AW ORDINANCE AMENDING THE ZONING CODE,
CHAPTERS 60 TO 64, INCLUSIVE,_OF THE'
SAINT PAUL LEGISLATIVE CODE, PERTAINING
TO USE DISTRICTS, HEIGHT DISTRICTS AND
REZONING OF CERTAIN PROPERTIES IN THE
CITY OF SAINT PAUL, AS AMENDER: THIS
IS AN EMERGENCY ORDINANCE RENDERED NECES-
SARY FOR THE PRESERVATION OF THE PUBLIC
PEACE, HEALTH, AND SAFETY.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
WHEREAS, heretofore, the Zoning Code, Chapters 60
to 649 inclusive, of the Saint Paul Legislative Code;
pertaining to Use Districts, Height Districts and rezoning
of certain properties in the City of Saint Paul, as amended,
was further amended by Ordinance No. 11231, approved April 17,
1958, so as to rezone and reclassify thereunder, in the
Commercial District thereby established, the several parcels
of land abutting thereon and extended therein and,,subject to
the existing dedicated public street or public Alley ease-
ment therein,,embraced by the following described now vacated
sections of-'public streets and public alleys situate within
Lot 3, Block 2, Western Area Addition, according to the
Official,Plat of said addition, filed and registered in the
Office of the Registrar of Titles, in and:fgr Ramsey County,
Minnesota,.to- wit.:
"All of those
parts of St. Anthony Avenue,
Cathedral Place, Ravoux Street, and Old
Military Eoad, also known as Territorial
Road now vacated, lying within Lot Three
(3) 9 Block Two (2), Western Area Addition.
'All that part of the alleys, now vacated,
formerly abutted b Lots Eleven (11), Twelve
(12), Thirteen (13T, Fourteen (14), Fifteen
(15) and Sixteen (16), Block One "(1). Dewey,
Drake and Pence's Addition to Saint Paul and
now being a part of Lot Three (3), Block Two

and
WHEREAS, by virtue of said amendment to said
Zoning Code, among othp-r things, the aforesaid several
parcels of land, and all of the same, then embraced by each
aforesaid section of public street or public alley, now
vacated,were'rezoned and reclassified thereunder in the
Commercial District established by said Zoning Code despite
the absence therefrom of any specific reference to any
public street or public alley area save for the platted
descriptions of the subject platted parcels of land thereby

extended therein and embraced by the aforesaid several
sections of public streets and public alleys, now vacated;
and that, for the purpose of the removal of any doubt or
uncertainty which might otherwise appear to exist pertaining
to the same that the aforesaid Commercial District zoning
and classification of said several sections of vacated
public streets and alleys be confirmed hereby and hereunder.
Section 1. That the Zoning Code, Chapters 60 -64,
inclusive, of the Saint Paul Legislative Code, pertaining
to Use Districts, Height Districts and rezoning of certain
properties in the City of Saint Paul, as amended, be and
the same hereby is further amended so that thereunder and
thereby the several parcels of land embraced by the follow-
ing described sections of vacated public streets and public
alleys, situate within Lot 3, Block 2, of Western Area
Addition, according to the Official Plat thereof, filed and
registered in the office of the Registrar of Titles in and
for Ramsey County, Minnesota, to -wit:
"All of those parts of St. Anthony Avenue,
Cathedral Place, Ravoux Street, and Old
Military Road, also known as Territorial
Road now vacated, lying within Lot Three
(3), Block Two (2), Western Area Addition.
"All that part of the alleys, now vacated,
formerly abutted byy Lots Eleven (11), Twelve
(12), Thirteen (13), Fourteen (14), Fifteen
(15) and Sixteen (16), Block One (1), Dewey,
Drake and Pence's Addition to Saint Paul and
now being a part of Lot Three (3), Block Two
(2), Western Area Addition. "'

zoning and reclassification of the same by virtue of the
amendment of said Zoning Code, as amended, by City of Saint
Paul Ordinance No. 11231, approved April 17, 19589 in such
Commercial District, shall be expressly confirmed.
Section 2. That the aforesaid Commercial District
zoning and classification status of each said parcel "of

The Housing and Redevelopment Authority of the City of Saint Paul,
Minnesota, pursuant to the provisions of Chapter 64, Zoning Code of
the City of Saint Paul, hereby request your Honorable Body to establish
and confirm the zoning for the following described vacated streets
and alleys situated within Lot Three (3), Block Two (2) of the Western
Area Addition and as shown on Exhibit One (I) attached hereto, is that

The City Council of the City of Saint Paul, Minnesota, by ordinance,
Council File No. 186770, adopted on April 17, 1958, rezoned the pro-
perty situated within the tract of land now described as Lot Three
(3), Block Two ,(2), Western Area Addition, then existing zoning
classification to Commercial District .l That at the time of passage
of said ordinance the streets and alleys, now vacated and referred r
to above and shown on said attached Exhibit One ,(1), had not been
vacated and the prop &rty abutting on said vacated streets and alleys
in said rezoning ordinance were described by Lot and Block descrip-

At the City Council of the City of Saint Paul, Minnesota, by Resolution,
Council File No. 187282, adopted May 6, 1958, vacated certain streets:.,. ry
and alleys situated within the Western Redevelopment Area, Project No.
U.R. Minn: 1 -2, including the streets and alleys, now vacated, described
above and situated within Lot Three (3), Block Two r(2), Western Area
Addition.

That the Housing and Redevelopment,Authority of the City of Saint Paul,
Minnesota, on May 12, 1961, entered into a Contract with the Ravoux
Company for the sale of Parcel #4,,Western Redevelopment Area, Project
No. U.R. Minn. 1 -2, as said parcel is identified on Parcelization Map
dated March, 1960, for said project area being the real property now
described as Lot Three t(3), Block Two (2),,Western Area Addition. In
accordance with the Redevelopment Plan for said project area and said
Contract for the sale by the Authority of said Parcel #4, all of Lot
Three (3), Block Two 1(2), Western Area Addition, is to be developed by
the purchaser thereof for commercial use including those portions
thereof described as being vacated streets and alleys. That in accor-
dance with said Contract, the Authority is required to, prior to con-
veyance, rezone all of the property being sold thereunder to "Commercial"
and it is necessary that zoning as to said vacated streets and alleys
situated within said Lot Three �(3), Block Two ,(2),,Western Area Addi-
tion, be established and confirmed to be that ,of a Commercial Use
District for the purpose of carrying out the objectives of the Redevelop-
ment Plan for the Western Redevelopment Area,.Project.No. U. R. Minn.
1 -2 and the Contract for the sale, conveyance and redevelopment of
said parcel of land.
That the Housing and Redevelopment Authority of the City of Saint Paul,
Minnesota, is the owner of all the real estate affronting on said
vacated streets and alleys, and the undersigned signatures represent
signatures on behalf of owners of at least two - thirds x(2/3) of the
several descriptions of real estate situated within one hundred x(100)
feet of the said vacated streets and alleys. That the Housing and
Redevelopment Authority of the City of Saint Paul, Minnesota, is the
owner of all the land embraced in the areas of said above described
vacated streets and alleys.

Dear Madam:
This is in the matter of the petition of the Saint Paul Housing & Redevelop-
ment Authority to determine that the authorized use of streets and alleys
located in Lot 3, Block 2 of the Western Area Addition is commercial. The
legal description is attached.
On September 14, 1961, the Commissioner of Finance reported the petition
sufficient with the owners of both (100 %) tracts of land within the prescribed
100 foot radius having signed the petition.
- The property under consideration involves portions of vacated streets and
alleys now lying within Lot 3, Block 2, Western Area Addition which were
vacated by the City Council on May 6, 1958, C. F. 187282. The abutting
properties were classified in a commercial district by the City Council on
April 17, 1958 and at the time of the street and alley vacation the City
