RESOLVED, That the proper officers of-the City of
Saint Paul are hereby authorized to pay to James D. Wolff
Construction Company on Partial Estimate No. 4 'for that
contract known as the Broadway Relief Sewer Proiject Contract
"B", said estimate being for the period from October 1, 1962
to October 31, 1962 in the amount of $26,462.23, and such
other partial estimates on said contract as may be subse-
quently by said contractor presented to and approved by the
City Engineer, it being the understanding of this Council
that such partial payment or payments on this estimate or
additional estimate or partial estimates on said contract in
no way is to be, construed as an act by the City or any of its
agents, servants or employees, extending the time specified- -
for completion or in any way changing the terms of said con-
tract, plans or specifications thereof, nor in any way or by
any means shall this resolution or payment or payments made
under authority of this resolution be construed as a waiver
of the rights of said City under said contract; and provided
further, that prior to payment of any of the aforesaid partial
estimate or estimates saYd contractor, by its duly authorized
agent or corporate officers and its sureties, shall each of
them file with the City Comptroller of the City of Saint Paul,
in a form approved by the Corporation Counsel, an acceptance
of the condition of payment as hereinbefore set forth; and be it
RESOLVED FURTHER, That in the absence of said ac- -
ceptance being filed with the Comptroller, no payment or pay-
ments., as aforesaid, shall be made.
