The applicant has since that time enlar ed his buiidin thereby eliminating or anal ar a o to the west. Field investigation discloses that the enlarged parking lot is rea y constructed, is properly surfaced and fenced with no access to the alley. However, the 8 foot screen buffer is not provided and the applicant is requesting that this buffer be eliminated. Field investigation further discloses that the deliveries to the food market are being handled from the public alley. North and-across Maryland Avenue are various commercial uses; east and ad- joining the parking lot is a 7 unit apartment building recently constructed; south and across the public alley are single - family residences that front on Rose Avenue; west and adjoining the parking lot is the food market building The Traffic Engineer has approved the traffic relationship to Maryland Avenue inasmuch as no further drive'vays are proposed. However, he is not in favor of providing access to the public alley as requested. The plans meet the standards for this type of facility except for the required 8 foot screen buffer along the east property line. The Board is of the opinion that the 8 foot screen buffer should be provided between the parking lot and the ado joining apartment building, and also that access to the public alley should be prohibited because it will have a detrimental effect upon the single - family residences across the alley and the present loading and unloading from the public alley is undesirable. In consideration of the above mentioned factors, the Board of Zoning recommends: 1) the denial of the appeal to waive the 8 foot required side yard screen buffer; 2) the denial of the appeal to provide access to the public alley; and 3) approval of the application for the enlarged parking lot subject to providing the 8 foot screen planting buffer and providing final plans reflect- ing the Council's action on this matter. Up until last year, the adjoining lot and 50 feet of my property were vacant. For sometime, preceding this, the owner of the adjoining property had contacted me a number of times about purchasing the east portion of my ground which was not used for a parking lot but I finnally turned him down because I told him that I was going to build an addition to my existing supermarket and would need this ground for additional parking, so'he was well aware of what this would be used for before he started construe-Ung his building. At Che time the permit was granted for the adjoining parking lot, I thought it also covered this 50f eet which we did not surface at this time bent F now find that I was incorrect in this. In view of the fact that this entire block has always been zoned commercial and that the owner of the proposed building knew that a parking lot was to be built there, I request that this buffer re- striction be waived. At the time that the original permit for the park- ing lot was granted in 1952, it was granted with the provision that we would not have access to the alley, but one of the big reasons that the neighbors game fo l this objection was that the alley was in very poor condition and would not stand additional traffic that would come from this parking lot and we agreed with this, but since that time the alley has been paved, for which I am naturally paying my share, but not receiving any benefit therefrom. Also, due to the heavy volume of traffic on Maryland Avenue, if those using the parking lot so desire, could go out from the alley, it would eliminate much congestion.
