Paul Legislative Code, therefor, that the building setback line in
respect of the south line of Thomas Avenue for the west 10 feet of

Dear Madam:
This is in the matter of the appeal of the Jehovah Evangelical Lutheran
Church to relax the building Line set back requirement to permit a canopy
on property located on the south side of Thomas Avenue between Snelling
Avenue and•Asbury Street. The property is described as the west-10-feet
of-Lo-t-.9-and all of Lot 10, Block 3, Hamline Syndicate Addition #3. The
property is zoned "C" residence.
The site is developed in part with the existing church structure, parish
offices and meeting rooms which front on Snelling Avenue. East of the
church structure are three single - family residences fronting on Thomas
Avenue. It is proposed to remove all of the above buildings and construct
a new church. It is necessary to obtain Council approval to secure a
change in the building line set back for the portion of the site above
described to permit construction of a•canopy over the entrance to the
church building which Would extend from the faeQ of the building to the
Thomas Avenue property line. (See attached plot plan for overall plan.)
The pres n set back o he remaining residences in the block to the east
is 20 feet. However, the required set back under Chapter 62 of the Legis-
lative Zoning Code is 12 feet. The entire site is IT' shaped having a
frontage of 234.5 fiei�e:7 on Thomas Avenue and 149.85 feet on Snelling Ave-
nue resulting in a total area of approximately 31,211 square feet.
East and adjoining and fronting on Thomas Avenue are single - family resi-
dences and one multi- residence at the end of the block; north and across
Thomas Avenue is the Hamline playground; south and across a public alley
fronting on Edmund Avenue are single - family residences, also commercial
uses which front on Snelling Avenue; west across Snelling Avenue are
various commercial uses. Field investigation discloses no objection to
this proposal. The Board is of the opinion that the proposal will not
have a detrimental effecg on the residences in the block to the east. The
proposed canopy will be a minimum of 75 feet at its closest point from the
adjoining residence to the east.
In consideration of the above factors, the Board of Zoning recommends
the granting of the appeal to establish a building line of zero (0.00)
feet from the north property line on the above described property for
the purpose of constructing a canopy over the church entrance in accord-
ance with plans submitted December 21, 1961.

Beginning 131 feet east of the southeast corner of Snelling and Thomas
Avenues, thence east a total distance of 29 feet.
By relaxing this requirement for the distance noted, a portion of Lots 9 and 10
(zoned IIC11 residence) of the following described property would be v4Te�."

Purpose of Appeal
To provide a canopy over sidewalk between the entrance to the church
office - dducational wing and the public sidewalk.
Appealing under Ordinance
Chapter 64.03 paragraph "j" of the Legislative Zoning Code. Set back
requirement,-Chapter 62.0.
Description of Canopy t
The proposed canopy will parallel Thomas Avenue and be twenty -eight (28)
feet long by twelve and one -half (12Z) feet wide by one and one -half
O D feet thick. The soffit will average ten feet three inches above
grade. The canopy will be constructed of concrete and be supported on
the south by the proposed building and on the north by two concrete
columns twelve feet apart located approximately six and one -half (62)
feet south of the street line.
Enclosed are two prints of the plot plan by Harold Spitznagel and Associates,
dated September 12, 1961. The outline of the proposed building has been
superimposed on outlines of existing structures, sidewalks, etc. It is
anticipated that all existing buildings now on church property will be removed
or demolished.
Enclosed is a check in the amount of $20.00 for filing fee.
