1 WHEREAS, Department of Safety and Inspections has requested the City Counci:
2 to hold public hearings to consider the advisability and necessity of ordering the repair or
3 wrecking and removal of a two-story, wood frame duplex located on property hereinafter
4 referred to as the "Sub}ect Property" and coxnmonly lrnown as 9Q7 BURR STREET.

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before October 25,
2006, the following are the now lrnown interested or responsible parties for the Subject

WHEREAS, Deparhnent of Safety and Inspections has served in accordance with
the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an
"Order to Abate Nuisance Building(s)" dated May 14, 2007; and
WHEREAS, this order informed the then l�own interested or responsible parties
that the structure located on the Subject Property is a nuisance building(s) pursuant to
Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they
must repair or demolish the structure located on the Subject Property by June 12, 2007;
and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WIIEREAS, this nuisance condition has not been conected and Department of
Safety and Inspections requested that the City Clerk schedule public hearings before the
Legislative Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in
accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the
time, date, place and purpose of the public hearings; and

WF�REAS, a hearing was held before the Legislative Hearing Officer of the
Saint Paul City Council on Tuesday, August 14, 2007 to heaz testimony and evidence,
and a$er receiving testimony and evidence, made the recommendation to approve the
request to order the interested or responsible parties to make the Subject Property safe
and not detrimental to the public peace, health, safety and welfaze and remove its
blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition of the structure to
be completed within fifteen (15) days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on
Wednesday, September 5, 2007 and the testimony and evidence including the action
taken by the Legislative Hearing Officer was considered by the Council; now therefore
BE IT RE50LVED, that based upon the testimony and evidence presented at the
above referenced public hearings, the Saint Paul City Council hereby adopts the
following Findings and Order conceming the Subject Property at 907 BURR STREET.
That the Subject Property comprises a nuisance condition as defined in
Saint Paul Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to
exceed five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to conect the deficiencies or to demolish and remove
the building(s).
5. That the deficiencies causing this nuisance condition have not been
corrected.
6. That Deparhnent of Safety and Inspections has posted a placard on the
Subject Property which declares it to be a nuisance condition subject to
demolition.
7. That this building has been routinely monitored by Department of Safety
and Inspections, Vacant/Nuisance Buildings.
8. That the lrnown interested parties and owners are as previously stated in
this xesolution and that the notification requirements of Chapter 45 have
been fulfilled.

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject
Property safe and not detrimental to the public peace, health, safety and welfare
and remove its blighting influence on the community by demolishing and
removing the siructure in accordance with all applicable codes and ordinances.
The ���erre� demolition and removal of the shucture must be completed
within r`� '� five (5) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time
Deparhnent of Safety and Tnspections is hereby authorized to take whatever steps
are necessary to demolish and remove this structure, fill the site and chazge the
costs incurred against the Subject Property pursuant to the provisions of Chapter
45 of the Saint Paul I.egislative Code.
In the event the building is to be demolished and removed by the City of Saint
Paul, all personal property ar fixtures of any kind which interfere with the
demolition and removal shall be removed from the property by the responsible
parties by the end of this time period. ff all personal property is not removed, it
shall be considered to be abandoned and the City of Saint Paul shall remove and
dispose of such property as provided by law.

The building is a two-story, wood frame duplex, on a lot of 6534 square feet.
According to our files, it has been a vacant building since September 27, 2005.
The current property owners are Jim Angle and Bee Nga Thao, per AMANAA and Ramsey county
property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been ten (10) SiJMMARY ABATEMENT NOTICES since 2005.
There have been seven (7) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of snow and ice
- Removal of tall grass and weeds
- Board up building
On Apri126, 2007, an inspection of the building was conducted, a list of deficiencies which constitute
a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A
NLJISANCE BUILDING was posted on May 14, 2007 with a compliance date of June 12, 2007. As of
this date this property remains in a condirion which comprises a nuisance as defined by the legislative
code.
The Vacant Building registration fees are delinquent in the amount of $250.00.
Taxation has placed an estimated market value of $50,000 on the land and $100,000 on the building.
As of February 14, 2006, a Code Compliance inspection has been completed.
As of August 10, 2007, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $60,000-$70,000. The
estimated cost to Demolish is $8,000 to $10,000.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes the
Division of Code Enforcement to demolish and assess the costs to the property.

Where wall and ceiling covering is removed, attic, replace doors and windows, (insulation,
glass, weather stripping, etc.) shall meet new energy code standazds.
Prepare and paint interior and exterior as necessary (take the necessary precautions if lead
base paint is present).

4. Most of the roof covering could not be properly inspected from grade. Recommend this

to meet appropriate Codes when complete.
6. All items noted as recommended do not have to be completed for code compliance but
should be completed at a later date. Possible purchasers of property shall be made aware
of these items.

Property Improvement, hereby declares the premises located at:

first remedial action, a Code Compliance Inspection must be obtained from the
Suilding Inspection and Design Section, 8 Fourth Street East, 5uite 200, Commerce
Building (651)266-9090. That inspecfion will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a five thousand dollar ($5,000.00) performance bond with the
Building Inspection and Design Office before any permits are issued, except for a
demolition permit.

This building(s) is sub}ect to the restrictions of Saint Paul Ordinance Chapter 33.03 and
shall not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a two-story, wood frame, duplex with a shed.
Exterior
1. The eaves and soffits are in a state of disrepair or deterioration. Repair
all defects, holes, breaks, loose or rotting boards, to a professional state
of maintenance. Permit may be required.
The exterior walls and/or trim of the house has defective, peeled, flaked,
scaled or chalking paint or has unpainted wood surfaces. Scrape and
repaint to effect a sound condition in a professional manner.
The foundation is deteriorated, defective or in a state of disrepair.
Repair all foundation defects in a professional manner to a
weather-tight, water-tight and rodent-proof condirion. Permit may be
required.
4. There are missing or defective guardrails. Provide all stairways,
porches, decks or steps which are more than 30" high with guardrails
and intermediate rails with openings in the guardrail no more than four
(4) inches apart and in accordance with the State Building Code.
5. There is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire building. Remove rodent
harborages in the yard areas. Tuckpoint the foundation if necessary to
rodent-proof the building to prevent re-infestation. Immediately remove
any dead rodents from the premises.
6. The roof is deteriorated, defective, or in a state of disrepair. Repair or
replace the roof covering to a sound, tight and water impervious
condition. Permit may be required.
7. The exterior walls of the house are defective. Repair all holes, breaks,
loose or rotting siding, to a professional state of maintenance.
8. The windows and/or storm windows are in a state of disrepair. Repiace
all missing or broken window glass. Make all necessary repairs to
frames, sashes, hazdware and associated trim in a professional manner.

The bathroom floor covering is deteriorated or inadequate. Provide
floor covering which is impervious to water and easily cleanable
throughout the bathroom and seal around the edges and fixtures.
2. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for
all entry doors to dwelling unit(s).
3. Due to the number of deficiencies, a Code Compliance Inspection will
be required before a Placard Lift will be issued.
4. Lack of Electricity. Immediately restore electrical service. Failure to
provide proper electrical service will result in these premises being
declared Unfit for Human Habitation and ordered vacated for lack of
this basic facility. Use of candles, fuel operated lighting or extension
cord wiring is not permitted while the power is off.
FURNACE: Have a licensed heating contractor service and clean the
fiimace or boiler and make any necessary repairs. Perform a GO test on
the heating plant. Then, send the attached form back to the Inspector.
Repair of gas fired appliances requires a permit.
6. Lack of Natural Gas Service. Immediately restore natural gas service.
Failure to provide natural gas service will result in these premises being
declared Unfit for Human Habitation and ordered vacated for lack of
this basic facility.
7. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit
May Be Required.
8. There aze missing or defective guazdrails. Provide all stairways,
porches, decks or steps which aze more than 30" high with guardrails
and intermediate rails with openings in the guardrail no more than four
(4) inches apart and in accordance with the State Building Code.
9. The interior ceilings are defective. Repair all ceiling defects and finish
in a professional manner.
10. Lack of Water Service. Immediately restore water service. Failure to
provide water service will result in these premises being declared Unfit
for Human Habitation and ordered vacated for lack of this basic facility.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not conected by June 12, 2007 Neighborhood
Housing and Property Improvement, Division of Code Enforcement, will begin a
substantial abatement process to demolish and remove the building(s). The costs of this
action, including administrative costs and demolifion costs will be assessed against the
property taxes as a special assessment in accordance with law.

As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite �200 Commerce
Building, (651}266-9090. This inspection will identify specific defects, necessary repairs
and legal requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you se11, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declazes it to be a"nuisance condition", subject to demolition and removal by the City.
This placazd shall not be removed without the written authority of the Department of
Neighborhood Housing and Property Improvement. The department is further required to
file a copy of this "Order to Abate" with the City Clerk's Office.
If conective action is not taken witrun the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including adtninistrative costs will be assessed
against the property as a special assessment in accordance with law. If you have any

4. Ordering the owner to remove or repair the building(s) at 907 Burr Street within fifteen (15)
days from adoprion of resolurion.
Mr. Magner stated the building was a two-story, wood frame, duplex a lot of 6,534 square feet and had
been vacant since September 27, 2005. A code compliance inspection had been done on February 14,
2006. The vacant building registrarion fees were delinquent in the amount of $250 and the $5,000
performance bond had not been posted. On April 26, 2007, an inspecrion of the building was done and
a list of deficiencies which constitute a nuisance condition was developed. An order to abate a
nuisance building was posted on May 14, 2007 with a compliance date of June 12, 2007. To date, the
property remained in a condition which comprised a nuisance as defined by the Legislative Code.
Ramsey County Taxation estimated the market value of the land to be approximately $50,000 and the
building to be $100,000. Real estate tases for were current. Code Enfarcement estimates the cost to
repair the building to be approximately $60,000 to $70,000. The cost for demolition was estimated to
be approximately $8,000 to $10,000. There had also been 10 summary abatements issued to this
property since 2005, seven of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stored refuse, remove tall grass and
weeds and remove snow and ice. Code Enforcement recommends the building be removed within 15
days. Mr. Magner stated that they had met with the neighbors on a number of occasions and they
would like to see some resolution to the problem with this property. The property was also located in
the Invest St. Paul area. Mr. Magner presented photographs of the property.
Ms. Moermond asked what conditions had lead to the condemnation and whether Mr. Manger was
aware of the conditions at the property since the code compliance had been done in Februazy, 2006.
Mr. Magner responded that the building was condemned for lack of gas and electricity as well as the
basic maintenance issues including windows, doors, screens and interior conditions. They also had to
board a basement window at the property as recent as a month ago as someone had tried to break into
the property. As far as the code compliance, he did not have any lrnowledge of the conditions on the
interior of the building and believed that it was possible that copper could have been stolen as there
had been a concentration of copper thefts in this neighborhood over the past year. He recommended
that Jim Seeger would need to do a walk through of the building to determine whether the conditions
had changed since the code compliance inspection in 2006.
The property owners of record, Jim Angle and Bee Nga Thao, did not appear. No other parties of
interest appeared.
Ms. Moermond stated that after reviewing the records and since the owners of record did not appear,
she recommended removing the building within 15 days with no option for repair.
