RESOLVED, that the Council of the City of Saint Paul hereby approves and ratifies the

attached Memorandum of Agreement between the City of Saint Paul and the Saint Paul Supervisors
Organization (SPSO) to implement a pilot project within Saint Paul Regional Water Services for
the job classification of Engineering Technician Supervisor — Water Utility.

The purpose of this ageement is to implement pilot pmject titled "Saint Paul Regional Water Services Water TecUnician Job Family
Competency Team Recommendations Report - November 20, 2006" aka the Competency Modeling Document and the "City of Saint
Paul - Water Technician Job Family Competency Mahix - November 20, 2006."
The City and SPSO agree that the pilot project shall apply to those employees of Saint Paul Regional Water Services who hold
positions allocated to the Engineering Technician Supervisor - Water Uulity class and who are represented by SPSO.
Advantages If Approved:
Saint Paul Regional Water Services and the SPS0.represented employees at Saint Paul Regional Water Services will both realize
benefits evolving from the modification of the Civil Service Rules noted in the attached MOA.

2007 Memorandum of Agreement
In accordance with Civil Service Rule 8.A.6, governing the unplementation of Human Resources
pilot projects, the City of Saint Paul (City) and the Saint Paul Supervisors Organization (SPSO)
hereby state that they have met and discussed the proposed pilot project. The proposed pilot
project is described in the attached documents titled "Saint Paul Regional Water Services
Water Technician Job Fanuly Competency Team Recommendarions Report — November 20, 2006"
aka the Competency Modeling Document and the "City of Saint Paul - Water Technician Job Family
Competency Matrix — November 20, 2006" The City and SPSO agree that the pilot proj ect shall
apply to those employees of Saint Paul Regional Water Services who hold positions allocated to the
Engineering Technician Supervisor — Water Utility classification. The City and SPSO agree that the
following Civil Service Rules, as modified, shall be used in the admnustration of this pilot project:
Civil Service Rule 6.B (Examination Contents). Modify Civil Service Rule 6.B to
allow qualifying examinations, e.g., pass/fail for promorion candidates. This rule, as
modified, shall be used only for examinations used to determine eligible candidates for
vacancies in positions allocated to the Engineering Technician Supervisor — Water Urility
classification at Saint Paul Regional Water Services.
2. Civil Service Rule 7(Eligible Lists). Modify Civil Service Rule 7 to allow for
promotion eligible lists established for posirions allocated to the Engineering Technician
Supervisor — Water Utility classification at Saint Paul Regonal Water Services to remain
in effect indefinitely.
Civil Service Rule 14 (Promotion Requirements). This Rule governing requirements to
be met for promotional rights still applies in full.
It is agreed that adoption of the " City of Saint Paul - Water Tecl�nician Job Family Competency
Matrix — November 2Q 2006" shall be done through the twenty-day notice process.
It is further agreed that grievances arising from terxns and conditions of employment in the City
of Saint Paul Civil Service Rules and Salary Plan and Rates of Compensation shall continue to
be processed through the procedure outlined in the current collecrive bargaining agreement
between the City and SPSO. Any grievances arising from alleged violations of the procedures
established in said pilot project shall be subject to the Civil Service grievance procedure.
However, because both parties aclrnowledge that the City retains its inherent managerial rights to
evaluate and select staff, any concerns regazding the substantive determinations of the
Competency Review Panel shall be appealed to the Civil Service Commission as outlined in the
November 20, 2006 Competency Modeling Document, which is attached.

2007 Memorandum of Agreement
It is further agreed that this Memorandum of Agreement shall initially be in force for three yeazs
from the adoption of the pilot project by the Saint Paul City Council, anticipated to be Febrnary
2007, with an automatic e�ctension to July 2010 unless either of the parties, the City or SPSO,
decide to end or modify said ag�ement prior to Febmary 2010. Finally, it is agreed that tlus
Memorandum of Agreement sha11 not be used to set, in any way, a binding precedent on either of
the parties.
Finally, it is agreed that 60 calendaz days prior to July 2010, the City will notify the Saint Paul
Supervisors Orgauization, in writing, that said date is pending so that a discussion of the pilot
process and the further ea�tension of the pilot can be held.
