In the matter of condemning and taking an easement in the land necessary for slopes] cuts
and fills, including right of removal of lateral support from subject land or remainder
thereof, occasioned by excavations thereof,or construction of slopes necessary for the
grading preparatory to building a sidewalk',-in the easement for walkway purposes in Block 6,
Highland Plains No. 2 from Collette Place4west to the west line of Lot 1, Block 6, in said
Highland Plains No. 2 and thence in a westerly direction to Return Court as opened by the
City Council
under Preliminary Order 204732 approved November 10, 1961
Intermediary Order 205245 approved December 20, 1961
A public hearing having been had upon the above improvement upon due notice, and the Council having
heard all persons, objections and recommendations relative thereto, and having fully considered the same;
therefore, be it
RESOLVED, By the Council of the City of Saint Paul that the precise nature, extent and kind of im-
provement to be made by the said City is t
condemning and taking an easement in the land necessary for slopes, cuts
and fills, including right of removal of lateral support from subject land or remainder
thereof, occasioned by excavations thereof. or construction of slopes necessary for the
grading preparatory to building a sidewalk in the easement for walkway purposes in Block 6,,,
Bisanz Highland Plains No. 2 from-Collette Place west to the west line of Lot 1, Block 6,,
in said Bisanz Highland Plains No. 2 and thence in a westerly direction as opened by the
City Council to Return Court
and the Council hereby orders said improvements to be made.
RESOLVED FURTHER, that the following land, lands or easements therein be and the same are
hereby ordered to be taken, appropriated and condemned for the purpose of making said improvements, viz.:
For slopes, cuts and fills, including right of removal of lateral support from
subject land or remainder thereof, occasioned by excavations thereof or construction of
slopes necessary for the grading preparatory to building a sidewalk in the easement for
walkway purposes in Block 6, Bisanz Highland Plains No. 2 from Collette Place west to the
west line of Lot 1, Block 6, in said Bisanz Highland Plains No. 2 and thence in a westerly
direction as opened by the City Council to Return Court to the extent shown on the plan on
file in the office of the Commissioner of Public Works.
RESOLVED FURTHER, That the Commissioner of Public Works be and is hereby instructed and
directed to prepare plans and specifications for said improvement, and the proper city officials are hereby
authorized and directed to proceed with the making of said improvement in accordance therewith. 7

liminary order of the Council, known as Council File No. 204732
approved November 10, 19 61 relative to
Condemning and taking an easement in the land necessary for slopes, cuts and
fills, including right of removal of lateral support from subject land or re-
mainder thereof, occasioned by excavations thereof or construction of slopes
necessary for the grading preparatory to building a sidewalk in the easement
for walkway purposes in Block 60 Highland Plains No. 2 from Collette Place
west to the west line of Lot 1, Block 60 in said Highland Plains No. 2 and
thence in a westerly direction to Return Court as opened by the City Council
