BE IT RESOLVED that, upon the petition of Gerald Frisch d/b/a Larpenteur Estate Apartments
as documented in Public Works Technical Services, Vacation File Number 07-2007, the public
property hereinafter described, as follows and on attached map Exhibit A, is hereby vacated of
its interest as street right-of-way:
7 That part of Huron Street as dedicated by the plat of CHELSEA HEIGHTS,
8 lying southerly of the south right-of-way line of Larpenteur Avenue and
9 northerly of a line lying 20.00 feet southerly and parallel to the easterly
10 egtension of the north line of Lot 5, Block 3, CHELSEA HEIGHTS, Ramsey

RESOLVED that, subject to the herein stated exceptions and with the accompanying Certificates
of Intended Non-Use, filed voluntarily on behalf of: District Energy/District Cooling St. Paul,
a private, non-profit Minnesota corporation; Comcast, a Pennsylvania corporation; Qwest,
a Delaware corporation; Northern States Power Company d/b/a Xcel Energy--Gas
Division, a public utility; made a part hereof by this reference and filed in the office of the City
Clerk of Saint Paul, the City, for itself and on behalf of these corporations and departments,
waives the right to the street right-of-way and utility easements in the area to be vacated,
described above and subject to the following, including:
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petilioners, their successars and assigns sha11 pay $1200.00 as an adnlinistrative
fee for this vacafion which is due and payable within 60 days of the effective date of this
resolution.
2. That the petitioner shall be responsible for the reconstruction of the intersection of Huron
and Larpenteur to eluninate the appeazance of public right-of-way. This shall include, but
not be limited to, reconstruction and/or conshuction of storm sewer structures, curb,
gutter, sidewalk and boulevard, to the satisfaction of the City of Saint Paul Department of
Public Works and Ramsey County Public Works under permits issued by the City of Saint
Paul Department of Public Works and/or Ramsey County Public Works.

That a permanent utility easement shall be retained on, over, under and across the
vacated area on behalf of the City of Saint Paul, Department of Public Works to reserve
the right of the City to maintain and operate any sewer in or upon said easement and to
enter upon said easement ar any portion thereof at any time and from Ume to time, for
the purposes of future construction, reconstruction, inspection, maintenance, or repair of
the same or, any part thereof. Said utility easement shall be subject to the following
conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
any other objects_which may prohibit normal access to utility facilities for maintenance
purposes will be pernutted within the easement area.
b. Improvements in ar upon the above described easement that do not prohibit the City
from exercising its reserved rights may be allowed by obtaining written permission
from the Department of Public Works Sewer Division with the understanding that the
restoration and costs of such improvements sha11 be the sole responsibility of the
petitioner, its successors and assigns in the event the City exercises its reserved
easement rights.
a Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of the Department of Public Warks operations, all removal,
replacement or modification costs shall be borne solely by the petitioner.

harmless the City of Saint Paul, its officers, agents, employees, and servants from a11
suits, actions, or claims which sha11 arise from any injuries or damages received or
sustained by any break in any service pipe or connection in said reserved easement
azising out of or resulting from any action or negligence of the peUtioner, its employees,
agents, or business invitees.
3. That an easement sha11 be retained over, under and across that part of Huron Street subject
to the action on behalf of Northern States Power Company d/b/a Xcel (Electric), a
Minnesota corporation, for its existing facilities. The petitioner or its successar sha11
provide new easements if required and the petitioner or its successor shall assume all costs
of relocating facilities to the new easements.

behalf of the Board of Water Commissioners of the City of Saint Paul to reserve the right of the Board

I recommend a public hearing before the City Council be held on September
5, 2007 to consider the petition of Gerald Frisch d/b/a Larpenteur Estate
Apartments.
This petition is to vacate part of a platted street south of Larpenteur on Huron
Street.
The purpose of this vacation is to allow property owner to develop on east side
of Huron, although there is no building proposed within the vacated area.
This property is located in City Council Ward 5, Planning District 10.

I, the undersigned constituting a ma,}ority of the owners (or their iegatly
designated representatives) of the abutt�s�g properties, do hereby getition the
Cauncil of the City of Saint Paul to vacate its interests in the property lega]Iy
described as foltaws:
That part of E3uron Street befween the south right-of-way line of
Larpenteur Avenue and a line 24.00 feet south of and parallel to
the easterly extension of the nos�tk line of Lot 5, Block 3, Chelsea
Heights.
I request this vacation for the fotiowing reasons:
Approximately siY (5j years ago as part of a settiement of a conflict
between City of St. Paul, Lazo Inc., owners of Fatrick's Lounge (on-sale liquor
establishment on Lots 1 thraugh 6) and adjoining neighbors, the St. Paul City
Cotaricil authorized the barricade of portion of Huron Street adjacent to Lots 1
thsough 6 to restrict access by bar patrons on the residential properties south
of Lot 6. As a result, said restricted portion of Huron Street adjacent to said
Lats 1 through 6 is unavailable for use by the public as a North - Sauth sEreet.
Accordingly, Patrick's Lounge has had the sole use and enjoyment of a public
street to the exclusion of neighbors and the public. Currently Public Works
Department of the City of St. Paul has and is installing sewer and other public
utilities in Huron Street. At the present time it appears reasonabie and
apprapriate to vacate said portion of Huron Sireet, which is for all intents and
purposes no longer used as a pubfic street. I,arpenteur Estates Apartments,
LLC is the owner of ad}oinixig land to Yhe East of said portion af Huron Street
proposed to be vacated and proposes to develap a parking ratnp on the East
side of said portion of Huron Street. No construction is proposed on tY�at
portion of Huron Street to be vacated. Lazo, Inc. has refused to join in this
Petition to vacate city interest. Larpenteur Estates Apartmen'Es, LLC believes
that its request to vacate said portion of Huron Street constitutes a hardship
and does hereby request that the City Council waive the requirement for
signatures of a majority of owners, pursuant to Secfion 130.02(3) of the St.
Paul izgislative Code. `

1) That the petitioner shall be responsible for the reconstruction of the intersection of
Huron and Larpenteur to eliminate the appearance of public right-of-way. This shall
include, but not be limited to, reconstruction andlor construction of storm sewer
structures, curb, gutter, sidewalk, and boulevard, to the satisfaction of the City of Saint
Paul Department of Public Works and Ramsey County Public Works under permits
issued by the City of Saint Paul Department of Public Works and/or Ramsey County
Public Works.
2) Existing Storm sewer and Sanitary sewer easements, and access for maintenance must
remain.

I recommend a public hearing before the City Council be held on September 5, 2007
to consider the petition of Gerald Frisch d/b/a Larpenteur Estate Apartrnents.
This petiUon is to vacate part of a platted street south of Larpenteur on Huron Street.
The purpose of this vacation is to a11ow property owner to develop on east side of
Huron, although there is no building proposed within the vacated area.
This property is located in City Council Ward 5, Planning District 10.
