the neighbors but did not speak.
Ms. Moermond asked Mr. Magner to address the concerns expressed during the process of a
demolition. Mr. Magner stated that if the building were scheduled for demolition, part of the
conditions for the contractor was that the building be baited for any rodents which would be done
through a private externunatar. The property would need to be tested to be sure it was cleared of all
rodents before the demolition could proceed. As for the air quality, the property would need to be
inspected by a licensed contractor through the State Department of Health to identify any asbestos or
other hazardous materials. Those items would be required to be abated and would need to be removed

to an approved site for disposal prior to the building actually coming down. During the time of
demolition, air quality was generally controlied through the use of watering the site to reduce the
amount of dust.
Ms. Moermond asked Mr. Magner whether he had any specific laiowledge of the water, gas or
electrical service and whether the electrical service had been tampered with. Iv1r. Magner stated that
the report indicated that everything had been shut off, however, he would need to personally inspect
the property or verify with Xcel that the meter had been turned off. In the case of demolition, all
utilities were required to be cut which meant that the gas would be cut in the boulevazd and the electric
would be cut at the pole which would also be the case with water and sewer.
Ms. Moermond stated that after reviewing the record in that the vacant building registration fees were
delinquent and there was no vacant building registration form completed; a performance bond had not
been posted; there was not a work plan indicating how the rehabilitarion will occur or how it will be
financed and since the owners of record did not appeaz, she recommended the building be removed
within five days with no option for repair.
