WHEREAS, Kenneth W. Kellerman, an employe of the
Department - of Public Safety, Bureau of Fire Protection, was
injured in a third party accident on October 24, 1960, when
the apparatus on which he was riding was struck by a atruck
owned by Consumers Milk Company and driven by Joseph J.
Johnston, and the City has expended the sum of $17.50 for
medical expense and $134.74 for salary paid to said employe
during the period of his disability on account of said
accident; and
WHEREAS, the Fire Department vehicle involved in
said accident was damaged to the extent of $1,424.19, as
evidenced by Registered Bill No. 3 -3221; and

WHEREAS, the office of the Corporation Counsel is
in possession of draft of the St. Paul Fire and Marine
Insurance Company, insurer of Consumers Milk Company, in
the amount of $152.24 to cover the City's subrogation claim
in connection with the personal injury of its employe, Kenneth
W. , Kellerman, and another draft in the amount of $1,000
for property damage, and recommends that the City accept
these sums in full and complete settlement of its claims
against said Consumers Milk Company, Joseph J. Johnston and
St: Paul Fire and Marine Insurance Company, now, therefore,
be it
RESOLVED, That the proper City officers are hereby
authorized and directed to accept said settlement, totaling
$1,152.24, in full, final and complete settlement of the
City's claims against the third party involved in said
accident of October 24, 1960, and to sign any necessary
releases; be it
FURTHER RESOLVED, That of said total settlement of
$1,152.24, the sum of $134.74 be credited to Fund B -C -1,
the sum of $17.50 be credited to Fund 31 Gl A, and the
sum of $1,000 be credited to payment of Registered Bill
No. 3- 3221., and the balance of said Registered Bill is hereby
cancelled.

WHEREAS, Kenneth W. Kellerman, an employe of'the
Department of Public Safety, Bureau of Fire Protection, was
injured in a third party accident on October 24, 1960, when
the apparatus on which he was riding was struck by a `-.truck
